NOTICE is hereby given in accordance with Chapter 551, Texas Government Code, that a SPECIAL MEETING of the Commissioners' Court will be held at the Edinburg Council Chambers 415 W. University Drive, Edinburg, Hidalgo County, Texas. Discussion and possible action relating to the following business will be transacted:

All members of the Court were counted present.

Judge Garcia led the Court and Audience in reciting the Pledge of Allegiance.

Prayer
Virginia Townsend led the Court and Audience in Prayer.
Judge Garcia then asked for a moment of silence for Mrs. Guadalupe Ramirez, Mother to Ms. Mona Porras; Humberto "Beto" Rodriguez, and to honor those who passed away in the Oklahoma tornadoes.

Approval of Consent Agenda
The Court moved to approve the Consent Agenda.

Open Forum
-Virginia Townsend commented on the lack of construction/remodeling of the Old Administration Building and the quantity of outstanding projects such as the Modular Buildings, etc. She also asked if the Court was planning on reinstating the Step & Grade, discussed the Biometric Clock Policy, Modified Leave Policy (FLSA Exempt Employees) and Public Accountability Policy.


-Ann Cass made various comments on the vote centers and Public Hearings.

-Judge Garcia asked the Court to proceed with item 14.A. so that the matter of Vote Center Selection could be properly discussed.

-Opal Billman disagrees with the legal settlement of her property and her false imprisonment.

Presentation, discussion, and action as applicable regarding House Bill 2123 and House Bill 1127.

Willacy County Judge John Gonzalez came before the Court to discuss HB 2123 (relating to the regulation of game rooms) and how it will affect his county. 

Rene Guerra, District Attorney, provided the Court information on gambling, regulations on gambling machines and clarified that gambling in Texas is not permitted.
 

On motion by COMMISSIONER, PCT. 4 JOSEPH PALACIOS, seconded by COMMISSIONER, PCT. 3 JOE M. FLORES, the Court made a UNANIMOUS vote of approval to pass on the invitation.

Diana Serna disclosed to the Court and public that this project is one in which O.G. Construction...Judge Garcia interjected and explained that he will be Abstaining from discussion and/or action. Steve Crain, Legal Counsel, addressed concerns by the Auditor and Ms. Serna and asked that Commissioner Hector Palacios preside over the meeting. Judge Garcia Abstained from action and or discussion but remained present to maintain the quorum.

Commissioner Pct. 1 A.C. CUELLAR, JR. moved to approve the acceptance and action to adjust the extension to reflect the additional $3,000.00 and increase the grand total from $285,632.45 to $288,632.45. The motion was seconded by Commissioner Pct. 2 HECTOR PALACIOS and the carried as follows:

2. Urban County Program on behalf of Precinct No. 1 is requesting consideration and action to award and enter into a construction contract with O.G. Construction, LLC for the base bid minus line item 2 and replacing it with alternate 2 (items pertaining to caliche base work) for a total contract amount of $304,982.35. Utilizing FYs 22, 23, 24 & 25 (2009, 2010 2011 & 2012) from Precinct No. 1 street improvements funds.

Commissioner Pct. 1 A.C. CUELLAR, JR. moved to approve and accept only the Base Bid in the amount of $288,632.45. The motion was seconded by Commissioner Pct. 2 HECTOR PALACIOS and the carried as follows, subject to legal review:

Vote Center Selection Committee Update

-Concerns were expressed by various Vote Center Committee Members of misunderstanding and lack of information. Another committee member expressed concerns because they were asked to reduce the number of polling locations.

-Ms. Rosalie Weisfeld also conveyed some concerns such as reducing the number of vote centers and having a Public Hearing during the Commissioners' Court Meeting which could possibility result in suppressing votes.

-Mrs. Barnes commented that they accomplished what they set out to do with the Voting locations, however difficult it was and clarified that they were not asked to reduce the amount of vote locations.

-Judge Garcia asked that the Court be informed of the next committee meeting so they may attend.

-Ms. Ramon reiterated that she was not reducing the amount of vote locations but rather meeting the needs of the various citizens in Hidalgo County.
