Code Enforcement Officer Debevec read the facts of the case.  She presented photos which were marked as composit Exhibit 1.

Joy Scott was sworn in.  She said she was cutting down the cabbage trees by hand and needed more time.  Both she and her husband are in poor health.  She said her fences have the slats in them but the gates don't.  They use the gates to drive to and from and the slats get in the way.  She said she would not put slats in the gates.  She said she was not going to move the bbq grills or her trailer because they are a part of her business.

Ms. Debevec said she was not asking her to move the grills but she did need to put away the buckets and items such as that.
 

Special Magistrate continued this case for 30 days. She needed to get with Ms. Debevec and Mrs. Arraiz to find out what needed to be done to get the violations taken care of.

Code Enforcement Officer Saucedo read the facts of the case and presented photos which were marked as Exhibit 1.  He said they had applied for the permit as of March 3 but the landscape and outside storage were not in compliance.  The maintenance helper said as of this date the outside storage has been taken care of.

Joy Scott was reminded she was under oath to testify for this case.  She also had her maintenance helper with her.  She said they were working on the violations but needed more time.

Building Department Investigator Coss read the facts of the case.  He said Atlas Fence Company is helping him to come into compliance.  They are going to remove the old fence and put up a new one.  

Jean Dantilus was sworn in.  He said he was able to finally talk to a fence company (Atlas) who agreed to help him out.  They would apply for the permit and take the old fence down.  They would then apply for another permit for a new fence.  They were in the process of discussing price but they said they needed to talk to Mr. Coss first.  
 

Special Magistrate found that a violation does exist and that Jean Dantilus has committed or is responsible for the violations. She ordered that the violator has 30 days in which to apply for the permit and comply with all conditions of the permit. In the event the violations are not cured or complied within the time period given, a fine of $50.00 per day will be assessed for each day the violation continues past the date set for compliance. The violator has 30 days in which to appeal his/her decision in the Circuit Court of St. Lucie County.

Building Department Investigator Coss read the facts of the case and presented photos marked as Exhibit 1.   He said the structure suffered from hurricane damage.  They hired a contractor, a roof permit was issued, but they are having a hard time finding an electrical contractor to obtain the permit for that.

Vasthie Dessources was sworn in.  She said the roof work has been stopped because she needs to hire an electricrical contractor to obrtain a permit and do the work. 

Mr. Coss recommended an extension of 60 days to pull permit and hire a contractor.  He said they had 180 days to comply the roof permit by obtaining an approved final inspection.  They had 180 days to obtain a permit for the electrical work, comply the permit, and obtain a final inspection.
 

Special Magistrate Ross said she understood due to all of the damage the coast received from Hurricanes Matthew and Irma that there was problems obtaining reputable contractors so she extended this case for 60 days.

Code Enforcement Officer Debevec read the facts of the case.  She said this was the Grandview Motel.  They have tried to pressure wash the building but there are roof issues and a problem with the insurance company.  

Grant Knighton, the maintenance manager, was sworn in.  He said their insurance was with Lloyds of London.  They have taken care of most of the violations but still need to do the painting.  After Hurricane Irma did the damage to motel and the insurance company keeps putting them off they are now in litigation. Because the paint is $150.00 per gallon they want to wait until the lawsuit is settled.  Because they may have to redo what has been done, they are reluctant to start work.  He said if the lawsuit hasn't been settled within 60 to 90 days, he would paint the entire motel with an inexpensive paint and absorb the costs until they can paint with the better product.
 

Special Magistrate found that a violation does exist and that Karuna-Orlando LLC has committed or is responsible for the violations. She ordered that the violator has 90 days in which to apply for the permit and comply with all conditions of the permit. In the event the violations are not cured or complied within the time period given, a fine of $50.00 per day will be assessed for each day the violation continues past the date set for compliance. The violator has 30 days in which to appeal his/her decision in the Circuit Court of St. Lucie County.

Building Department Investigator Coss read the facts of the case.  He said this consisted of 2 separate violations.  The air-conditioning unit was installed without a permit and the tenant did the other violations.  He has shifted all responsibility of those violations to the tenant.  The tenant has obtained permits and done the work.

Matthew Johns was sworn in.  He shifted all responsibility to the tenant and the tenant has paid for all permits.  He agreed to the reduction.
 

The Special Magistrate, after reviewing the 3 criteria required by Rule 16 and after considering the facts, ordered the fines be reduced from $3,130.00 (includes $30.00 recording fees) to $350.00 payable in 5 days. If not paid within this time period the fines would revert back to the original amount and a lien would be recorded at the St. Lucie County Clerk of Court’s Office.

Building Department Investigator Coss read the facts of the case.  He said Ms. Delva did obtain the permit but the work did not get done. She didn't call for the final inspection so the permit expired.  She has applied for SHIP funds and as of this date it has been granted. He recommended stopping the fines to give her time to complete the grant from the SHIP program.

Marking Delva was sworn in.  She said she has been trying.  She is just waiting for the SHIP funds in order to obtain the permit(s) and do the work.
 

The Special Magistrate, after reviewing the 3 criteria required by Rule 16 and after considering the facts, ordered the fines be stopped from accruing for 6 months to allow property owner to obtain funds from the SHIP program and correct the violations. If not corrected within this time period the fines will begin again and a lien will be filed with the St. Lucie County Clerk of Court.

Building Department Investigator Coss read the facts of the case.  He said the case is in compliance and the fines have stopped accruing.

Queen Gibbs was sworn in.  She said it was the tenant who caused the violations.  When she learned about them she made the repairs but forgot to contact Mr. Coss.  She works for the Long Shoremen out of Cocoa.  She supports her grandchildren and her father who is in a nursing home.  She did not receive any of the notices.  They were being mailed to the tenant and he did not forward them to her.

Mr. Coss said the City would settle for the administrative costs of $854.04.  Ms. Gibbs asked if the Special Magistrate could lower it any more.
 

The Special Magistrate, after reviewing the 3 criteria required by Rule 16 and after considering the facts, ordered the fines be reduced from $22,530.00 (includes $30.00 recording fees) to $550.04 payable in 4 months. If not paid within this time period the fines would revert back to the original amount and a lien would be recorded at the St. Lucie County Clerk of Court’s Office.

Lucas Rossknecht, legal representative for the current owner, Florida Land and Farm Holdings Inc., said they had filed with the Clerk of Court an interpleader for tax deed proceeds and motion to disperse.
 

The Special Magistrate continued this case for 60 days.

Building Department Investigator Coss read the facts of the case.  He said Mr. Lewis purchased the property and was aware of the violations.  He hired a contractor to do the work but there were issues and he was unable to obtain the permit and fulfill the work.  He is working with PACE & SELF and Staff recommends giving him a 90 day extension.

Special Magistrate Ross said she sits on the Board of Directors of SELF and didn't want there to be any conflict of interest.  

Lucien Lewis III was sworn in.  He said he was in agreement with the terms but wanted to thank Shaun and his team for helping him to understand the importance of hiring the right people and the information they gave to help him get the violations in compliance.  
 

Special Magistrate Ross recused herself as knowing Mr. Lewis as they were on the Board of Directors together. After hearing the case she ordered:

The Respondent’s request for an extension of time within which to comply with the requirements of the Special Magistrate’s Order Determining Violation dated September 6, 2017 be and the same is hereby granted to the extent specified in this Order.

  1. In the event the violations specified in said Order Determining Violation dated September 6, 2017 are not remedied within 90 days of March 7, 2018 there shall be imposed a fine at a daily, cumulative rate of $100.00.
  2. All other provisions of said Order Determining Violation dated September 6, 2017 shall remain in full force and effect.
