Building Department Investigator Coss read the facts of the case.  He said this is damage from Hurricane Irma.  She was approved at one time for some SHIP funds, but later told there was no funds available.  Staff is agreeable to allowing her more time.

Virgilene Davis was sworn in.  She said she was applying to other agencies to get funds, possibly Catholic Charities.  She was told to have the City write a letter saying the Red Cross would donate $2000 to help.  SHIP ran out of money and she has no insurance

Investigator Coss read the facts of the case.  He said this was a tenant complaint.  An inspection was made and inspector found a drain line was clogged.  A second bath was started by the prior owner and they  had no permits.  It does not meet code. 

Earl Gardner was sworn in.  He gave the tenant an eviction notice and this is when he filed a complaint.  He said this was damage from the hurricane.  He inherited the property from his sister.
 

The Special Magistrate found that the violation(s) listed on the summary sheet do exist and that Earl Gardner has committed or is responsible for the violations. She ordered that the violator has 90 days in which to apply for the permit and comply with all conditions of the permit. In the event the violations are not cured or complied within the time given, a fine of $100.00 per day would be assessed for each day the violation(s) continue past the date set for compliance. The violator has 30 days in which to appeal the decision in the Circuit Court of St. Lucie County.

Investigator Coss read the facts of the case.  This damage was caused by a vehicle accident.  He has applied for a permit but it was rejected.  He has to reapply for the permit.  Mr. Coss said he would check with the building department and contractor to see why it was rejected.

Olin Carrelus was sworn in as Creole interpreter.  Jen Simon was sworn in.  He said he has no money. He gets $700.00 a month. There are 3 adult children and 1 baby living in this home. The family just got here and are looking for jobs and going to school.

Rolin Dothenhill, contractor, was sworn in. He said Mr. Simon had hired a contractor who was unlicensed and Mr. Simon got fined by the city. Mr. Dothenhill is doing the job for free.  He has spent his own money to fix the roof. 
 

Special Magistrate Ross, after reviewing the 3 criteria required by Rule 16 and after considering the facts, ordered the fines be reduced from $2,330.00.00 to $100.00 payable within 30 days. If not paid within this time period, the fines wuld revert back to the original amount and a lien would be recorded at the St. Lucie County Clerk of Court's Office.

Building Investigator Coss said they would take all cases and discuss as one.  He explained that this property was in deplorable condition and the new owners came in and did all of the improvements to make the structure livable.  Staff recommends reducing each case to $3,000.

Elan Bally was sworn in.  He said when he purchased the property he did not know about the condition, the fines, and the liens.  He tried to cancel the purchase but was advised to continue with the project.  It took a long time to do the job, they had to contend with squatters, muggings, and threats but he continued the project.  They have more than a million dollars into it already. 

Special Magistrate Ross said she has seen the improvements and appreciates everything that has been done.  She read the criteria for the reduction of liens and explained if she accepted the $3,000 it would have to go thru the City Commission for approval.  Mr. Bally said he needed to get this done soon so he can get a mortgage.  She said an order will be prepared that he can present to the lenders. 
 

Special Magistrate Ross, after reviewing the 7 criteria required by Rule 17 and hearing the recommendations from Staff said she would recommend the City Commission reduce each lien to $3,000.00 payable in 6 months or less. Failure to pay the reduced amount within the time ordered, results in the lien reverting to its original amount.

Investigator Coss read the facts of the case and said the fines had not started yet.  He had already extended the time for 90 days and had advised Ms. Hicks that if she needed more time she would have to go before the Special Magistrate.  Staff was recommending extending her 90 days to bring the property into compliance.

Ms. Hicks, who was already sworn in, said this should be enough time.
