Shaun C presents the case - this case was continued from a previous hearing.  A representative of the tenant is present.  The tenant is in the process of purchasing the property.  Mr. Coss states that he has been advised that their intent is to obtain an interior demo permit to remove the violation.  They then plan to submit a permit application in 2022 for a comprehensive renovation of the property.  The City recommends continuing the case to allow for the sale of the property.  The Special Magistrate grants a continuance to the March 2022 hearing.

Exh 1.  The owner responds that the roof permit that was obtained.  The contractor saw extra work that had to be done on the soffit, fascia, and the support post required a separate permit.  The permit requires that an engineer signs off on the support post.  Mr. Coss explains that fascia can be included in a roof permit, but the soffit and post would have to be on a separate permit.  The case was continued to the February 2022 hearing.

The owner states that the permit is still under review, she states that it was submitted in September or October.  Mr. Coss clarifies that it was initially rejected for lacking pertinent information.  Revisions were submitted this month and rejected for lacking information on the ladder and electrical connection.  Staff confirmed that the ladder has been removed and there is no imminent safety concern.  The Special Magistrate finds that a violation exists and that the owner is responsible and provides 60 days to get a permit or a fine may accrue.

Section 5-1.105.1 (2017) Permit Required
Shaun Coss presents the case for the City, which is a Massey Hearing for a fine reduction.  The owners are present.  The total amount of the fines is $1,840.00.  The owners have requested a complete rescinding of the fines.  They were under the impression that the inspector signed off on the permit.  They renewed the permits and got the final inspections.  They contend that they did everything necessary and should not be fined.  The City points out that there is nothing in our computer system that shows that a final inspection was requested before the permit expired.  All properly requested inspections create an open inspection in our computer system.  Mr. Coss asks for a recess to review the documentation of the owners.  After the recess the City proposes reducing the fines to $413.30, which is agreeable to the owner.  The Special Magistrate orders that the fines be reduced to that amount to be paid within 10 days to pay.
