BE IT REMEMBERED, that on this 21st day of March A.D., 2014, there was begun and held a SPECIAL MEETING of the Honorable Commissioners’ Court of Hidalgo County, Texas, wherein the following members thereof were present, to-wit:

NOTICE is hereby given in accordance with Chapter 551, Texas Government Code, that a SPECIAL MEETING of the Commissioners' Court will be held at the Edinburg Council Chambers 415 W. University Drive, Edinburg, Hidalgo County, Texas. Discussion and possible action relating to the following business will be transacted:

Discussion, consideration and action to engage a vendor for the purpose of reviewing and conducting a forensic analysis of Hidalgo County election hardware/equipment and software used in the 2014 March Primary, in an amount not to exceed $50K through a purchase order

Mrs. Marty Salazar stated that she assigned two staff members from the Purchasing department to search for cooperative program awarded vendors and found none.  The internet search led them to four vendors and distributed detailed proposal requests and only two responded by the deadline.  She stated the amount would exceed the competitive bidding requirements of $50,000.  Ms. Yvonne Ramon informed the Court that she has a court order signed by Judge Aida Salinas which would allow the removal of the Republican voting machines and there is a reserve of 90 machines.  She stated there would be enough machines available for the May election, yet there will be a reduction of poll locations. 

Steve Crain, legal counsel, informed the court that the Election Code states that the District Attorney's Office or the Attorney General's Office has authority on the investigation.  The Election Code also states that if the allegations are in more than one county, then the Attorney General would have authority, but in this case, the allegations are only in one county in which the District Attorney would have the authority to investigate in this situation.  Mr. Crain stated that the Judge ordered the machines to be impounded; therefore the appropriate action is to see what that Judge is going to decide what is just because the machines cannot be investigated while they are impounded. 

The court requested for Purchasing to go out for RFP's for an expert to evaluate the voting machines to determine if the they are reliable and safe when operated in accordance with procedures of the Election Administrator.  Ms. Salazar stated she would place the item on the agenda for next week.

On motion by COMMISSIONER PCT. 4, JOSEPH PALACIOS, seconded by COMMISSIONER PCT. 3, JOE M. FLORES, the Court made a UNANIMOUS vote of approval.

Vote: 5 - 0 - Unanimously

Drainage District #1 Board are now hereby adjourned.
