Code Officer Isaac Saucedo read the facts of the case, presented photos, and explained the nature of the violation. Through questioning by Assistant City Attorney Earley, Officer Saucedo confirmed that he initiated Case #20-0792 on April 1, 2019 and that the photos he took were time stamped and fairly and accurately depicted the violation. Assistant City Attorney Earley asked if the respondent had seen the photos and having been confirmed that he did, she asked that the photos be admitted as City's composite 1 and so they were by the Special Magistrate.
Simon Castor was sworn in. He said his tenants are supposed to take care of the violations and he will go back by and see if it's been done.
The Special Magistrate found that Section(s) 16-46, 16-47, 16-48 (11) Outside Storage - Indoor Furniture did exist but has been cured as of the date of this hearing. The violators shall be warned that if these violations re-occur, pursuant to FL Statute 162.09, the Code Officer may notify the Special Magistrate and request that a fine be entered.
The Special Magistrate found that the remaining violation(s) 16-46, 16-47, 16-48 (1) (5) Outside Storage does exist and that Simon Castor has committed or is responsible for the violation(s). She ordered that the violator(s) have 10 days in which to comply with the city code of ordinances. In the event the violation(s) are not cured or complied within the time given, a fine of $50.00 per day will be assessed for each day the violation(s) continue past the date set for compliance. The violator has 30 days in which to appeal the decision in the Circuit Court of St. Lucie County.

Adrian Curtis Hudson was previously sworn in. She said she was on disability and financially unable to pay the fine. She said she did all the work. She put everything on the carport or the back screen area. She didn't know she was being fined. She thought she was in compliance. But, she was told after the fines started that she couldn't have anything on the carport. She moved everything she could and what she couldn't move, she gave away to charity.
Special Magistrate Ross, after reviewing the 7 criteria required by Rule 17 of the Rules of Procedure, recommends to the City Commission to reduce the $2,580.00 lien to $1,100.00 payable 18 months. If not paid within this time period the lien reverts back to the original amount.

Special Magistrate Ross, after reviewing the 7 criteria required by Rule 17 of the Rules of Procedure, recommended reducing the lien from $3,500.00 to $1,100.00 payable 18 months after Case #19-2726 is paid. Failure to pay the reduced amount within the time ordered, results in the lien reverting to its original amount.
