NOTICE is hereby given in accordance with Chapter 551, Texas Government Code, that a SPECIAL MEETING of the Commissioners' Court will be held at the Edinburg Council Chambers 415 W. University Drive, Edinburg, Hidalgo County, Texas. Discussion and possible action relating to the following business will be transacted:

Roll Call

Judge Garcia led the Court and Audience in reciting the Pledge of Allegiance.

Mr. Jaime Longoria led the Court and Audience in Prayer.

Approval of Consent Agenda

The Court moved to approve the Consent Agenda.

Open Forum

Judge Garcia wanted to recognize an event occurring in Washington where President Obama is honoring an Edinburg resident with the highest Military Award, the Congressional Medal of Honor.

Fern McClaugherty questioned Item 7.E for an alarm in what she believes is the old license building in McAllen on Hackberry. She stated she wouldn’t know why the alarm would be needed for a place that has nothing to steal out of.

Opal Billman stated the land she and her late husband purchased from her mother-in-law was considered excess land with no value by the court. She is concerned that the lake she has on her property is connected to the irrigation district.

Maria Guadalupe Pruneda, LUPE member, lives in Linda Vista Subdivision and understood that Precinct 3 plans projects on three subdivisions and would like to know which ones they are. She questioned the grant that was received by Hidalgo County to correct problems in the colonias.

Commissioner Joe Flores commented that the colonia Linda Vista is sitting in low spot. A drainage ditch exists, yet he understands problems continue to exist. He stated there is a need for a pump to eject the water and he will plan to alleviate the issue soon.

Emilio De Los Santos wanted to elaborate on the honors Private Pedro Cano received. Private Cano was recognized by a resolution introduced by Texas House Representative Aaron Pena five years ago. At that time, Private Cano was honored with the Texas Legislature Medal of Honor. He wanted to announce that Private Cano will also be recognized at the Pentagon as well as The White House.

FLORES, the Court made a UNANIMOUS vote of approval as it pertains to Item 20.C: C-1518-14-F; Josephine Carnell and David Mendoza, Jr. v. Hidalgo County, Hidalgo County Drainage District No. 1 and Gerardo Cavazos.

2. Requesting engagement with the firm of ATLAS, HALL & RODRIGUEZ for the "Provision of Legal Services/Representation in connection with Litigation" and authority to submit letter of engagement

On motion by COMMISSIONER PCT. 3, JOE M. FLORES, seconded by COMMISSIONER PCT. 1, A.C. CUELLAR, JR., the Court made a UNANIMOUS vote of approval as it pertains to Item 20.C: C-1518-14-F; Josephine Carnell and David Mendoza, Jr. v. Hidalgo County, Hidalgo County Drainage District No. 1 and Gerardo Cavazos.

Mr. Valde Guerra informed the Court that there was a meeting held in respect to the renovations the day prior. He stated that they will hold another meeting on Thursday or Friday and will update the court next week.

3) Emergency situations occurring since last agenda meeting

Requesting approval of the Memorandum of Agreement between Remote Area Medical Foundation and The County of Hidalgo.  Remote Area Medical Foundation in conjunction with Operation Lone Star will provide free expanded medical services to the residents of Hidalgo County.

Mr. Eddie Olivarez noted that this will bring in $400,000 worth of services to our residents at no cost to them during Operation Lone Star, June 4 and June 5, 2014.

Ms. Serna advised that the backup indicated the incorrect engineer, Javier Hinojosa, and should be Hinojosa Engineering.  She will provide the corrected backup.

 Urban County Program on behalf of Hidalgo County Precinct No. 2 is requesting authority to purchase solar lights for Whitewing and Road Runner Colonias from Facility Solutions Group (contract # 368-10) an approved vendor through Hidalgo County’s membership and participation with the State of Texas Buy Board. The total cost for the purchase and installation is $230,551.20 (quote attached hereto) to include shipping and handling, installation and discounts as requested by the Hidalgo County Precinct No. 2 for the UCP FY 26 (2013) Street Improvement funds.

Mr. Eufracio informed the court about a recent phone call regarding the dissolution of Perdue, Brandon, Fielder, Collins & Mott, in association with the Law Firm of John David Franz.  He wanted direction on how the payments should be issued.  Steve Crain, Legal Counsel, stated that one checks should be made out to Perdue, Brandon, Fielder, Collins & Mott, in association with the Law Firm of John David Franz in order to pay pursuant to the contract not according to the W-9. Mr. Franz stated he sent a letter dated February 20, 2014 notifying Judge Garcia of the future dissolution with the law firm, Perdue, Brandon.  He stated they will continue to represent the County, without interruption, until the dissolution of the firms is complete.
