MINUTES OF A REGULAR MEETING OF THE CITY COMMISSION OF THE CITY OF FORT PIERCE, FLORIDA, HELD IN THE CITY HALL COMMISSION CHAMBERS, 100 NORTH U.S. #1, FORT PIERCE, FLORIDA, AT 5:05 P.M. ON MONDAY, MARCH 04, 2024.

CALL TO ORDER
Mayor Hudson called the March 04, 2024, Regular Meeting of the City Commission to order at 5:05 P.M.

Approval of the Minutes from the February 20, 2024 Regular Meeting.
 

Motion was made by Commissioner Curtis Johnson, Jr., seconded by Commissioner Arnold Gaines to approve the minutes of the February 20, 2024, Regular Meeting.

City Manager Nick Mimms requested the addition of a letter of support for St. Lucie County’s Harbour Pointe Regional Boat Ramp Facility Grant as item 13b.
 
 

Motion was made by Commissioner Jeremiah Johnson, seconded by Commissioner Arnold Gaines to approve the agenda as amended with the addition of item 13b.

COMMENTS FROM THE PUBLIC ON AGENDA ITEMS NOT REQUIRING PUBLIC HEARINGS

CONSENT AGENDA
 
a.
Approval of First Amendment to contract RFQ 2019-027 Professional Engineering Services with Kimley Horn and Associates.
 
b.
Approval of Change Order 1 for the Delaware Avenue Striping Project with TRP Construction Group, LLC in an amount not to exceed $1,421.00.
 
c.
Approval of Public Service Agency Grant Agreement for First United Methodist Church of Fort Pierce in the amount of $5,000.00.
 
d.
Approval to increase Purchase Order No. 24-0435 with Fleet Air Maintenance to provide emergency temporary solid waste mechanic staffing in an amount not to exceed $150,000.00.
 

Motion was made by Commissioner Michael Broderick, seconded by Commissioner Arnold Gaines to approve the Consent Agenda.

PUBLIC HEARINGS
Quasi-Judicial Hearings follow a strict set of rules and procedures which can be found on the City’s website using this link: https://www.cityoffortpierce.com/DocumentCenter/View/6740/Quasi-Judicial-Procedures. All Quasi-Judicial decisions by the City Commission must be based on competency substantial evidence. Competent substantial evidence is evidence which will establish a substantial basis from which the fact at issue can reasonably be inferred. It includes fact or opinion evidence offered by an expert on a matter that requires specialized knowledge and that is relevant to the issues to be decided. It is evidence a reasonable mind could accept as having probative weight and adequate to support a legal conclusion. Hypothetical, speculative, fear or emotion based generalized statements that do not address the relevant issues and that cannot be reasonably said to support the action advocated, are not competent substantial evidence.

CITY COMMISSION
 
a.
Resolution 24-R11 establishing a fee for the Police Department's "Private Property Enforcement Program" and designating the revenue for Police Department use to replenish the signs and fund community engagement activities and events with the remaining funds. 
 
City Clerk Linda Cox introduced the Resolution, read by title only, into the record.

RESOLUTION NO. 24-R11
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF FORT PIERCE, FLORIDA; ESTABLISHING A FEE OF $30.00 FOR PROVIDING FORT PIERCE POLICE DEPARTMENT “NO TRESPASSING” SIGNS PURSUANT TO THE PRIVATE PROPERTY ENFORCEMENT PROGRAM AND AUTHORIZING PROCEEDS TO BE USED FOR COMMUNITY ENGAGEMENT ACTIVITIES AND EVENTS; PROVIDING FOR A SEVERABILITY CLAUSE; REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE.
 
Mr. Mimms explained the increase and how it would be utilized by the City.
 
 

Motion was made by Commissioner Curtis Johnson, Jr., seconded by Commissioner Jeremiah Johnson to approve Resolution No. 24-R11.

City Manager Nick Mimms Commented on the City Manager’s Report which highlighted the Cracker Trail Parade, The Highwaymen Festival, and Chart Your Course event.

COMMENTS FROM THE COMMISSION
Commissioner Curtis Johnson commented that Ms. Brown summed it all up as to Brightline with the City moving forward and encouraged the citizens, announced the new fire engine, and wished the City happy Spring.

Commissioner Broderick commented on Ms. Brown’s comments, Coast Guard recruitment day, and the public works departments streetlight replacement on Seaway Drive.

Commissioner Gaines commented on Ms. Brown, strategic planning, Navy Museum tour, and inquired on City signage.

Commissioner Jeremiah Johnson commented on the great things and opportunities coming to the City, streetlamps and public works, and the fair.

Mayor Hudson commented on Ms. Browns' comments, the police department's handling of the recent event at the Federal Court House, the Great American Clean Up, the Farmers Market, Chart Your Course, and Legislative events.

ADJOURNMENT

Immediately following adjournment, please move toward the doors and exit the chambers. This allows for the safe and courteous exit of all persons, and those on the dais. Conversations after the meeting should be held outside of chambers, in the foyer or elsewhere, but not in the commission chambers where lights will be out as soon as the chambers are empty.
Mayor Linda Hudson adjourned the meeting at 5:43 P.M.
