Parking Enforcement Officer Futch presented the case and explained the nature of the violation.  Assistant City Attorney Earley stated the resondent was not present.

Through questioning by Assistant City Attorney Earley, Officer Futch confirmed that he issued Citation # 9157 on October 16, 2019 and that the photos he took were time stamped and fairly and accurately depicted the violation.  Assistant City Attorney Earley requested the photos be admitted as composite Exhibit 1.  

Special Magistrate admitted them as composite Exhibit 1.
 

The Special Magistrate finds that a violation does exist and that Dontallis Render having been provided notice and failing to appear is responsible for the violation(s). Further, this Court enters a Default Summary Judgement based on the unrefuted facts as presented by the City. It was ordered that they pay the amount on the citation $50.00 plus $10.00 administrative fees and $18.00 late fee or a total of $78.00 within 30 days. Failure to pay the total amount within 30 days will result in the case being turned over to the St. Lucie County Court and an additional fee may be charged.

Assistant City Attorney Earley stated the respondent was not present.  Parking Enforcement Officer Futch presented the case on behalf of the City.  He confirmed that he issued citation #9046 for violation of City Ordinance 10-23 (P).  He presented photos and agreed they were time stamped and accurate. The Special Magistrate admitted them as composite Exhibit 1. 
 

The Special Magistrate finds that a violation does exist and that Dontallis Render having been provided notice and failing to appear is responsible for the violation(s). Further, this Court enters a Default Summary Judgement based on the unrefuted facts as presented by the City. Parking Enforcement Officer Futch presented the case and explained the nature of the violation.  Assistant City Attorney Earley stated the resondent was not present.

Through questioning by Assistant City Attorney Earley, Officer Futch confirmed that he issued Citation # 9152 on October 9, 2019 and that the photos he took were time stamped and fairly and accurately depicted the violation.  Assistant City Attorney Earley requested the photos be admitted as composite Exhibit 1.  

Special Magistrate admitted them as composite Exhibit 1.

Shortly after this order was issued, Jacquelyn Gibson arrived.  The case was recalled and she was sworn in. The facts and photos were re-admitted. Ms. Gibson apologized for being late and said she had gone to the other court house.  She said she was going to pay the ticket this morning.
 

The Special Magistrate found a violation does exist and Jacquelyn Gibson is ordered to pay the amount on the citation $50.00 as indicated plus the administrative charges of $10.00 and the $18.00 late fee for a total amount due of $78.00 payable within 30 days of the hearing date. Failure to pay the total amount within 30 days will result in the case being turned over to the St. Lucie County Court and an additional fee may be charged.

Everton Williams was sworn in.  He said he didn't know he was parking in the wrong direction.  He saw an empty space and pulled in there.  He said he now knows and won't do it again.
 

The Special Magistrate found a violation does exist and Everton Williams is ordered to pay the amount on the citation $50.00 as indicated plus the administrative charges of $10.00 and the $18.00 late fee for a total amount due of $78.00 payable within 30 days of the hearing date. Failure to pay the total amount within 30 days will result in the case being turned over to the St. Lucie County Court and an additional fee may be charged.

Further, this Court enters a Default Summary Judgement based on the unrefuted facts as presented by the City. It was ordered that they pay the amount on the citation $50.00 plus $10.00 administrative fees and $18.00 late fee or a total of $78.00 within 30 days. Through questioning by Assistant City Attorney Earley, Officer Debevec confirmed that she initiated Case # 19-2935 on November 5, 2019 and that the photos she took were time stamped and fairly and accurately depicted the violation.  Assistant City Attorney Earley requested the photos be admitted as composite Exhibit 1.   Special Magistrate admitted them as composite Exhibit 1.

Officer Debevec said the violator has added pavers in an effort to rectify the problem.

Cristalyn West was sworn in.  She said there was no room to park the cars and the Police Department told her that parking in the street was dangerous.  

After looking at the photos again, Code Compliance Manager Arraiz recommended continuing this case to allow the Code Officer to check this information with the Police Department.

Code Enforcement Officer Debevec read the facts of the case, presented photos, and explained the nature of the violation. Through questioning by Assistant City Attorney Earley, Officer Debevec confirmed that she initiated Case # 19-1592 on June 27, 2019 and that the photos she took were time stamped and fairly and accurately depicted the violation.  Assistant City Attorney Earley requested the photos be admitted as composite Exhibit 1.   Special Magistrate admitted them as composite Exhibit 1.

Dan Williams was sworn in.  He asked if he needed a permit?  After looking at the photos showing the violations, Code Compliance Manager Arraiz, said probably not, but he should check with the building department.
 

Special Magistrate found that the violation(s) listed on the summary sheet do exist and that Dan Williams has committed or is responsible for the violation(s). She ordered that the violator(s) have 30 days in which to comply with the city code of ordinances. In the event the violation(s) are not cured or complied within the time given, a fine of $50.00 per day will be assessed for each day the violation(s) continue(s) past the date set for compliance. The violator has 30 days in which to appeal the decision in the Circuit Court of St. Lucie County.

Code Enforcement Officer Debevec read the facts of the case, presented photos, and explained the nature of the violation. Through questioning by Assistant City Attorney Earley, Officer Debevec confirmed that she initiated Case # 19-2402 on October 1, 2019 and that the photos she took were time stamped and fairly and accurately depicted the violation.  Assistant City Attorney Earley requested the photos be admitted as composite Exhibit 1.   Special Magistrate admitted them as composite Exhibit 1.

Simon and Natacha Castor were sworn in.  Mr. Castor said he didn't know they couldn't put the garbage cans under the trees; but they would be moved to the back. Officer Debevec spoke to the owner and explained that they needed to clean up, put things out of sight and repair the fence. He asked for more time to repair the fence.   
 

The Special Magistrate found that Section 16-46, 16-47, 16-48 (4) did exist but has been cured as of the date of this hearing. The violators shall be warned that if these violations re-occur, pursuant to FL Statute 162.09, the Code Officer may notify the Special Magistrate and request that a fine be entered.

Special Magistrate found that Section 16-46, 15-47, 16-48 (1) (5) and IPMC 302.7 do exist and that Natacha Castor has committed or is responsible for the violation(s). She ordered that the violator has 10 days in which to comply with the city code of ordinance Section 16-46, 16-47, 16-48 (1) (5) and 60 days for IPMC 302.7. In the event the violation(s) are not cured or complied within the time given, a fine of $50.00 per day will be assessed for each day the violation(s) continue(s) past the date set for compliance. The violator has 30 days in which to appeal the decision in the Circuit Court of St. Lucie County.

Larry and Vicky King were sworn in.  Mrs. King said they could get the violations corrected in 10 days but asked why all of the other neighbors were not being cited.  She said they have vehicles, boats, shutters etc. in their yards and on their homes.  Code Compliance Manager Arraiz said we acted on a neighbor complaint; but when the officer investigates the complaint, they usually take notice of the homes around them.  If they observe violations, they send a notice of violation and a deadline to comply.
 

The Special Magistrate found that the Section 22-60 (1)(2)(B) did exist but has been cured as of the date of this hearing. The violators shall be warned that if these violations re-occur, pursuant to FL Statute 162.09, the Code Officer may notify the Special Magistrate and request that a fine be entered.

She ordered that the violator(s) have 10 days in which to comply with the city code of ordinances. Officer Debevec said there had been no changes; however, the owner is aware of the violations.
 

The Special Magistrate finds that a violation does exist and that JBM Properties having been provided notice and failing to appear is responsible for the violation(s). Further, this Court enters a Default Summary Judgement based on the unrefuted facts as presented by the City. It is hereby ordered that the Violator be given the number of days recommended by the Code Enforcement Officer on the case summary sheet to come into compliance or they would be fined the amount also shown on the summary sheet. The Violator shall have 30 days within which to appeal this decision to the Circuit Court.

Through questioning by Assistant City Attorney Earley, Officer Debevec confirmed that she initiated Case # 19-2747 on October 20, 2019 and that the photos he took were time stamped and fairly and accurately depicted the violation.  Assistant City Attorney Earley requested the photos be admitted as composite Exhibit 1.   Special Magistrate admitted them as composite Exhibit 1.

Code Compliance Manager Arraiz explained the code ordinance and the process for Business Tax Receipts to Special Magistrate Pelletier.
 

The Special Magistrate found that the violation does exist is and R Stein LLC has committed or is responsible for the violation(s). She ordered that the violator has 0 days in which to obtain or close out the Business Tax Receipt with the City Clerk’s office. In the event the violation(s) are not brought into compliance within the time period given, per Section 162.09, Fla. Stat., a fine of $150.00 per day will be assessed. She further ordered that after the 30-day period, if not in compliance, all utilities to the premises were to be suspended while the violation continues. The violator has 30 days in which to appeal her decision in the Circuit Court of St. Lucie County

Code Compliance Manager Arraiz read the facts of the case and reviewed the 3 criteria necessary for approving a case with fines.  There is no lien recorded at this time.  Mr. Tarr made the corrections and City is agreeable to the reduction.
 

Special Magistrate Pelletier, after reviewing the 3 criteria required by Rule 16 and after considering the facts, ordered the fines be reduced from $7,880.00 to $1,153.12 payable in 30 days. If not paid within this time the fines would revert to the original amount and a lien would be recorded at the St. Lucie County Clerk of Court’s Office.
