Alexis Bethel was sworn in.  She said she was not there that night.  She had loaned her car to friends and they are who parked illegally.

Officer Patriani read the facts of the case.  He said the citation was issued on Saturday around 12:30 am at the Elks Club.  He said all parking lots were full and they were parked on the sidewalk.

Rosalyn Thomas Carter was sworn in.  She said the car was not hers, but her daughters.  She said they were parked on the sidewalk but it did not obstruct the right of way.  She said they did not see any signs posting no parking.

Special Magistrate Ross asked the code department and the police department to get with the Elks Club management and discuss what can be done about the parking situation.  She then dismissed the case.

Animal Control Officer BJ Gasparre read the facts of the case.  She explained about the voucher program and the new tethering rule. She said the citation was for rabies and city tag.  She said there was no proof of rabies and or tags for the 4 dogs.  She did not cite her for running at large.

Anna Castillo Maria was sworn in as Spanish interpreter for Florinda Castillo.  She said they were working on getting the rabies shots for two of the dogs.  She was using the Oleander veterinary.  She said she did not have Susie anymore.

Officer Gasparre suggested continuing the case for 30 days.
 

Special Magistrate continued this case for 30 days to allow violators to complete the process.

Animal Control Officer BJ Gasparre read the facts of the case.  She said Susan Parry and Janice Douglas from United for Animals were complaining there was no shelter and the dogs were tied to a fence in the hot sun.  She said she found no proof of these complaints.

Sandra Wilson (the dog owner) and Kenethea Wilson (signed the paperwork) were sworn in.  They agreed to put an enclosure around the dog house.  
 

Special Magistrate dismissed this case.

Animal Control Officer BJ Gasparre read the facts of the case.  She said in November 2016 they were checking on a complaint from United for Animals that there was no water, food and the dogs were tethered.  Also the dogs had no rabies or tags.  Officers found the dog owners were preparing to give the dogs a bath and although they did have registrations for the dogs, they were expired.

Jack Cloe affirmed who he was and said he now had the rabies but not the registrations.  He agreed to get them within the next couple of days.
 

Special Magistrate continued this case for 15 days to allow violator to pay for tags.

Animal Control Officer BJ Gasparre read the facts of the case.  She said the department was called out by the task force during a raid on 1010 Avenue F.  They found the dogs and took them to the shelter.  The dogs were later released to Ellis Fletcher, the owner.  He was given instructions on what had to be done in order to keep the dogs.  She said corrective action 3 and 4 were now in compliance.

Ellis Fletcher was sworn in.  He said two of the dogs have now been sterilized.  Code Compliance Manager Arraiz asked if he wanted to get the other two dogs fixed?  He didn't respond at this time.
 

Special Magistrate found Ellis Fletcher responsible for the violations referenced. She ordered the rabies vaccination to be acquired within 30 days and 60 days to get a fencing unit up and the dogs off of chains.

Animal Control Officer Gasparre read the facts of the case She said they learned of a new puppy in January 2017.  She gave them the requirements for shots and tethering rules.  They were called out for a welfare check in April 2017.  They found the owners had not obtained the rabies or registrations.
 
Cheryl Edouard and Stephanie Tijfrino were sworn in.  Cheryl said the dog (Kilo) belonged to her son.  He was currently in jail but when he gets out they have told him he would have to move out.  They were afraid Kilo might harm or kill her cat.
 

After hearing the facts and testimony Special Magistrate dismissed the case.

Animal Control Officer Gasparre read the facts of the case.  She said she was responding to a neighbor's complaint that dogs were running at large and had no rabies or tags.  Officer Gasparre said when she approached the dog owner she explained about the voucher program but they did not want it.  Special Magistrate Ross disclosed that she knew Gabrielle Halloman personally.

Gabrielle Hallowman was sworn in.  She said she no longer had the dogs.  One died and the other one she re-homed.  She said the dogs were inside dogs and she only let them out to go to the bathroom and to go for walks.  However, they got loose that day.

Officer Gasparre said she couldn't verify the dogs were gone but she hasn't seen them in a while.

Code Manager Arraiz recommended waiving all charges but the administrative fee of $35.00.
 

After hearing the facts and testimony Special Magistrate waived all fines except the administration fees of $35.00.

Code Officer Avery read the facts of the case.  He said the case is continued as of the May 17 hearing date.  They need to obtain permits to demo the shed/pool house.  Their construction company needs to get with Kim in building and find out what's necessary.

There was no one present to testify for the property owner.

Ervin McMillian was sworn in.  He said Bobby McMillan was deceased.  He was in the process of finding a contractor.  It took him 6 months to get home owner's insurance.  He did not know he had to pull a permit.  Most of this was damage from Hurricane Matthew.
 

The Special Magistrate found that a violation does exist and that Kathy McMillon Thompson has committed or is responsible for the violations. She ordered that the violator has 60 days in which to apply for the permit and comply with the conditions of the permit. In the event the violations are not cured or complied within the time period given, a fine of $100.00 per day will be assessed for each day the violation continues past the date set for compliance. Building Department Investigator Coss read the facts of the case. He said several of the violations were in compliance but there were still several that had not been corrected.

William Hopkins was sworn in.  He said he inherited this property.  He was not working and had a disability.  He said he was not the person who did the violation and that he needed more time to get all of the violations corrected.
 

The Special Magistrate found that a violation does exist and that William Hopkins has committed or is responsible for the violations. She ordered that the violator has 90 days in which to apply for the permit and comply with the conditions of the permit. In the event the violations are not cured or complied within the time period given, a fine of $100.00 per day will be assessed for each day the violation continues past the date set for compliance. The violator has 30 days in which to appeal her decision in the Circuit Court of St. Lucie County.

Code Officer Avery read the facts of the case stating the case was continued from May 17 hearing.  The house numbers is now in compliance and everything else is in the works but not completed at this time.
 

The Special Magistrate found that a violation does exist and that JP Morgan Chase Bank N.A. has committed or is responsible for the violations. She ordered that the violator has 60 days in which to apply for the permit and comply with the conditions of the permit. Building Department Investigator Coss read the facts of the case.  He said the permit is closed out and the fines have stopped accumulating.  

Katrina and Justin Price were sworn in.  They said this was their primary residence and they bought it in bad shape.  They were working on a tight budget, had a couple of children and were trying to save up the money to make improvements and help to beautify the neighborhood.
 

The Special Magistrate, after reviewing the 3 criteria required by Rule 16 and after considering the facts, ordered the fines be reduced from $2820.00 to $650.00 payable in 6 months. If not paid within this time period the fines would revert back to the original amount and a lien would be recorded at the St. Lucie County Clerk of Court’s Office.

Patricia Shotto was sworn in.  Special Magistrate Ross stated she knew Ms. Shotto personally.  Ms. Shotto said she has put out over $647.00 to do the windows that were not hers in the first place.  She said she has a contract on the house.
 

The Special Magistrate, after reviewing the 3 criteria required by Rule 16 and after considering the facts, ordered the fines be reduced from $5,000.00 to $700.00 payable at close of sale. If not paid within this time period the fines would revert back to the original amount and a lien would be recorded at the St. Lucie County Clerk of Court’s Office.

Code Manager Arraiz read the facts of the case and said Mr. Gonzalez had asked for a re-hearing.

Code Officer Isaac Saucedo acted as translator for Andres F. Gonzalez who was sworn in for testimony.  Mr. Gonzales expressed his disappointment that he was not allowed to have more than one truck on his property for one hour during a 24 hour period.  He said he had more than one truck where drivers come in, clean up, eat and get back on the job.
 

Special Magistrate Ross repeated her orders from before. One truck allowed for 1 hour in a 24 hour period.
