1.  Urban County Program on behalf of the City of Progreso is requesting waiver of technicality on non-acknowledgement of receipt of Addendum #1 by apparent low bidder in-as-such as it is in the best interest of the City of Progreso and the Urban County Program to do so.

2.  Consideration and action to award and enter into a Construction Contract with O.G. Construction Company, LLC (lowest bidder meeting all specifications and/or requirements) for the Street Improvements project  located in the City of Progreso, Texas in the amount of $118,049.75 utilizing Year 23 (2010) Street Improvement funds.

BACKGROUND

The City of Progreso has requested and received bids for the Street Improvements project. R. Gutierrez Engineering Corporation prepared specification packages and bids were received and opened at the Hidalgo County – Purchasing Department on March 23, 2011.  After review the project engineer noted that Addendum #1 was not initially included in the Bid Package submitted to the Purchasing Dept.  R. Gutierrez Engineering Corporation then proceeded to verify that OG Construction indeed acknowledged the Addendum #1 and that the bid of $118,049.75 included any and all changes that were included in the Addendum #1.  O.G. Construction Company LLC, did confirm, and thereafter, R. Gutierrez Engineering Corporation proceeded to recommend the lowest qualified bidder.  (See attached recommendation letter from R. Gutierrez Engineering Corporation, LLC, copy of bid tabulation, and letters of clarification from O.G. Construction.)  The project consists of the reconstruction of Shelby Avenue.
