Code Officer Isaac Saucedo read the facts of the case and presented photos marked as composite exhibit 1.  A couple of the violations are in compliance at this time; however, there are several that need to be corrected.

Aziz Chagani was sworn in for testimony.  He said the officer is right.  He spoke to the man who owns the car and told him he had to move it.  If it's not moved by the time he gets out of this meeting he will have a tow company come and get it.  He would get everything else done within the agreed 10 days.
 

Special Magistrate Ross found that a violation does exist and that Aziz Chagani has committed or is responsible for the violations. She ordered that the violator has 10 days in which to apply for the permit and comply with the conditions of the permit. In the event the violations are not cured or complied within the time period given, a fine of $150.00 per day will be assessed for each day the violation continues past the date set for compliance. The violator has 30 days in which to appeal her decision in the Circuit Court of St. Lucie County.

Code Officer Heather Debevec read the facts of the case and presented photos marked as exhibit 1.

Douglas Munyon was sworn in for testimony.  He stated he was parked there for a legitimate reason and other vehicles were parked there but he was the only one who got the ticket.  He said trades people need to be able to park their vehicles in order for them to get to their tools and equipment.

Code Compliance Manager Arraiz said he was correct; but the department follows the rules as written.  Linda Cox and the City Manager came to a decision that Mr. Munyon was correct and they agreed that trades people could purchase a parking permit for $100.00 and be allowed to park their vehicles at the job site.  Service work usually does not take more than 2 hours.
 

The Special Magistrate found a violation does exist and the violators are ordered to pay the amount on the citation $50.00 and she waived the $10.00 administrative fees and $18.00 late fees.

Code Enforcement Officer Andy Avery said he was representing Mr. Wrobleski on this case.  He presented the facts of the case and photos which were marked as Exhibit 1.  He said the violations are 50% corrected and Mr. Wrobleski confirms the rest of them can be completed within 30 days.
 

Special Magistrate Ross found that a violation does exist and that James Murphy Jr., Glenda and Francis Wrobleski have committed or are responsible for the violations. She ordered that the violators have 30 days in which to apply for the permit and comply with the conditions of the permit. In the event the violations are not cured or complied within the time period given, a fine of $100.00 per day will be assessed for each day the violation continues past the date set for compliance. The violator has 30 days in which to appeal her decision in the Circuit Court of St. Lucie County.

Officer Debevec read the facts of the case.  There were flyers advertising Tax Ready Express all over the vehicles.  She asked the violators to remove them, they did not, so she issued citations.

Deanna Woodard was sworn in for testimony.  She said she thought it was her business license (BTR) that was the problem rather than advertising flyers.  She said she had been doing this for several years and didn't know she couldn't put flyers on cars.  She has stopped since receiving the citations.  She was told that handouts were okay but they had to be hand to hand; not left on door handles, cars, etc.
 

The Special Magistrate found a violation does exist. She dismissed all citations but 3 of them and reduced the amount to be paid to $150.00 plus $10.00 administrative fees or a total of $160.00. She has 30 days in which to pay.

Failure to comply with the order dated February 15, 2017 to immediately cease and desist all current and future rentals.
Code Compliance Manager Arraiz read the facts of the case and said this was a recall.  She stated this was a tri-plex.  One part of it the city is aware of a long term resident.  The other two there are different cars coming and going.  She presented photos. 

Anthony Crincolli was sworn in.  He stated in March he had friends of the family who came down to umpire for the spring training.  There was no money exchanged and they were only there for approximately a month.  While they were there they stayed in Mr. Crincolli's unit, his grandfather had unit B and unit C was rented to an annual tenant.  

Ms. Arraiz showed rental ads that were continuing to be run.  She said the vehicles had been there for a week not a month.  She presented the lease for the annual tenant.

Crystal Dearborn and Daniel Imperati were sworn in.  They were the tenants for unit C.  They said that Mr. Crincolli's grandfather helped them move in on March 13 and they would be there until November.
 

After hearing the case that was presented the Special Magistrate ordered the original fine of $1500.00 be reinitiated and was to be paid within 30 days. Also, an immediate cease and desist of all current and future rentals of the referenced property.

Mr. Mackey purchased the properties and wasn't aware of the violations.  There were originally permits issued but they expired.  The permit for 202 Dundas Court was issued again but the other two properties were not renewed.  He spoke to Mr. Mackey prior to the hearing and he agreed that he could get everything done in 60 days.  He asked the Special Magistrate to stop the fines and if not complied after the 60 days restart and file the lien.

Damian Mackey was sworn in.  He had no comment at this time and understood the terms.
 

The Special Magistrate, after reviewing the 3 criteria required by Rule 16 and after considering the facts, ordered the fines be stopped from accruing for 60 days to allow property owner to correct the violations. If not corrected within this time period the fines will begin again and a lien will be filed with the St. Lucie County Clerk of Court.

Building Department Investigator Shaun Coss read the facts of the case.  He said there was another contractor hired to do the work but he failed to do so.  He hired another contractor and the permit has now been complied.

Mayra Garcia was sworn in as translator for Jose & Maria Garcia who were also sworn in.  He said he had a communication problem with the general contractor who he thought would pull the permit and complete the work in a timely manner.  When this wasn't done he hired Raymond Villanova to renew the permit and get the work done.  
 

The Special Magistrate, after reviewing the 3 criteria required by Rule 16 and after considering the facts, ordered the fines be reduced from $18,820.00 to $850.00 payable in 60 days. If not paid within this time period the fines would revert back to the original amount and a lien would be recorded at the St. Lucie County Clerk of Court’s Office.

Investigator Coss read the facts of the case.  He said the contractor needs more time so he can fulfill what needs to be done to get the permit completed.  There has been no revisions at this time.

Jesus Carranza was sworn in on behalf of his wife.  He said he would talk to contractor and tell him the permit needs to be completed or he will hire a new contractor.  He agreed to the 60 days.
 

The Respondent’s request for an extension of time within which to comply with the requirements of the Special Magistrate’s Order Determining Violation dated May 18, 2016 and the Order on Rule 16 dated November 15, 2016 which stopped the fines from accruing for 90 days be and the same is hereby granted to the extent specified in this Order.

In the event the violations specified in said Order Determining Violation dated May 18, 2016 and the Order on Rule 16 dated November 15, 2016 which stopped the fines from accruing for 90 days are not remedied within 60 days of April 19, 2017 a fine of $100.00 will be restarted and a lien will be recorded against the property.

Building Department Investigator Coss read the facts of the case.  He said there was 2 trailers on the property but no one living in them at this time; however, it has running water and electricity.  There was also a bathroom added that did not have permits.  He said Reverend Bernard had attempted to contact contractors but they did not show up.

Loretta Taylor, Reverend Bernard's nurse, was sworn in for testimony. She presented a letter giving her authorization to speak for Reverend Bernard. She said she tried to meet with contractors but when she showed up for the designated time they didn't.  She said Reverend Bernard does not have the money.

Special Magistrate asked Ms. Taylor if she had called Mr. Coss to let him know what was going on.  She said no.  Special Magistrate asked why Reverend Bernard didn't appear for himself? He's responsible for these violations because it's his property.  She said this really didn't concern Ms. Taylor.

Reverend Cornelius Bernard was sworn in.  He repeated what was presented by Ms. Taylor - that he would reach out to a contractor, make arrangements to meet, and then they didn't show up.  He said he didn't have the money to pay for their services.

Special Magistrate suggested he contact 211 for assistance and other sources around the neighborhood.  Also, he could go on line and search for local contractors who might be willing to help him out.  
 

The Respondent’s request for an extension of time within which to comply with the requirements of the Special Magistrate’s Order Determining Violation dated October 19, 2016 be and the same is hereby granted to the extent specified in this Order.

In the event the violations specified in said Order Determining Violation dated October 19, 2016 are not remedied within 60 days there shall be imposed a fine at a daily, cumulative rate of $100.00.
