MINUTES OF A REGULAR MEETING OF THE BOARD OF EXAMINERS OF CONTRACTORS OF THE CITY OF FORT PIERCE, FLORIDA, HELD IN THE CITY COMMISSION CHAMBERS, 100 NORTH U.S. #1, FORT PIERCE, FLORIDA, AT 9:00 A.M. ON TUESDAY, August 10, 2021.

APPROVAL OF MINUTES

Approval of the July 13, 2021 meeting minutes.
 

Motion was made by Reed Sudderth, seconded by Holly Theuns to approve the minutes of the July 13, 2021 meeting. A voice vote was taken and the motion passed unanimously.

No additions or deletions to the agenda were noted.

PUBLIC COMMENTS
At staff’s suggestion, Ms. Crystal Ploszay of Unicorn Epoxy appeared for the Public Comment portion of the hearing.  Ms. Ploszay is not a painting contractor, therefore the specialty painting contractor designation is not appropriate and she does not fall into any other specialty category.  She wanted to comply with the City's regulations so she may begin her scope of work at Harbour Isle condominiums applying coating to the ground floor.  She indicated that she has all of City's requirements to obtain a Competency Card except for test scores as testing is no longer required due to the implementation of House Bill 735.  Ms. Ploszay has all other requirements of the Competency Card application including proof of Worker's Compensation and liability insurance. 

The Board determined that since she has the insurance and other information that would be needed to obtain a Certificate of Competency;  a permit is not required for this scope of work; she is knowledgeable in the field; the contract has been awarded; the work is not structural, permanent, or a liability such as balconies, etc.; and since she has earnestly appeared before the Board to seek their opinion in this situation; they came to the conclusion to make the recommendation that Ms. Plosznay does not need a contractor's license to proceed with the work. 
 
Normally the City issues a citation to contractors working without a license.  These citations often go to the Special Magistrate, who may look to the Board of Examiners of Contractors for input or recommendation.   Mr. Coss noted that as long as there are municipalities to reciprocate with, the City will continue to require the letters and test scores as part of the application for Certificate of Competency.  He indicated that hopefully in the next two years there will be more legislation that will provide more clarification, and it was noted that another solution would be to contact the legislators themselves when issues arise.
