Building Department Investigator Coss read the facts of the case and submitted photos marked as Exhibit 1.  Although the owner was not present, he had spoke to Donna Becker who said because the house was vacant she didn't think they had to do anything to make corrections  She said she would do it right away but as of this date there has been no visible action.
 

The Special Magistrate finds that a violation does exist and that the Violator(s) having been provided notice and failing to appear is responsible for the violation(s). Further, this Court enters a Default Summary Judgement based on the unrefuted facts as presented in the City’s Affidavit. It is hereby ordered that the Violator be given the number of days recommended by the Code Enforcement Officer on the case summary sheet to come into compliance or they would be fined the amount also shown on the summary sheet. The Violator shall have 30 days within which to appeal this decision to the Circuit Court.

Attorney Curtis Randolph said they would make every effort to get the permit and comply.
 

Special Magistrate found that the violation(s) listed on the summary sheet do exist and that Julia Randolph has committed or is responsible for the violations. She ordered that the violator has 60 days in which to apply for the permit and comply with all conditions of the permit. Building Department Investigator Coss read the facts of the case.  He said this was damage done by the hurricane and they did the roof work without a permit.  Mr. Flores was supposed to come before the Special Magistrate in January but being a truck driver he couldn't make it.  He recommended issuing an order giving him 60 days to bring the property into compliance. 
 

After considering the facts presented, the Special Magistrate continued this case until December 18 hearing date.

Code Enforcement Officer Debevec read the facts of the case.  She said Ms. Newsome was a repeat violator.  She had previously spoke to Ms. Newsome who said there were no more ads posted; however, there are two reservations for the rooms.
 

Special Magistrate found the violators who are not present and that the Violator(s) having been provided notice and failing to appear is responsible for the violation(s). Further, this Court enters a Default Summary Judgement based on the unrefuted facts as presented in the City’s Affidavit are deemed to have admitted guilt and that Lauren Newsome has conducted short- term rentals. The rentals that have already commenced are considered irreversible and irrevocable in nature, and a fine equal to one month’s rental ($1,950.00 x 2 rooms ) for a total of $3,900.00 is to be assessed payable within 30 days. She also ordered the immediate cease and desist order from the City be imposed and all future rentals be terminated. She ordered that after the 30- day period, if not complied, all utilities to the premises were to be suspended while the violation continues. The violator has 30 days in which to appeal the decision in the Circuit Court of St. Lucie.

The rentals that have already commenced are considered irreversible and irrevocable in nature. The Special Magistrate ordered a fine equal to one month’s rental, $3,500 be assessed. The Special Magistrate also ordered an immediate cease and desist be imposed and future rentals be terminated immediately. All advertisements for short- term rentals are to be removed. Advertisements on websites dedicated to vacation and short term rentals are assumed to be for vacation or short- term rentals regardless of the length of stay listed in the advertisement. If rentals continue without a business tax receipt, all utilities to the property are to be suspended. The violator has 30 days in which to appeal the decision in the Circuit Court of St. Lucie.

Code Enforcement Officer Saucedo read the facts of the case  He said Mr. Florio was a repeat violator.  November 1, 2017 was the first case.

David De Florio was sworn in.  He presented his phone with photos showing the tenant is a scrapper.  He is constantly coming and going with scrap material.  He has given the tenant a final notice to stop the scrapping or he will be evicted.  

Officer Saucedo testified there was only one solution the tenant could make and that is to put up a privacy fence and keep the junk out of sight of public.
 

Special Magistrate found that the violation(s) listed on the summary sheet do exist and that David De Florio has committed or is responsible for the violation(s). She ordered that the violator has 24 hours in which to comply with the city code of ordinances. In the event the violation(s) are not cured or complied within the time given, a fine of $250.00 per day will be assessed for each day the violation(s) continue(s) past the date set for compliance. The violator has 30 days in which to appeal the decision in the Circuit Court of St. Lucie County.

Building Department Investigator Coss read the facts of the case.  He said he spoke to a contractor on Marking's behalf a couple of weeks ago but he hasn't heard anything further from him. A SHIP application was put in; but the grant was not issued due to structural issues. There were permits but they expired. 

Marking Delva was sworn in for testimony.  She said some of the violations are not approved by SHIP.  They have to get things fixed on the inside before they can do anything on the outside.  She was told to hire a contractor to get the permit and do a floor plan.  She is a single parent with no government help.  She's been trying to get the SHIP help since 2008.
 

The Special Magistrate, after reviewing the 3 criteria required by Rule 16 and after considering the facts, ordered the fines be stopped from accruing for 60 days to allow property owner to correct the violations. If not corrected within this time the fines will begin again and a lien filed with the St. Lucie County Clerk of Court.

Gary Richardson, Real Estate Agent for Mr. Saghir, was sworn in.  He agreed to the $500.00.  The date for City Commission was set for December 3.
 

Special Magistrate reviewed the 7 criteria required by Rule 17 and will recommend the City Commission reduce the lien from $1,600.00 to $500.00. That would include the City Commission's administrative fee of $250.00 and will be payable in 60 days. If not paid within that time the lien would revert to its original amount.

Building Department Investigator Coss read the facts of the case and went over the 7cristeria.  Also, he read the administrative fees saying they could waive $1,200.00 and recommended reducing the lien to $1,000.00.    

Jerome Rhyant was sworn in.  He said they had first received the notice in January 2017.  They hired an electrician, plumber, etc. and pulled a permit in April 2017.  The work was done.  The plumbing was approved but mechanical and electric failed the inspection.  He had the contractors go back and do the repair work; but they failed to call for an inspection. The permit expired.  A week or so later his mother was diagnosed with cancer and he was primary caretaker for her and his father.  Next, they were hit with the storms that did even more damage.  His mother died in December.  He came into the building department a few months later to start the process all over.  He was able to raise enough money to put a new roof on.  The roof was approved.   He said he couldn't do anything with the inside of building until the roof was done.  Now, with everything that has happened, he's asking the Special Magistrate to waive the fines.  He said the violations only affected 911 N 13th Street; 907 is the office. 
 

Special Magistrate reviewed the 7 criteria required by Rule 17 and will recommend the City Commission reduce the lien from $25,140.00 to $1,000.00 that would include the City Commission's administrative fee/or plus the City Commission’s administrative fee of $250.00 and payable in 6 months. If not paid within that time the lien would revert to its original amount.

Evone McArthur was sworn in.  She said she was in a financial bind and only received Social Security of $769.00 a month.  She had one person living with her but he's always in the hospital and doesn't contribute financially.  She said her son was in prison and couldn't help out.  Her sister is the original owner and she is unable to take care of the property; so she has been doing the best she can.  She keeps the property maintained and up to code.  She asked that the Special Magistrate waive the fines.
