Mayor Hudson called the January 21, 2025 Regular Meeting of the City Commission to order at 5:05 P.M.

Acting City Manager, Linda Cox pulled items 12G and 11E at the request of staff, announced that representatives from Live Oaks Holdings and Mainsail were present, and requested they be permitted to speak during miscellaneous reports, item 10.

The commission inquired about Live Oaks Holdings, Mainsail speaking, and the third amendment draft.

Ms. Cox clarified that the purpose was introductions.

City Attorney, Sara Hedges provided an update on the third amendment finalization.
 
 

Motion was made by Commissioner Michael Broderick, seconded by Commissioner Curtis Johnson, Jr. to approve the agenda as amended.

MISCELLANEOUS REPORTS
Scott Hawkins, Jones Foster, on behalf of Audubon, provided an update notifying the Commission that Live Oak would be the lead developer in the project. 

Bill Ware, Live Oak commented on the the PSA, Marriott franchise agreement, site plans, and third amendment. 

Joe Collier, President and Founder of Mainsail, commented on the length of the project, clarified Mariott's participation provided company history,

The Commission inquired on the timeline, design process, curated property process, branding, project vision, and the financing package. 

Mr. Collier commented on the timeline, design process, permitting process, branding, the hotel vision, and financing. 

Paul Bertozzi, Live Oak, commented on the working relationship with Mr. Ware. 
 
11.
CONSENT AGENDA
 
a.
Approval of Security Camera System, Police Department, Securitas Electronic Security, Inc. Uniontown, OH, in the amount of $255,845.72. 
 
b.
Approval of First Amendment to the Interlocal Funding Agreement with St. Lucie County, FL for Homeless Services
 
c.
Authorize staff to negotiate a traffic signal maintenance continuing service contract with Econolite Systems with an annual cost of $175,000.00; final contract will come back for approval.
 
d.
Authorization for the Mayor to sign an affidavit to be submitted to the Department of Florida Commerce notifying them that the city will perform the Comprehensive Plan Evaluation and Appraisal review.
 
e.
Approval or denial of the request for the Third Amendment to the Amended and Restated Agreement for Development of King's Landing.
Commissioner Gaines pulled item 11a for discussion.
 

Motion was made by Commissioner Arnold Gaines, seconded by Commissioner Michael Broderick to approve items 11a-11d of the Consent Agenda.

All Quasi-Judicial decisions by the City Commission must be based on competency substantial evidence. Competent substantial evidence is evidence which will establish a substantial basis from which the fact at issue can reasonably be inferred. It includes fact or opinion evidence offered by an expert on a matter that requires specialized knowledge and that is relevant to the issues to be decided. It is evidence a reasonable mind could accept as having probative weight and adequate to support a legal conclusion. Hypothetical, speculative, fear or emotion based generalized statements that do not address the relevant issues and that cannot be reasonably said to support the action advocated, are not competent substantial evidence.

Kerry Driver, Planner , presented the review and approval of voluntary annexation at 3302 Avenue B.
 
RECOMMENDATION:

As proposed, the annexation meets the standards of the City's Comprehensive Plan, specifically Policy Section 1.11 regarding annexations. Therefore, the Planning Staff recommends approval of the proposed voluntary annexation, along with the associated Future Land Use designation RL and the Zoning classification R-3.

Questions of Staff:

The Commission inquired on zoning classification, what is on the property, and its county zoning.

Mr. Freeman commented on the zoning classification.

Ms. Driver commented on the county zoning as the property owner has adjacent properties.

RECOMMENDATION:

Staff recommendation is for the City Commission to APPROVE the proposed amendment to the COA Approval Matrix.

Kris Einstein - Supports the COA process

Commissioner Johnson inquired if the process has parameters for the identification of historic sites and suggested including local realtors in the identification process.

Ms. Cox commented that Tyler can identify historical processes through the GIS.

Mr. Freeman commented on the use of zoning identification and suggested yearly informational materials for existing owners.

The Commission discussed identification markers and processes for properties that have not maintained historical guidelines, and options for designation on St. Lucie County Property Appraiser. 

Mr. Freeman explained how owners are notified of historical guideline violations.

Ms. Hedges commented on unpermitted , violated processes and compliance.

Update on City Manager applicants and the establishment of a timeline. 
Sara Hedges, City Attorney inquired on additional applicants and Special Meeting for February 5, 2025 at 5:05 p.m., and interviews for February 18,2025.


Commission Johnson inquired on applications without a questionnaire.

Ms. Hedges commented that the five were given the opportunity to complete the questionnaire.

Jared Sorenson, Human Resources Manager, confirmed the Commission requirements were met and explained the executive summary.

Acting City Manager, Linda Cox, commented on the cold weather shelters opening at the Percy Peek Gym, Sunrise Theatre RFP, thanked South Beach volunteers for their hard work and strategic planning on Thursday.

Commissioner Johnson - commented on the MLK parade, and the upcoming job fair.

Commissioner Taylor - commented on FPUA tour and thanked Charlene Adair and the South Beach volunteers.

Commissioner Gaines commented on the job fair January 29th, park renovations, MLK parade, and noise ordinance concerns.

Ms. Cox commented that a consultant will be hired regarding the noise ordinance.

Ms. Hedges commented on the actions taken for violations of the noise ordinance. 

Mayor Hudson commented on Charlene Adair and the South Beach volunteers, traffic signal system for emergency vehicles.

Jack Andrews, Deputy City Manager, commented on the cost of implementing the traffic signal system although funds are not currently available and the intersections designated.

Commissioner Johnson mentioned exploring this with the lobbyist in Tallahassee for safety and inquired on the mapping and percent that falls within the CRA boundaries.

ADJOURNMENT

Immediately following adjournment, please move toward the doors and exit the chambers. This allows for the safe and courteous exit of all persons, and those on the dais. Conversations after the meeting should be held outside of chambers, in the foyer or elsewhere, but not in the commission chambers where lights will be out as soon as the chambers are empty.
Mayor Hudson adjourned the meeting at 8:12 p.m.
