A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HAWTHORNE, CALIFORNIA, UPHOLDING THE PLANNING COMMISSION APPROVAL OF A CONDITIONAL USE PERMIT TO OPERATE A DRIVE-THRU AT 13324 S. INGLEWOOD AVENUE, SUBJECT TO CONDITIONS AND MAKING FINDINGS IN SUPPORT THEREOF
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HAWTHORNE, CALIFORNIA, UPHOLDING THE PLANNING COMMISSION APPROVAL OF A CONDITIONAL USE PERMIT TO OPERATE A DRIVE-THRU AT 13324 S. INGLEWOOD AVENUE, SUBJECT TO CONDITIONS AND MAKING FINDINGS IN SUPPORT THEREOF
RECOMMENDED MOTION:
Staff recommends that the City Council approve Resolution No. 8507.
DISCUSSION:
The Planning Commission approved Resolution No. PC 2024-19 for a drive-thru at 13324 S. Inglewood Avenue on November 20, 2024. The approval was called for review by Council Member Reyes English and a duly noticed public hearing on the call for review was held on December 10, 2024. After testimony of all interested parties was given, the City Council voted to uphold the Planning Commission decision with modifications to the conditions of approval and directed staff to prepare this resolution.
Several modified conditions relate to improvements in the public right-of-way (signal lights at the proposed crosswalk on Inglewood Avenue, left turn lane for southbound Inglewood Avenue, and one-way streets north and south of the project site; and reduced hours of operation for the drive-thru.
The Public Works Department received a grant to redesign and rebuild Inglewood Avenue in the near future, and without knowing the specifics of the redesigned street, staff recommends the applicant provide a bond to cover the costs associated with right-of-improvements immediately adjacent to the subject property rather than pay for improvements that may not be included in the final redesign. The Police Department requested that the drive-thru be allowed to operate 24 hours per day as a nuisance deterrent. However, if within the first six months of operations, the Chief of Police determines that the drive-thru being open 24 hours is actually causing a public nuisance, the drive-thru must remain closed from 12:00 am until 5:00 am daily.
