Code Officer Isaac Saucedo read the facts of the case, presented photos, and explained the nature of the violation.  Through questioning by Assistant City Attorney Earley, he confirmed that he initiated Case #20-2337 on October 14, 2020 and that the photos he took were time stamped and fairly and accurately depicted the violation.  After showing the photos to the respondent, Attorney Earley requested the photos be admitted as City's 1 composite, which they were.
 
Candance Walencia Brown was previously sworn in.  She said she was not parked in front of the dumpster, but off to the side. Saturdays are very busy in this area and she saw no signs saying she couldn't park there.  She submitted photos also which were admitted as Respondent's 1.

Code Compliance Manager Arraiz said there were no signs but pointed out the lines that shows no parking.  They are faded and the City is planning on repainting them, but they can be seen.
 

Special Magistrate Pelletier, after considering the facts of the case and the respondent's testimony, dismissed the case.

Code Officer Saucedo read the facts of the case and presented photos, which after being shown to the property owner, were admitted as City's 1 composite.

James and Sharon Brady were sworn in.  Mr. Brady said he understood about the parking situation and was trying to get it corrected.  He has had a lot of health problems lately and the rainy weather has caused some delay.  He asked for a little more time.

Code Compliance Manager Arraiz said they were willing to extend the time to 30 days.
 

Special Magistrate Pelletier found that the violations listed on the summary sheet do exist and that James & Sharon Brady has committed or is responsible for the violations. She ordered that the violators have 30 days in which to comply with the City's Code of Ordinances. In the event the violations are not cured or complied within the time given, a fine of $100.00 per day will be assessed for each day the violations continue past the date set for compliance. The violators have 30 days in which to appeal the decision in the Circuit Court of St. Lucie County.

Code Officer Dawson read the facts of the case.  He stated the violations were in compliance as of the date of the hearing and requested an Order of Review and Determination be issued.
 

Special Magistrate found that section 125-315 (i)(2)(b) and 24-19, 24-20, 24-21 (4) did exist but has been cured as of the date of this hearing. The violators shall be warned that if these violations re-occur, pursuant to Fl Statute 162.09, the Code Officer may notify the Special Magistrate and request that a fine be entered.
