Side Letter of Agreement between the City of Hawthorne and Hawthorne Police Management Supervisory Group (HPMSG) – Retention Pay Amendment
RECOMMENDED MOTION:
That the City Council approve the Side Letter of Agreement between the City of Hawthorne and the Hawthorne Police Management Supervisory Group (HPMSG) amending Section 9.11 of the Memorandum of Understanding (MOU) regarding retention pay to include reserve time in the calculation of eligibility, effective March 27, 2025 and authorize the City Manager to execute the side letter agreement.
DISCUSSION:
The City of Hawthorne and HPMSG are parties to a current Memorandum of Understanding (MOU) effective July 27, 2024, through June 30, 2027. This agreement outlines wages, hours, and other terms and conditions of employment for classifications represented by HPMSG.
To ensure parity between employees represented by the Hawthorne Police Officers’ Association (HPOA) and HPMSG, and to provide a fair transition for employees promoted from HPOA into HPMSG-represented classifications, the City and HPMSG have agreed to amend Section 9.11 of the MOU via Side Letter.
This Side Letter of Agreement temporarily amends Article 9, Section 9.11 of the HPMSG MOU to mirror the provisions in Article 9, Section 9.9 of the HPOA MOU. The amendment includes the following changes:
Approval of this Side Letter will promote internal equity among sworn personnel and facilitate a consistent approach to recognizing long-term service.

This Side Letter of Agreement temporarily amends Article 9, Section 9.11 of the HPMSG MOU to mirror the provisions in Article 9, Section 9.9 of the HPOA MOU. The amendment includes the following changes:
- Inclusion of reserve time in the calculation of eligibility for the 25-year retention pay benefit.
- Clarification of “lateral entry Police Officer” and the consideration of prior service for retention pay eligibility.
- Retention pay will be reported as special compensation to the extent permitted by CalPERS regulations.
Approval of this Side Letter will promote internal equity among sworn personnel and facilitate a consistent approach to recognizing long-term service.

FISCAL IMPACT:
The fiscal impact of this amendment is limited to affected HPMSG employees who meet the new criteria. Funding is available in the approved FY 2024-25 and FY 2025-26 budgets.
