Motion was made by Frank M. Blandino that the violations do exist and the violators who are not present are deemed to have admitted guilt. He further ordered that they be given the number of days recommended by the Code Enforcement Officer on the case summary sheet to come into compliance or they would be fined the amount also shown on the summary sheet.

Peggy Arraiz read the facts of the case and went over the 3 criteria of Rule 16 of the Rules of Procedure.  Once the bank learned of the violations and after the bank work orders were approved, City Mortgage proceeded to cure the violations.   Staff is willing to accept their offer of $1,273.00 which would cover the administrative fees.
 

Motion was made by Frank M. Blandino who reviewed the 3 criteria required by Rule 16 and ordered the fines be reduced to $1,273.00 payable within 60 days. If not paid the fines would revert back to the original amount and a lien would be recorded at the St. Lucie County Clerk of Court’s Office.

Officer Avery read the facts of the case into the record.  Mr. Petersen has been working steadily on correcting the violations and did comply the one case prior to the hearing date. Due to the rainy season approaching he is asking for 90 additional days and Staff is agreeable to this.
 

Motion was made by Frank M. Blandino that the Respondent’s request for an extension of time within which to comply with the requirements of the Special Magistrate’s Order Determining Violation dated November 5, 2014 be and the same is hereby granted to the extent specified in this Order. In the event the violations specified in said Order Determining Violation dated November 5, 2014 are not remedied within 90 days of today's date May 6, 2015, there shall be imposed a fine at a daily, cumulative rate of $250.00. All other provisions of said Order Determining Violation dated November 5, 2014 shall remain in full force and effect.
