Fort Pierce Police Officer #8524 Gibson read the facts of the case.  She said the vehicle was taking up four (4) parking spaces and provided photos which were marked as Exhibit 1.
 
Kip Rigel was sworn in.  He said the only thing that is attractive about Fort Pierce is the water.  He said there are no other boat ramps but Jaycee Park where he can put his boat in.  He parked in the overflow parking area and saw no signs saying he couldn't park there.  He took up four (4) spaces because that is what his truck and trailer required.
 

The Special Magistrate found a violation does exist and the violators are ordered to pay the amount on the citation $50.00 as indicated. She waived the administrative charges of $10.00 and the $18.00 late fee for a total amount due of $50.00 due and payable within 30 days of the hearing date. Failure to pay the total amount within 30 days will result in the case being turned over to the St. Lucie County Court and an additional fee may be charged.

Fort Pierce Police Officer Gibson read the facts of the case and presented photos marked as Exhibit 1.  She said this vehicle was taking up five (5) spaces.

John Mead was sworn in.  He said this was the second ticket he received and when he questioned it he was told to go to the City.  He spoke to Deputy Chief Amandro, Public Works, and Code Enforcement.  He was told they were working on the problem.  He said he parked in the boat and trailer parking spots and yes, he took up 5 spaces, because there was no where else to park.  

Code Compliance Manager Arraiz said the converting is in the process. They are removing the "no parking on grass" and "no boat trailers" signs  and replacing them with "overflow parking signs".  This will then allow the boat trailers to have an additional designated parking area.
 

The Special Magistrate found a violation does exist and the violators are responsible for the fine. She reduced the fine to $25.00 and waived the administrative charges of $10.00 and the $18.00 late fee for a total amount due of $25.00 payable within 30 days of the hearing date. Failure to pay the total amount within 30 days will result in the case being turned over to the St. Lucie County Court and an additional fee may be charged.

Code Compliance Manager Arraiz read the facts of the case.  She said this is for sign violations.   She spoke to the attorney, Cary Sabol, prior to the start of meeting and they stipulated to a reduction of $2,500.00 payable in 30 days.  

Attorney Cary Sabol confirmed this agreement.
 

The Special Magistrate found Back Country Properties LLC responsible for the violations. Per stipulation between the two partys she reduced the fines to $2,500.00 payable in 30 days. She further ordered if there were any future violations; there would be no consideration for reduction. Failure to pay the reduced fines within the time period given will result in the fines reverting to the original amount. This order shall be forwarded to Cry Wolf for processing.

Building Department Investigator Coss read the facts of the case.  He said Ms. Lazare is a repeat violator and recommended giving her 60 days to obtain a permit and comply.  If not fines would be assessed at $250.00 per day.  He asked that the department be allowed to make an inspection every 100 days.

Ermith Lazare was sworn in.  She said she has hired a contractor and he has applied for the permit.
 

Special Magistrate found that a violation does exist and that Ermith Lazare has committed or is responsible for the violations. She ordered that the violator has 60 days in which to obtain permits pursuant to the Florida Building Code and/or the Code of Ordinances; obtain approval for all required inspections at least every 100 days until the permit has been closed; and comply with all other permit conditions or a fine of $250.00 per day be assessed for each day the violation continues past the date set for compliance. The violator has 30 days in which to appeal the decision in the Circuit Court of St. Lucie County.

The Special Magistrate finds that a violation does exist and that the Violator(s) having been provided notice and failing to appear is responsible for the violation(s). Further, this Court enters a Default Summary Judgement based on the unrefuted facts as presented in the City’s Affidavit.
It is hereby ordered that the Violator pay a fine of $500.00 as recommended by the Code Enforcement Officer on the case summary sheet. Failure to do so will result in a lien being recorded with the Clerk of Court, St. Lucie County. The Violator shall have 30 days within which to appeal this decision to the Circuit Court.

Code Compliance Manager Arraiz read the facts of the case.  She said the property owner is in agreement to paying the "fast forward" amount $3,000.00.  This reduction would only need the approval of the Special Magistrate.

Christopher Howson was sworn in via telephone conference.  He said he had hired Scott Markowitz, who was supposed to be a qualified contractor, to do the work in 2015. He did the work, but failed to get permits.  In speaking to him, he assured me he would get the permits.  He failed to do so and I continued to get notices from the City.  I approached Scott several times with no success and soon after he disappeared. 

 After this we worked with the City and hired a different contractor, TLC Experts.  It was determined the best thing to do was demolish the home which they did.  
 
 

The Special Magistrate, after reviewing the 7criteria required by Rule 17 of the Rules of Procedure, approved a lien for $67,840.00 reduced to $3,000.00 payable within 30 days. Failure to pay the reduced amount within the time ordered, results in the lien reverting to its original amount.
