NOTICE is hereby given in accordance with Chapter 551, Texas Government Code, that a SPECIAL MEETING of the Commissioners' Court will be held at the Edinburg Council Chambers 415 W. University Drive, Edinburg, Hidalgo County, Texas. Discussion and possible action relating to the following business will be transacted:

Roll Call

All members of the Court were in attendance.

Judge Garcia led the Court and Audience in reciting the Pledge of Allegiance.

Virginia Townsend led the Court and Audience in Prayer.

Approval of Consent Agenda

The Court moved to approved the Consent Agenda for the exception of Item.7.A - 7.H. to be pulled for discussion.

Open Forum

Commissioner Palacios and Commissioner Cuellar stepped away from the meeting.

Commissioner Palacios joined the meeting.

Opal Billman came in front of the Court to express her disagreement in regards to her community property. She stated that the property was sold without her consent to the City of Mission after her husband's death.

Commissioner Cuellar joined the meeting.

Maria Gomez, Brad Cano, Neli Curiel, Rosie Tijerina, LUPE, came to thanked The Budget Department and the Office of the Attorney General, in regards to the Public Lighting Program.
Rosie Tijerina mentioned that due to the consistent rains the potholes that were already in existence have become even worst. Although she acknowledges some of the roads being covered with caliche she said it’s still not good enough for the amount of traffic going through. Neli Curiel added to this comment saying the potholes are affecting their tires.

Fern McClaugherty stated that there are names of deceased people still in the voting list and that somehow those names appeared as current voters. She also addressed the issues in regards to the proposed escalators in the new courthouse, stating that having them could be a safety issue and consistent maintenance.

Virginia Townsend approached the Court to express how pleased she was to be back at the Administration Building.

Josue Ramirez, ARISE, upgraded the Court in regards the youth group and their South Tower Power project. Once again he restated issues of the waste water outfall in the South Tower area. He added that there will be a public meeting in regards to the issues; he formally invited Commissioner Cantu and his staff.

Proclamation declaring August 31, 2015 as The University of Texas Rio Grande Valley Day in Hidalgo County.

Julia Sullivan introduced to the Court the Proclamation declaring August 31, 2015 as The University of Texas Rio Grande Valley in Hidalgo County. She introduced UTRGV President, Guy Bailey and Vice President for University Advancement, Veronica Gonzalez, together with UTRGV students Alberto Adame and Simona Lizondo accepted the Resolution. In recognition of the new University the Edinburg Courthouse will fly the UTRGV flag on August 31, 2015.

On motion by COMMISSIONER PCT. 1, A.C. CUELLAR, JR., seconded by COMMISSIONER PCT. 4, JOSEPH PALACIOS, the Court made a UNANIMOUS vote of approval.

Proclamation designating the Month of September as Valley Voter Month in Hidalgo County.

Hidalgo County Elections Administrator Yvonne Ramon and members of the Advocacy Alliance Center of Texas (AACT) together with Cameron County Elections Administrator Remi Garza came before the Court to promote voting in the Valley. Albert Morales representative of (AACT) stated that there has been an increase in voting turnouts since the last major election. Veronica Garza former State Representative and member of the Advocacy Alliance Center of Texas, was pleased to inform the audience that with the help of Representative Sergio Muñoz, Senator Juan “Chuy” Hinojosa and former Chief of Staff Richard Sanchez the Proclamation was passed by the 84th  legislature of the State of Texas.

On motion by COMMISSIONER PCT. 3, JOE M. FLORES, seconded by COMMISSIONER PCT. 1, A.C. CUELLAR, JR., the Court made a UNANIMOUS vote of approval.

Presentation by Rolando Rios on the Texas Voter ID Law.

Mr. Rios confirmed that voters will be able to cast their ballots with the regular Voters Registration Card with no need for a photo I.D. In reference to the passing of the law without the photo I.D. Mr. Rios recognized Judge Ramon Garcia as one of the judges that contribute to this case.

Presentation regarding Property Assessed Clean Energy (PACE) 

Bobby Villarreal approached to Court in regards to the Property Assessed Clean Energy (PACE) he introduced Ken Jones and Charlene Heydinger, Executive Director of Keeping PACE in Texas. Ms. Heydinger stated that that this program is to no cost to the County or to anyone who does not wish to participate in it. The program is designated to help enable commercial, multi-family or agricultural property owners to get low-cost loans for water conservation and energy efficiency. The only cost is to those property owners who wish to participate. There will be a conference in regards to the program on August 19, 2015 to August 21, 2015.

Approval of resolution and order in accordance with SB1964 assessing additional fees for filing court cases and/or recording certain documents 

Commissioner Flores stepped away from the meeting.

The new bill proposes having a $20 dollar increase in filing fees for civil cases, district courts, statutory probate courts, and county courts at law, set to take effect on January 1, 2016. The second is a $10.00 fee proposed for all real property recordings filed in the County Clerk's Office, beginning October 1, 2015.  In reference to the County Clerk’s Office, Chief Deputy, Annette Muñiz requested to wait until January 1, 2016, due to current software upgrades being conducted at the County Clerk's Office. 

Commissioner Flores joined the meeting.

On motion by COMMISSIONER PCT. 3, JOE M. FLORES, seconded by COMMISSIONER PCT. 1, A.C. CUELLAR, JR., the Court made a UNANIMOUS vote of approval to have both fees go into effect January 1, 2016.

Paul Villarreal, Hidalgo County Tax Assessor, discussed with the Court the future submission of the 2015 effective and rollback tax rates and the 2015 planning calendar. Judge Garcia stated that currently the tax rate is of $.59 per $100.00 evaluation and they intent to leave it as is.

Introduction by Andrea Valdez, County Coordinator and Kimberly Guillen, Community Outreach Program Specialist of the 2015-2016 Hidalgo County 4-H Ambassadors, Hidalgo County Council Officers and District 12 Council Officers.

The new 2015 – 2016 County Council Officers and 4-H Ambassadors were proudly introduced by Andrea Valdez, who stated the importance of the members within the county. The purpose and goals are to provide leadership and citizenship skills, by becoming involved in the county, district, and state, national and international activities. The Officers and Ambassadors are also spoke persons that become involved in community service and help promote the organization.

The new 2015 – 2016 Hidalgo County Council Officers are Claudia Martinez, Vanessa Martinez, Bianca Garcia, Michael Buillon, Charles Lee, Briana Bullion, Tyler Denny, Clare Lee and Deana Ciomperlik.

The new 2015 – 2016 Hidalgo County Ambassadors are Bianca Garcia, Brody Hill, Tyler Denny, Cynthia Cantu, Olivia Vela, Briana Bullion, Amanda Salinas, Mathew Salinas, Michael Bullion, Krista Olivarez, Claudia Martinez, Vanessa Martinez, Leandra Flores, James Andrew Cano, Amanda Cantu and Derek Cerelli.

Hidalgo County Commissioners Court and present audience honored U.S. Marine Lance Corporal Jacob D. Garcia, he proudly represented and served our country and county and was honored the Bronze Star Medal on May 16, 2011. U.S. Marine Lance Corporal Jacob D. Garcia was born and raised in Edinburg Texas, to Jose Armando Garcia and Elia R. Garcia. He attended Edinburg High School and graduated in 2007 and as a U.S. Marine was deployed to Afghanistan where he served for five years.

On June of 2010 while serving as the lead sweeper his unit was surrounded by the enemy forces; however he acted unselfish of his own safety and heroically returned to cleared out the area for his unit. He was also involved in over 130 combat patrols, three battalion operations and two company operations. He also identified 36 IEDs totaling 1,300 pounds of explosives.
