Minutes from the February 25, 2019 meeting
Motion was made by Jon Neprud, and seconded by Michael Broderick to approve the minutes from the February 25, 2019 meeting.

PUBLIC HEARINGS
a.
Certificate of Appropriateness 19-13 - New Residence with Variance from City Code Section 22-24(b)(3) Lot Coverage - 712 South 10th Street
Ms. Lewicka gave an overview of the application and answered questions from the Board on the disapproval notices, lot coverage, open code enforcement case and the property being visited by the Urban Forester.
Charles Frazier II, resident to the north, explained there were some oak trees on the lot that were cut down on a Friday without a permit and the lot is an eyesore due to a mound of dirt left from the clearing.
Ursula Freeman, resident to the south, asked if the new home will be built on part of her lot and expressed concerns with code violations.
Cathy Wassylenko, resident, suggested the Board revisit the design and look at the materials being used.
Ms. Mosley stated if there was a code violation filed it would be going through the county court, and she is not aware of any case that has been filed regarding the trees. Ms. Mosley said a permit has to be filed on a certain variety of trees where the trunk is greater than 9" in width. Ms. Mosley explained that if a code enforcement officer measured and found that trees greater than 9" in width had been removed, the case would be sent to the county court where a fine and replacement trees of the same variety could be ordered.
Board discussion ensued.
Ms. Mosley said in the past the Board has recommended the particular passage of an application be contingent upon the planting of certain shrubbery or landscape plan. Ms. Mosley stated she has some concerns about the actual existence of a potential violation of law.

Motion was made by Michael Broderick, and seconded by Jon Neprud to table Certificate of Appropriateness 19-13, to the next Historic Preservation Board meeting, at which point a full report from the Planning department can be given, relative to any pending code enforcement action or complaint that has been filed subject to investigation by the Code Enforcement department.
