FPPD Officer Patriani read the facts of the case.  He presented photos which were marked as Exhibit 1 showing the car parked on sidewalk at the Elks Club. Jonathan Osborn was sworn in.  He said his cousin had borrowed his car and he did not know nothing about the citation until he received a notice to appear.  Special Magistrate said she understood the parking issues and asked that the Police Department check into them; but in the meantime, it is his car and he is responsible for the citation.
 

The Special Magistrate found a violation does exist and the violators are ordered to pay the amount on the citation $30.00 as indicated on the citation plus the administrative charges of $10.00 and $18.00 late fees for a total amount due is $58.00 payable within 30 days of the hearing date June 21, 2017.

Code Officer Alesi read the facts of the case and presented photos which were marked exhibit 1.  
Ashley M. Somers was sworn.  She said this was in front of Hoskins Turco, not in front of 311 S 2nd Street and asked if this area was subject to the 2 hour regulation.  Photos showed the vehicle parked from 12:42 pm to 2:51 pm.

Asst. City Attorney Mosley recommended amending the citation to read across from 311 S 2nd Street. Officer Alesi confirmed that both sides of the street are 2 hour parking.
 

The Special Magistrate found a violation does exist and the violators are ordered to pay the amount on the citation $50.00 and the $10.00 administrative fees. She waived the $18.00 late fees. The total amount due is $60.00 payable within 30 days of the hearing date June 21, 2017.

Michelle Beringhaus said she did not see any loading zone sign and presented photos of the location. Code Compliance Manager Arraiz pointed out the loading zone sign in Ms. Berinhaus's photos.
 

The Special Magistrate found a violation does exist and the violators are ordered to pay the amount on the citation $50.00 as indicated on the citation plus the administrative charges of $10.00 and $18.00 late fees for a total amount due is $78.00 payable within 30 days of the hearing date June 21, 2017.

Code Officer Saucedo read the facts of the case and presented photos marked as Composite Exhibit 1.  He said they had applied for the permit and were working on cleaning up the property maintenance.
Gayle Raulerson was sworn in.  She said she was taking care of all of the violations but some of the outside storage was still there.  The refrigerator/ice box safety issue has been corrected.
 

Special Magistrate found that the violation(s) listed on the summary sheet do exist and that Gayle Raulerson has committed or is responsible for the violations. She ordered that the violator(s) have 30 days in which to comply with the city code of ordinances. In the event the violation(s) are not cured or complied within the time period given, a fine of $150.00 per day will be assessed for each day the violation(s) continue(s) past the date set for compliance. The violator has 30 days in which to appeal his/her decision in the Circuit Court of St. Lucie County.

For Section 11-30, the Special Magistrate found that violations listed on the summary sheet existed but has been cured as of the date of this hearing. The violators shall be warned that if these violations re-occur, pursuant to FL Statute 162.09, the Code Officer may notify the Special Magistrate and request that a fine be entered.

Building Department Investigator Coss read the facts of the case and presented photos marked as Composite Exhibit 1.

Ray Villanova was sworn in.  He is the contractor hired by Mr. Torkaman.  He said there was a previous contractor hired but he did not finish the permit; nor did he get a final inspection.  Mr. Torkaman's church called him asking if he had a place a senior lady could live for a while.  Acting as a humanitarian he allowed her to stay there and she brought in another person who had a dog.  They tore the place up.  He issued an eviction notice and 3 days later they called code enforcement on him.

Special Magistrate said no matter who did the damage he was responsible for the property and the violations.
 

The Special Magistrate found that a violation does exist and that Gholam R. Torkaman has committed or is responsible for the violations. She ordered that the violator has 60 days in which to apply for the permit and comply with the conditions of the permit. In the event the violations are not cured or complied within the time period given, a fine of $200.00 per day will be assessed for each day the violation continues past the date set for compliance. The violator has 30 days in which to appeal his/her decision in the Circuit Court of St. Lucie County.

Building Department Investigator Coss read the facts of the case and presented photos marked Composite Exhibit 1.  He said Mr. Jewdun has been working on curing the violations but there was much work to be done.  

Christopher Jewdun was sworn in.  He agreed to the violations and the time given to make corrections.  He said he had financial and health issues and was only able to get  a little done at a time.  When he purchased the property he knew there was extensive work but he had been in the hospital 3 times in the last year.
 

The Special Magistrate found that a violation does exist and that Christopher Jewdun has committed or is responsible for the violations. She ordered that the violator has 90 days in which to apply for the permit and comply with the conditions of the permit. In the event the violations are not cured or complied within the time period given, a fine of $100.00 per day will be assessed for each day the violation continues past the date set for compliance. The violator has 30 days in which to appeal his/her decision in the Circuit Court of St. Lucie County.

Building Department Investigator Coss read the facts of the case.  He said the hearing was originally heard by the Code Enforcement Board on March 14, 2016 against Doclus Lima; however the property had changed owners prior to the fines being started.  He asked for an order to set aside the old violations and issue them against the new owner.
 

The Special Magistrate ordered the previously entered Order Determining Violation dated March 9, 2016 be set aside as the property changed owners before the fines started. Property is still in violation and Karis H Lima is found to be responsible for these violations. The violator is to be given 30 days to renew the permit and comply with all permit conditions of a fine of $100.00 per day will be assessed.

Roshini Lakram was sworn in.  He said he would probably hire a contractor and revert the two units back into one.   He asked for more time and said 90 days should be good.
 

The Special Magistrate found that a violation does exist and that Roshini Lakram has committed or is responsible for the violations. She ordered that the violator has 90 days in which to apply for the permit and comply with the conditions of the permit. In the event the violations are not cured or complied within the time period given, a fine of $100.00 per day will be assessed for each day the violation continues past the date set for compliance. The violator has 30 days in which to appeal his/her decision in the Circuit Court of St. Lucie County.

Eddie C Hadley was sworn in.  He said the mail was going to his old address and he had not received any of them.  He said he was trying to sell the property and he had a contract. This is when he found out about the fines.  He agreed to the recommendation and asked if it could be paid at closing.
 

The Special Magistrate, after reviewing the 3 criteria required by Rule 16 and after considering the facts, ordered the fines be reduced from $14,230.00 to $2,000.00 to be paid at closing. If not paid , the fines would revert back to the original amount and a lien would be recorded at the St. Lucie County Clerk of Court’s Office.

Building Department Investigator Coss read the facts of the case.  He said Mr. Price was aware of the condition the property was in and he was working on making the corrections.  He recommended stopping the fines and allowing the property owner until the next scheduled meeting to comply. 
If not complied he will appear again before the Special Magistrate.

Justin Price was sworn in.  He said this should be enough time to complete the work.
 

The Special Magistrate, after reviewing the 3 criteria required by Rule 16 and after considering the facts, ordered the fines be stopped from accruing for 30 days to allow property owner time to correct the violations. If not corrected within this time period the fines will begin again and a lien will be filed with the St. Lucie County Clerk of Court.

Calandra Riggins was sworn in.  She said they had put up the wall after the hurricanes.  She said instead of hiring an engineer to assist in putting a new door in, she had the permit revised to remove the wall and put the old door back in.
 

The Special Magistrate, after reviewing the 3 criteria required by Rule 16 and after considering the facts, ordered the fines be reduced from $4,520.00 to $750.00 payable in 12 months. If not paid within this time period the fines would revert back to the original amount and a lien would be recorded at the St. Lucie County Clerk of Court’s Office.
