MINUTES OF A REGULAR MEETING OF THE CITY COMMISSION OF THE CITY OF FORT PIERCE, FLORIDA, HELD IN THE CITY HALL COMMISSION CHAMBERS, 100 NORTH U.S. #1, FORT PIERCE, FLORIDA, AT 6:30 P.M. ON MONDAY, AUGUST 21, 2017.
 
1.
CALL TO ORDER - Mayor Hudson called the meeting to order at 6:30 p.m.
 
2.
OPENING PRAYER - Pastor Harry Shaw, Good News Missionary Baptist Church, gave the opening prayer.

APPROVAL OF MINUTES

Approval of minutes from the August 1, 2017 special meeting and the August 7, 2017 regular meeting.
 

Motion was made by Commissioner Thomas Perona, seconded by Commissioner Jeremiah Johnson to approve the minutes from the August 1, 2017 special meeting and the August 7, 2017 regular meeting.

CONSENT AGENDA
 
a.
Approval of Specific Authorization No. 4 in an amount not to exceed $135,875 ($50,000 reimbursement by FDOT, $85,875 City cost) for professional engineering services relating to the Ohio Avenue Realignment and Signalization project located between South 3rd Street and U.S. Highway One.
 
b.
Approval to enter into a 1-year contract with International Golf Maintenance, Inc. (IGM) consistent with the Indian River County Contract for Golf Course Maintenance, RFP Number 7054, in an amount not to exceed $567,476.00. 
 
c.
Approve proposal between the City of Fort Pierce and St. Lucie County UF/IFAS Extension Service FY 2017-2018 in the amount of $10,000 to provide Watershed and Lagoon Life education to the citizens of the City of Fort Pierce to meet the City's National Pollutant Discharge Elimination System (NPDES) educational requirements.
 
Commissioner Perona requested to pull item 10b.
 

Motion was made by Commissioner Jeremiah Johnson, seconded by Commissioner Rufus Alexander to approve items 10a and 10c.

As to item 10b, Commissioner Johnson asked Mr. Mimms to talk about the discussions with IGM. Mr. Mimms, City Manager, stated that our golf professionals will be included in contractual negotiations. Results from the public workshop proved that overall course maintenance was a top priority. The goal is to no longer transfer funds from general funds to Indian Hills Golf Course.

Commission discussion included staff opportunities during the transition, overall course conditions, and general fund transfers. This is a one year contract that allows the City to move forward and be mindful to how it develops.
 

Motion was made by Commissioner Jeremiah Johnson, seconded by Commissioner Thomas Perona to approve item 10b.

Legislative Hearing - Ordinance No. 17-024, Reducing the number of Planning Board Members.  SECOND READING

Linda Cox, City Clerk, read the Ordinance, by title only, into the record as follows.

AN ORDINANCE AMENDING THE PROVISIONS OF FORT PIERCE CODE OF ORDINANCES CHAPTER 2, ARTICLE XII, SECTIONS 2-221 AND 2-223, REDUCING THE NUMBER OF PLANNING BOARD MEMBERS AND ELIMINATING ITS POWER TO ADOPT RULES AND REGULATIONS; PROVIDING FOR A SEVERABILITY CLAUSE; REPEALING ALL ORDINANCES OR PARTS THEREOF IN CONFLICT; PROVIDING FOR AN EFFECTIVE DATE.

Mayor Hudson opened the public hearing.
Marcia Baker spoke about her concerns.
Seeing no one else, Mayor Hudson closed the public hearing.

James Messer, City Attorney, stated that once appointed, the board member is seated until they are removed or the Commissioner is no longer in office. He confirmed that members of any board are always exposed to removal without cause by the Commission. Mr. Messer believes that the concerns mentioned should resolve themselves.
 

Motion was made by Commissioner Reginald Sessions, seconded by Commissioner Jeremiah Johnson to approve item 11a.

Resolution 17-R26 approving technical revisions to State Housing Initiatives Partnership (SHIP) Local Housing Assistance Plan (LHAP) for 2015-2016, 2016-2017 and 2017-2018.

Linda Cox, City Clerk, read the Resolutino, by title only, into the record as follows.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF FORT PIERCE, FLORIDA, APPROVING TECHNICAL REVISIONS TO THE LOCAL HOUSING ASSISTANCE PLAN (LHAP) FOR FISCAL YEARS 2015- 2016, 2016-2017 AND 2017-2018, AUTHORIZING THE MAYOR AND CITY MANAGER TO EXECUTE ANY REQUIRED DOCUMENTS AND CERTIFICATIONS RELATED TO THE REVISED LHAP; AUTHORIZING THE CITY MANAGER TO APPROVE EXPENDITURES OF FUNDS IN ACCORDANCE WITH THE REVISED LHAP; AUTHORIZING THE SUBMISSION OF THE REVISED LHAP TO THE FLORIDA HOUSING FINANCE CORPORATION; AND PROVIDING AN EFFECTIVE DATE.

Libby Woodruff, Grants Manager, gave a brief presentation and was available for questions. Proposed revisions would allow for more work to be done in the community. Commission discussion included investing in our housing stock and the procurement of local contractors.

Commissioner Perona appointed Bob Burdge.
Commissioner Sessions appointed John George.
Mayor Hudson appointed Michael Broderick.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF FORT PIERCE, FLORIDA, REMOVING EXISTING BOARD MEMBERS AND CERTIFYING THE APPOINTMENT OF MEMBERS TO THE CITY PLANNING BOARD; PROVIDING FOR AN EFFECTIVE DATE.

The members being appointed are Caroline Sessions, Frank Creyaufmiller, Bob Burdge, John George, Michael Broderick, Marcia Baker, Tim O'Connell, and Brian Paul.

Resolution 17-R28 approving the adoption of the amended Solid Waste Administrative guidelines and the schedule of fees for collection and disposal of garbage and trash.

A RESOLUTION BY THE CITY COMMISSION OF THE CITY OF FORT PIERCE, FLORIDA; ADOPTING THE AMENDED SOLID WASTE ADMINISTRATIVE GUIDELINES AND APPROVING THE SCHEDULE OF FEES FOR COLLECTION AND DISPOSAL OF GARBAGE AND TRASH AS SET OUT IN THE SOLID WASTE ADMINISTRATIVE GUIDELINES BY THE CITY MANAGER IN ACCORDANCE WITH SECTION 16-31 OF THE CODE OF ORDINANCES OF THE CITY OF FORT PIERCE, FLORIDA; PROVIDING FOR AN EFFECTIVE DATE.

Mike Reals, Public Works Director, appeared and was available for questions.

Commission discussion included single days for picking up household garbage, availability of Solid Waste funds, increasing costs, efficiency savings, recycling education and participation rates. This increase will allow for an investment back into the Solid Waste department.

COMMENTS FROM THE CITY MANAGER

Nicholas Mimms, City Manager, highlighted Peacock Arts District (PAD) energy and the partnerships that will help to revitize the area. On Thursday, August 24 at 6 p.m. there will be a Medical Marijuana informational public workshop. There will be public comment and general discussion. The Budget Hearings are scheduled: Tuesday, Sept 5 at 5:30 p.m., Millage Rate & Budget Ordinance first reading will take place on Sept 11 at 5:05 pm , FPRA Budget Hearing at 5:45 p.m., Millage Rate & Budget Ordinance second reading will take place on Sept 18.

COMMENTS FROM THE COMMISSION

Commissioner Alexander was happy to see fellow Commissioner Johnson at the FLC Conference in Orlando. He brought back some ideas and materials will forward to Mr. Mimms.

Commissioner Perona congratulated Main Street Fort Pierce for a great Reverse Raffle event.

Commissioner Sessions stated that the Sandi Paws event will be on Saturday, September 9 at 3 p.m. at Marina Square.

Commissioner Johnson learned a lot of great things at the FLC Conference, August has been busy with events such as 1st Annual Minority Business Expo and Swordfish Shootout. The County has received a certificate of occupancy for customs building at the airport, the TCERDA building is moving forward at the Research Park. His son is going to college this week and he hopes to be here for the workshop on Thursday.

Mayor Hudson thanked Dr. Gina Dean and looks forward to the event. The TV channel is looking great and benefits many citizens that want to watch the meetings.
