A translating service is used for this recalled case and services are obtained by phone.  The owner is present.  Frank Remling presents the case for the City.  He explains that the owners were to obtain a survey showing the location of the fence that the owner is building.  The neighbor who made the complaint is present.  The owner describes the dispute between him and the neighbor that led to him calling the police.  The City Attorney questions the owner, asking if he obtained the survey.  The owner says that he spoke to a company but told them to wait because of the trouble between him and the neighbor and he wanted to see what direction would be given him from this hearing.  Photos are entered into evidence as City's Comp. Exh. 1. The neighbor, James Bryan is present and has a survey from over a year ago. Mr. Bryan said that the damage that he did, did not prevent the owner from getting a survey.  Mr. Bryan provides a copy of the survey that he had done.  The survey is entered into evidence as Respondent's Exh. 1.  He says that his property line falls inside the fenced area.  He shows photos of the fence from his phone.  The owners of 1117 Paseo decline to look at the pictures. The Special Magistrate asks if the fence is permanent.  The owner states that he only built 2 inches in one spot and 8 inches in another area.  The Special Magistrate asks why he hasn't gotten a survey. He said that the neighbor said he was going to tear it down and so he didn't get the survey.  The Special Magistrate asks if he admits that the fence is on the neighbor's property. No he responds.  He is asked how long it would take him to get a survey.  He responds that the neighbor interferes and so he doesn't get the survey.  The neighbor states that he will not interfere with a survey and doesn't stay there.  The City asks the Special Magistrate to rule since the owners have already been provided time to get a survey and has not done so. The Special Magistrate finds that a violation does exist and the owners are responsible, and are provided 30 days to work toward getting the permit or fines may accrue.  Mr. Coss clarifies that there is a permit and asks that the order be to get a survey as a revision to the permit within the 30 days.  The Special Magistrate so orders.

She contends that the photos are from road and not from the perspective of the parking lot itself.  The City shows pictures from Google Earth in 2019 & 2021 where it appears that millings were installed, removed and then reinstalled.  The owner states that the millings were removed but some left and smoothed out to cover potholes.  The Special Magistrate continues the case to the February hearing.

Shaun Coss reads the case into the record for the City.  Photos are entered into evidence as City's Comp. Exh. 1. Mr. Coss describes what is seen in the photos.  Mr. Conquistador Ray is present and speaks on behalf of the owner, his cousin.  They explain that the property has changed hands.  Mr. Coss offers to look at St Lucie Public Records to see if the property has changed hands.  Mr. Coss finds the quit claim deed and suggests that this case be dismissed. The case will be started over with the new owner.  The Special Magistrate states that it be dismissed and restarted.

Shaun Coss presents this lien reduction case for the City. The owner, Mr. Pedro Alonso is present. The owner asks that the lien be reduced to $3,000.00.  This coincides with the Special Magistrate's Rules of Procedure, Rule 17.  This provides that if City staff agrees to this reduction and it is approved by the Special Magistrate, then it will not have to go before the City Commission.  Staff does agree with this reduction.  Mr. Alonso explains that the original owner bought the house but was living out of the country.  He was originally partnered with someone who did not make him aware of the violation.  He then partnered with Mr. Alonso, who is a contractor, brought the property into compliance.  The Special Magistrate agrees to the reduction, to be paid within 5 months.

Shaun Coss presents the case for the City.  This is a request for a lien reduction, and the owner is present.  The City is willing to reduce the lien amount to $822.62.  The Special Magistrate approves the lien to be reduced to $822.62.  The owner asks to be given 5 months to pay. She explains that this case will have to go before the City Commission for final approval of the reduction.
