MINUTES OF A REGULAR MEETING OF THE SPECIAL MAGISTRATE BOARD OF THE CITY OF FORT PIERCE, FLORIDA, HELD IN THE CITY HALL COMMISSION CHAMBERS, 100 NORTH U.S. #1, FORT PIERCE, FLORIDA, AT 9:00 A.M. ON WEDNESDAY, SEPTEMBER 2, 2015.  THERE WAS TECHNICAL DIFFICULTIES WITH THE AUDIO TODAY.

Officer Shaun Coss read the facts of the case.  He asked that the order include obtaining a permit for all work that has been started or has been completed.  Alan Berger, representing I.P.O. Realty was sworn in. He stated that they did not know the violations existed. They have hired a contractor and once he is registered with the city they will obtain a permit and get the work done.  He asked for additional time.
 

Motion was made by Frank M. Blandino that a violation does exist and that Land Trust Service Corp (TR) has committed or is responsible for the violations. He ordered that the violator has 30 days in which to obtain the permit and comply with all permit conditions. In the event the violations are not cured or complied within the time period given, a fine of $100.00 per day will be assessed for each day the violation continues past the date set for compliance. The violator has 30 days in which to appeal his decision in the Circuit Court of St. Lucie County.

Shaun Coss read the facts of the case.  He went over the violations that are in compliance and  the violations that are still active.  He stated that he had done a walk- thru with the property manager and they are in agreement with the violations.  He asked for 30 days to obtain the permit and comply or a fine of $100.00 per day.

Peggy Arraiz read the facts of the case and stated due to being a new owner, the 7 Criteria of Rule 17 of the Rules of Procedure did not apply in this case.  She stated this was a tax lien sale and there were excess funds for which the City received a check in the amount of $31,111.00.  There are two code violation liens against the property and a lot clearing lien.  The new owner and Staff are in agreement to settle these liens with the excess funds payment.
 

Motion was made by Frank M. Blandino  that after reviewing the 7 criteria required by Rule 17, that the City Commission reduce the lien to $24,000.00.

Officer Andy Avery read the facts of the case. Bruce Isenhour was sworn in for testimony.  He stated that he now has family coming to help him do the repairs and that he has checked with the SHIP program on where he stands in his request for financial assistance.  He has moved up; but in the meantime he needs more time to get the work done.  Officer Avery stated that this was the first time he had heard that someone was coming to help Mr. Isenhour out.  Peggy Arraiz suggested that they continue the case to allow the Special Magistrate to continue monitoring the progress rather than issuing an order.  Mr. Isenhour and Staff were in agreement to this.
 

Motion was made by Frank M. Blandino that the case be continued until the first meeting in January which is January 6, 2016. He asked that Officer Avery continue monitoring the progress.
