Kimberly Hefty was sworn in.  She said there was no proper signage.  She presented photos which were marked as Exhibit 2 saying the signage was inadequate.  They are blue instead of green like the rest of the signs.  She also said there were no signs inside the parking lot showing where she could park unlimited and where there were two hour parking.

Officer Alesi said there were two entrance signs and they each state 2 hour parking.  
 

The Special Magistrate found a violation does exist and the violators are ordered to pay the amount on the citation $50.00 as indicated on the citation plus the $18.00 late fees. She waived the $10.00 administrative fees. Total amount due is $68.00 payable within 30 days of the hearing date August 2, 2017.

Code Enforcement Officer Isaac Saucedo read the facts of the case and presented photos marked as Exhibit 1.  He said since his last inspection Mrs. Scott has been working on the property and the cities recommendation has changed.  He is recommending extending the time to 60 days. 

Joy Scott was sworn in.  She asked the Special Magistrate for 90 days.  He said they have put the fence back up and have begun paining the fence and house.  She said  the paint was expensive and they were buying one gallon at a time.  She said because she has had problems getting productive help she is doing the work herself.
 

Special Magistrate found that the violation(s) listed on the summary sheet do exist and that Joy Ann Scott (TR) has committed or is responsible for the violations. She ordered that the violator(s) have 75 days in which to comply with the city code of ordinances. In the event the violation(s) are not cured or complied within the time period given, a fine of $150.00 per day will be assessed for each day the violation(s) continue(s) past the date set for compliance. The violator has 30 days in which to appeal her decision in the Circuit Court of St. Lucie County.

Code Enforcement Officer Janey Vanderhorst read the facts of the case and the corrective action necessary to bring the property into compliance. She said there has been no contact from anyone regarding the store.  Special Magistrate Ross asked if the notices had been sent certified and she said yes.  Oficer Vanderhorst said there was a property maintenance representative, Jessica Kent,  but she's never there.  She said she had emailed her about the landscape in February and we were told she would put the store on a maintenance plan but it hasn't been done. Staff has had no further contact with her.  Staff also learned of a district manager, Danielle Martoni, and sent her a letter; however, she never responded.

Brett Givens was sworn in.  He is the manager/owner of the LLC.  He has been unable to contact anyone from the Dollar Store.  He said nothing has ever been done right.  He said there is a 15 year lease and they are responsible for everything.  He submitted a copy of the lease which was marked as Exhibit 1.  
 

Special Magistrate found that the violation(s) listed on the summary sheet do exist and that Family Dollar Store has committed or is responsible for the violations. She ordered that the violator(s) have 5 days in which to comply with the city code of ordinances. In the event the violation(s) are not cured or complied within the time period given, a fine of $500 per day will be assessed for each day the violation(s) continue(s) past the date set for compliance. The violator has 30 days in which to appeal her decision in the Circuit Court of St. Lucie County.

Building Department Investigator Shaun Coss read the facts of the case and read each corrective action explaining in detail what department was involved and where the action stood to date.  

Alexander Gonada, Attorney for the property owner said the permit for the irrigation system was being applied for during the current week.  He responded to the corrective actions individually.  He said John Foster, architect, had the final inspection on the building done / the roof was looked at and they found no issues.  With regards to issue 4 an electrical permit was issued with the wrong address.  They were told they would have to revise the scope of work, a final inspection and it was late.  They were then told the permit would have to be revised    Mr. Gonada said the permit was issued February 2017 with the wrong address.  He said he felt this was no fault of theirs. He said he inspected the parking lot and did find some errors and they would need to put in a stop sign.  He feels the landscaping and trees are fine and doesn't see tearing up the asphalt to put in shrubbery.  When the work was done, they called for an inspection, but it was late.  He said they still had two weeks to revise the plans or roll them into Phase 2.  Phase 2 is in the works.  They are working with John Foster and Culpepper & Terpening.  He said the original letter was not as detailed as the issues being presented today and he requested an additional 90 days to attempt to address the issues as they were laid out today.

Investigator Coss said for the record Staff was not in agreement with the 90 day extension.  Kori Benton from Planning went out and did a thorough inspection on July 31.  He made a list of all the issues that were still not addressed or corrected.

John Andrews from Engineering said they would needed  an as built drawing and certifications to review to complete Phase 1.  This should take about a week. They had no plans for Phase 2 but they could proceed with Phase 1.  Mr. Gonado said they need an opportunity to address what the code and planning issues are before addressing the engineering issues; but he would need more time.  They don't want to have to pay the contractors and surveyors twice.

John Katsock, agent for Railside LLC, was sworn in.  He said this was the largest project going on in the City.  The plans were submitted or approval in October of 2015 and they have been held up by permits, inspections, etc.  Special Magistrate Ross asked what the project consisted of and Investigator Coss said there were plans for a restaurant, a diner, as well as changing some of the other building usage.  Phase 2 is a rather large project and he thinks Phase 1 should be completed before starting Phase 2.  He said they should be able to finish Phase 1 in 30 days.

Investigator Coss conferred with other staff.  Kori Benton said the conditional use for the property was reviewed and approved by the City Commission in October 15.  

Staff agreed to 30 days for additional time to complete the 1, 2 & 3 and 90 days to obtain a permit and apply to the conditions for 4 & 5.
 

Special Magistrate Ross found that a violation does exist and that Railside LLC has committed or is responsible for the violations. She ordered that the violator has 30 days in which to apply for the permit for violations 1, 2, and 3 and comply with the conditions of the permit. In the event the violations are not cured or complied within the time period given, a fine of $250.00 per day will be assessed for each day the violation continues past the date set for compliance.

She also found Railside LLC responsible for the violations 4 and 5 and ordered that the violator has 90 days in which to apply for the permit and comply with the conditions of the permit. In the event the violations are not cured or complied within the time period given, a fine of $250.00 per day will be assessed for each day the violation continues past the date set for compliance.

The violator has 30 days in which to appeal her decision in the Circuit Court of St. Lucie County.

Jim Crist the general contractor and a member of the Church was sworn in.  He said another member of the church had tried to help out by pouring the pad but he did not know a permit was needed.  That is why he decided to get involved and get the issue resolved.
 

The Special Magistrate, after reviewing the 3 criteria required by Rule 16 and after considering the facts, ordered the fines be stopped from accruing as of June 16 to allow property owner to correct the violations. If not corrected within this time period the fines will begin again and a lien will be filed with the St. Lucie County Clerk of Court.

The Respondent’s request for an extension of time within which to comply with the requirements of the Special Magistrate’s Order Determining Violation dated January 4, 2017 be and the same is hereby granted to the extent specified in this Order.

  1. In the event the violations specified in said Order Determining Violation dated January 4, 2017 are not remedied within 60 days there shall be imposed a fine at a daily, cumulative rate of $100.00.
  2. All other provisions of said Order Determining Violation dated January 4, 2017 shall remain in full force and effect.
