Fort Pierce Police Officer Gibson presented the case and photos marked as Exhibit 1.  He said the boat trailer was taking up 5 parking spaces.  He said there were other vehicles that received citations on that day.

Judy Novotni and Tim Wile were sworn in.  He said after putting his boat in the water, he went to park the truck.  There were no spaces in the designated area so he parked in the overflow area.  He said there were no signs saying he couldn't park there.  He had to park sideways because he would be sticking out into the drive area and block other vehicles.  He showed photos of city vehicles being parked the same way.

Code Compliance Manager Arraiz said they have received numerous complaints about there being no signs and the City is working on it.  The City's position is; if there is no parking available, go to another park.  There is a parking meeting going on at this time.  She recommended continuing the case and see what the results of the meeting was.
 
Later during the meeting, Deputy Chief Amandro came into the room and said the overflow parking at Jaycee Park is being taken care of.  He recommended dismissing the cases until the lines are restriped and signs put up.   
 

After hearing testimony from Tim Wile, Police Department Officer Gibson, and Deputy Chief Amandro the Special Magistrate dismissed the case.

Animal Control Officer Kenny Nelson read the facts of the case.  The complaint came in through 911.  He said the vehicle was parked at Moonswiners.  The temperature outside was 92 degree and inside the vehicle it was 103 degree.  

James Herndon was sworn in.  He presented a photo showing the vehicle was in partial shade, the windows were down about 4 inches and they were tinted.  He said there was water behind the seat.  His dog is a service dog trained to handle heat and the outside.
 

The Special Magistrate found James Herndon III responsible for the violations; however, after hearing testimony, she downgraded the charges to 4-22 (B), She ordered $100.00 paid within 30 days. She waived the $5.00 administrative fee. Failure to pay the total amount prior to the expiration date will result in the case being turned over to the St. Lucie County Court and an additional fee may be imposed.

Senior Code Enforcement Officer Janey Vanderhorst read the facts of the case.  She said there was a serious storage problem with this Family Dollar. She presented photos that were marked as Exhibit 1.  She recommended Citation Nos. 313, 314, 315, 316, 317, 318, and 320 be paid within 5 days.
The rest of the unpaid citations to be waived. 

Attorney Allison Heim was representing Family Dollar.  She said the corporate office was taking these matters seriously and taking all necessary steps to fix the violations.  She said the inside of the building does not have enough storage room so they put stuff outside.  She told them they would have to organize the outside storage and keep it out of the public's view.   She agreed to the recommendation but asked for 15 days to pay the fines.
 

The Special Magistrate having heard testimony and having considered any exhibits while being otherwise advised in the premises found Family Dollar Stores of FL is in violation of the Code of Ordinances as specified summary sheet. In the event the fine of $840.00 is not paid within 15 days after the date of this Order, the citation(s) will be forwarded to the St. Lucie County Clerk of Court for processing. The violator will be called to answer the charges before a St. Lucie County Judge and additional fees and court costs may be imposed.

Code Enforcment Officer Heather Debevec read the facts of the case.  She said Ms. Burgess, the tenant,  was in the process of purchasing the property.

Willie Stokes was sworn in and he confirmed the property was in the process of being transferred to Ms. Burgess.  He said he would work with her to get the violations corrected.  He asked for additional time.
 

The Special Magistrate continued this case for 30 days.

Further, this Court enters a Default Summary Judgement based on the unrefuted facts as presented in the City’s Affidavit. Code Enforcement Officer Heather Debevec read the facts of the case.  She said she had spoke to Mr. Dixon and he has been trying to work with the tenant to get them to move things so he could get it painted.

Vernon Dixon was sworn in.  He said he would get the violations corrected or evict the tenant.

Code Compliance Manager Arraiz said we could issue a citation to Mr. Sylvester, the tenant, for the outside storage.  This might help Mr. Dixon to correct the problems. Recommended continuing the case another 30 days.
 

The Special Magistrate continued the case for 30 days.

Building Department Investigator Shaun Coss read the facts of the case.  He said the contractor did not call in for a final inspection.  He recommended stopping the fines for 60 days.

Daniel Carranza was sworn in as translator.  Lucia Carranza was sworn in.  She said everything was done but the shutters.  Agreed 60 days should be enough time.
 

The Special Magistrate, after reviewing the 3 criteria required by Rule 16 and after considering the facts, ordered the fines be stopped from accruing for 60 days to allow property owner to correct the violations. If not corrected within this time the fines will begin again and a lien filed with the St. Lucie County Clerk of Court.

Building Department Investigator Coss read the facts of the case.  He said the violations were results of the hurricane and recommended extending the case for 90 days to allow the violator to renew the fence permit.

Nathan Albers was sworn in.  He said he had been out of the country contributing to hurricane relief when this was going on.  He agreed the 90 days should be enough time to complete the fence permit.
 

The Special Magistrate, after reviewing the 3 criteria required by Rule 16 and after considering the facts, ordered the fines be stopped from accruing for 90 days to allow property owner to correct the violations. If not corrected within this time the fines will begin again and a lien filed with the St. Lucie County Clerk of Court.

Building Department Investigator Coss read the facts of the case.  He said the plumbing contractor he had hired was deceased and Mr. Torkaman wasn't aware of that.  

Raymond Villanova was sworn in as Mr. Torkaman's representative.  He agreed to the reduced fines and the 30 days.
 

The Special Magistrate, after reviewing the 3 criteria required by Rule 16 and after considering the facts, ordered the fines be reduced from $12,240.00 to $700.00 payable in 30 days. If not paid within this time the fines would revert to the original amount and a lien would be recorded at the St. Lucie County Clerk of Court’s Office.

Code Compliance Manager Arraiz read the facts of the case.  She said the lights in the parking lot were not lit. Staff does not work at night.  However, Mr. Stiberman did provide proof the lights were working; therefore, Staff recommends waiving the fines.

Sergio Stiberman was sworn in via telephone conference.  He thanked everyone.
 

The Special Magistrate, after reviewing the 3 criteria required by Rule 16 and after considering the facts, ordered the fines be waived.

Code Enforcement Officer Heather Debevec read the facts of the case.  She said the fence was still not down.  She presented photos marked as Exhibit 1.

James Greenfield was sworn in via telephone conference.  He said he was still trying to find someone to take the fence down.  He didn't want the City to do it because it would cost him more.  He said he has someone now taking care of the yard work.  
 

Special Magistrate continued this case for another 30 days. She did advise him that if the property was not in compliance by the next date, the City will go forward with recording the lien.
