FPPD #4919 Montgomery presented the case and explained the nature of the violation. Through questioning by Assistant City Attorney Earley, Officer Montgomery confirmed that he issued Citation # 8739 on July 14, 2019 and that the photos he took were time stamped and fairly and accurately depicted the violation.  Assistant City Attorney Earley requested the photos be admitted as City's composite 1.   Special Magistrate admitted them as City's composite 1.  There was no respondent present to object to the violations.
 

The Special Magistrate finds that a violation does exist and that the Violator(s) having been provided notice and failing to appear is responsible for the violation(s). Further, this Court enters a Default Summary Judgement based on the unrefuted facts as presented in by the City. It was ordered that they pay the amount on the citation $50.00 plus $10.00 administrative fees and $18.00 late fee or a total of $78.00 within 30 days. Failure to pay the total amount within 30 days will result in the case being turned over to the St. Lucie County Court and an additional fee may be charged.

Through questioning by Assistant City Attorney Earley, Officer Futch confirmed that he issued Citation # 9011 on September 10, 2019 and that the photos he took were time stamped and fairly and accurately depicted the violation.  Assistant City Attorney Earley requested the photos be admitted as City's composite 1.   Special Magistrate admitted them as City's composite 1.  There was no respondent present to object to the violations.
 

The Special Magistrate finds that a violation does exist and that the Violator(s) having been provided notice and failing to appear is responsible for the violation(s). Animal Control Officer Pellot  read the facts of the case, presented photos, and explained the nature of the violation. Through questioning by Assistant City Attorney Earley, Officer Pellot confirmed that he initiated Case # 19-2295 on August 10, 2019 and that the photos he took were time stamped and fairly and accurately depicted the violation.  Assistant City Attorney Earley requested the photos be admitted as City’s composite 1.   Special Magistrate admitted them as City’s composite 1. He said he issued 3 citations on that Saturday after receiving a call from 911 about a dead dog.  He checked and found the dog inside a wire crate.  There was food but no water.  The dog was dead.  He added the dog would be in fairly good shape if he had not been sick and died.  

Alexis Fitzpatrick was sworn in.   She could not keep the dog where she lived, so she had her friends keep him.  They got another dog and did not take care of this one. She knew the dog was sick but did not get any medical care.  The dog died on Friday and she was going to bury the dog on Saturday, August 10.   She said she had gotten the rabies vaccine from a local store and was administering them herself.  She showed a receipt; however, Code Compliance Manager Arraiz said this was not a valid rabies vaccination because only vets were allowed to administer them.
 

The Special Magistrate found a violation does exist and the violators are ordered to pay the amount on the citation number(s) listed above. Failure to pay the total amount prior to the expiration date, 30 days as of the date of this hearing, will result in the case being turned over to the St. Lucie County Court and an additional fee may be imposed.

Through questioning by Assistant City Attorney Earley, Officer Dawson confirmed that he initiated Case # 19-1505 on June 17, 2019 and that the photos he took were time stamped and fairly and accurately depicted the violation.  Assistant City Attorney Earley requested the photos be admitted as City's composite 1.   Special Magistrate admitted them as City's composite 1.  There was no respondent present to object to the violations.
 

The Special Magistrate found that a violation does exist and that Fond De Blanc Inc having been provided notice and failing to appear is responsible for the violation(s). Further, this Court enters a Default Summary Judgement based on the unrefuted facts as presented by the City. It is hereby ordered that the Violator be given the number of days recommended by the Code Enforcement Officer on the case summary sheet to come into compliance or they will be fined the amount also shown on the summary sheet. The Violator shall have 30 days within which to appeal this decision to the Circuit Court.

Through questioning by Assistant City Attorney Earley, Officer Saucedo confirmed that he initiated Case # 19-2390 on August 22, 2019 and that the photos he took were time stamped and fairly and accurately depicted the violation.  Assistant City Attorney Earley requested the photos be admitted as City's composite 1.   Special Magistrate admitted them as City's composite 1. The respondent was not present.

Douglas Diedrich was sworn in.  He said his wife worked out of town and he was there representing her.  He said he was trying to get things done. He showed his photos via phone.  Officer Debevec said she has seen the photos and there has been a lot more done since she was last out there.  She said she spoke to Mr. Diedrich prior to the hearing and agreed to continue the case.
 

The Special Magistrate, after hearing testimony from the Code Officer, continued this case until December 11.

Sam Moore and his son Gene Moore were sworn in.  The Code Officer showed him the photos.  He said these corrections had been done.  

Officer Debevec said unless the violations had changed since yesterday, they were not in compliance.

Code Compliance Manager Arraiz requested the case be continued until December 11 to allow the code officer to go out and inspect the property.
 

After hearing testimony the Special Magistrate continued this case until December 11.

Code Compliance Manager Arraiz presented the case.  She said the property was sold at a tax-deed sale and there was funds issued that would cover the fines, but she can't resolve the lien until the violations are in compliance. She said the Building Department is in the process of redoing the permits and recommended stopping the fines for 90 days.

Johnny White, the new property owner, was sworn in.  He didn't have anything to say except to request the fines be stopped.
 

The Special Magistrate, after reviewing the criteria required by Rule 16 and after considering the facts, ordered the fines be stopped from accruing for 90 days to allow property owner to correct the violations. If not corrected within this time the fines will begin again. She instructed Mr. White to work with the Building Department to get the necessary permits.

IPMC 304.2 Protective treatment.
Code Officer Debevec read the facts of the case stating it had previously gone to a hearing and the Special Magistrate issued an order giving Morris/Satwick 45 days to paint the building or a fine of $100.00 per day would be assessed.  She said this hearing was heard along with another case on the same day and a part of the necessary actions were not addressed.  Received an email from the Morris Company requesting we adjust the order to reflect the missing discussion points.

Peter Feldman was sworn in.  He said they are in the process of getting bids to paint and stucco but they did not want to do this until the roof is completed (this is the other case).  

The photos were shown on the screen to show what is needed to be done.  The Building Department confirmed that the permit had been completed.

 
 

After hearing testimony the Special Magistrate reissued the order being date specific. The building is to be pressure washed and the stucco repaired by March 14, 2020. The front of the building is to be painted by June 30, 2020. In the event the violation(s) are not cured or complied within the times given, a fine of $100.00 per day will be assessed for each violation. The violator has 30 days in which to appeal the decision in the Circuit Court of St. Lucie County.
