NOTICE is hereby given in accordance with Chapter 551, Texas Government Code, that a SPECIAL MEETING of the Commissioners' Court will be held at the Edinburg Council Chambers 415 W. University Drive, Edinburg, Hidalgo County, Texas. Discussion and possible action relating to the following business will be transacted:

All members of the Court were present for the exception of Commissioner Cuellar.

Judge Garcia led the courtroom in reciting the Pledge of Allegiance.

Virginia Townsend led the audience in Prayer.

Commissioner Cuellar joined the meeting.

Approval of Consent Agenda

The court moved to approved the Consent Agenda for the exception of Item.11.H.

Open Forum

Senior Deputy and K-9 trainer Javier Solis proudly spoke about the life of K-9 Deputy Argo. He was born in the Czech Republic on March 13, 2006 and later imported to the United States. In 2009 he was adopted by the Sheriff’s Office and was partnered with Lt. Francisco Guerrero. Deputy Argo obtained two National Certifications, from the National Narcotic Detective Dog Association. He was also certified as a Narcotic Detective Dog and as a Patrol Tracking Dog.

Throughout his service to the county he was responsible for thousands drug seizures and was credited with several seizures of drug money that exceeded over $1 million dollars.

Sadly at the beginning of 2015 Deputy Argo was diagnosed with bone cancer and despite the medical efforts to ease his pain, his love ones made the difficult decision of putting him to sleep. He passed away on October 10, 2015.

The Sheriff’s Office will be hosting a memorial to honor the life of Deputy Argo, as the 1st Annual South Texas Police K-9 Competition. The free event will be held November 10, 2015 from 9:00 a.m. to 5:00 p.m. the event is open to everyone in the community.

Patrick Perone with Friends of the Edinburg Cemeteries came to speak about the different charities they assist. He personally thanked Commissioner Palacios, Valde Guerra and Judge Garcia for all their support in the charity process. Norma Ramirez also spoke about the importance of the charity and the products that they are selling to help the Gate Way Association. In addition they kindly requested the assistance of the court to keep the maintenance of the local cemeteries.

J.L. Ivey approached the members of the court to manifest his constant issues with flooding around his community. Mr. Ivey also brought to court pictures of what he assumed was a county backhoe parked for three days at a county employee’s house, for no apparent reason. He approached Commissioner Cuellar and demanded an explanation for the equipment being parked at a house instead of putting it to use. Commissioners Palacios and Flores explained that it is not strange for these types of equipment to be parked at the employee’s home for safety reasons. Nonetheless, to ease Mr. Ivey suspicions Mr. Lozano mentioned that all these type of equipment have tracking devices to know where they are located at all times.

Andrea Landeros from ARISE formally thanked Commissioner Cuellar and Commissioner Cantu for attending their meeting in regards to the EPA meeting of the outfall in South Tower.

Commissioner Palacios stepped away from the meeting.

Norma Aldape expressed her situation in regards to the flooding in her community. She also reminded the court about the importance of public lighting in the colonias.

Fern McClaugherty argued that she has been contacted in regards to the flooding issues around the county and requested for the commissioners to consider drainage as a priority. Ms. McClaugherty commented on item 6.A. of the agenda, suggesting that there’s special treatment of certain employees.

Commissioner Palacios joined the meeting.

Commissioner Flores addressed the issue of flooding pointing out that he received calls from the workers in the affected areas that have noticed trash in the drainage ditches. All these items keep the ditches suffocated and reduce the flow of water.

Commissioner Cuellar stepped away from the meeting.

Opal Billman discussed her continuous issues with the unfair treatment and division of her community property. She claims her family has been deserted from their rightful land and demands an explanation from the Drainage District, the county and the city of Mission.

Commissioner Cuellar joined the meeting.

Valde Guerra commented that he will be implementing a more secured approached during Open Forum.

Judge Garcia suggested that for safety reasons it will be best if the deputies bring up to them any exhibits from the public.

Recognition of Precinct 2 Constable Martin Cantu for his role in rescuing a man from falling off the Queen Isabella Causeway.

Constable Martin Cantu was recognized by Commissioners Court and the community for his courageous participation in saving a man who was about to jump off the Queen Isabella Causeway in Port Isabel. 

In returned Constable Cantu acknowledge South Padre Island Police Officer Carlos Gonzalez who was the first one to respond to the call.

On motion by COMMISSIONER PCT. 3, JOE M. FLORES, seconded by COMMISSIONER PCT. 2, EDUARDO “EDDIE” CANTU, the Court made a UNANIMOUS vote of approval.

Resolution in appreciation of Heals International Medical Missions (HIMM) for their work providing medical care to the poor

Commissioners Court honored and openly recognized the tremendous medical assistance provided by the Heals International Medical Missions (HIMM) to help Central American countries.  This time around the group traveled to Colombia, were they were able to provide medical aid to the unfortunate. 

On motion by COMMISSIONER PCT. 3, JOE M. FLORES, seconded by COMMISSIONER PCT. 1, A.C. CUELLAR, JR., the Court made a UNANIMOUS vote of approval.

Presentation on the United Way of South Texas’ Hidalgo County Campaign

Commissioner Flores stepped away form the meeting.

Michael Leo, County Judge’s Office approached the court to announced the kick off of the United Way of South Texas’ Hidalgo County Campaign. Fidel Mercado representative of the United Way South Texas commented on the various assistance provided by the organization. He stated that all the money collected stays here in the Valley. One of the assistance they provide is to taking students shopping for school clothes and assist the organization Mujeres Unidas.

Approval to waive the year 2016 contribution/donation of sick leave hours to the Sick Leave Pool for currently enrolled participants due to current balance.  Employees not currently enrolled and who wish to enroll must contribute sick leave hours as per the Sick Leave Policy.

Raul Silguero commented that no action was taken on Item 6.A because other stricter implementations were taken.

Mr. Silguero reported on the Sick Leave Pool for the current enrolled employees, he explained that there’s about 10,000 hours in the pool. He proposed waiving the hours of current enrolled employees, but anyone new to the pool will have to donate.

4.  Requesting approval of the budget appropriation in the amount of $147,344.00 in grant funds and $14,734.00 in local match funds.  

Mr. Olivarez mentioned they were actually able to allocate $15,000 in local match funds.

On motion by COMMISSIONER PCT. 1, A.C. CUELLAR, JR., seconded by COMMISSIONER PCT. 3, JOE M. FLORES, the Court made a UNANIMOUS vote of approval.

Martha Sanchez representing LUPE came to court to accept the Resolution in support of the Deferred Action for Parental Accountability (DAPA) and Deferred Action for Childhood Arrivals (DACA). Ms. Sanchez mentioned that Cameron County, the City of Edinburg and now the County of Hidalgo have approved and passed this much anticipated resolution. The resolutions and letters they been able to obtain will be taken to Governor Greg Abbott.


Commissioner Cantu commented on the story of a young student who he was able to assist while the student was struggling to pass the ACT exam and at the same time was concentrating on obtaining DAPA. The student was able to obtained a full scholarship and is now attending the University of Houston in Victoria, Texas.

Ms. Salazar reminded Commissioner Palacios who the evaluators were, Mr. Cruz, Mr. Quintanilla, Ivette Salinas and herself. 

Mr. Quintanilla spoke about the coverage the county has had for the last 10 years, he mentioned that this year MSW came in and proposed a different coverage for the county. He stated that currently the county has a $ 25,000 deductible for property coverage plus a 2% on wind and hail. Now with the new company the county will be insured for $25,000 in property coverage with $ 50, 000 on wind and hail. Previously they would of have to buy supplemental insurance or buy back policies in order to to cover that $ 50,000 to $ 499,000 for two events per year. This new proposal would eliminate the need for that additional insurance. Therefore they are recommending this new company because of the lower premiums and deductibles, plus they are also recommending the option for flood insurance in zone A.

The county has been with current vendor for the last two years and have not experienced any issues and everything has stayed the same, for the exception of medical malpractice. For the medical malpractice they are recommending to stay with Merkel Evanston Ins., it is a $ 34,000 premium. Lloyd's London had a lower premium at $30,000 however, their deductible is higher.

Mr. Ray Eufracio requested no action on this item due to the specs not being complete and awarding the contract like that. Ms. Salazar commented that under the letter submitted to the county by the Health Department it states the need for the urgent and necessary repairs. The precinct had to move on fixing the immediate health risk therefore, they asked a proposal from several vendors. They were given a proposal to give them the work. Now an engineer is being engaged to make sure the proposal ends up meeting all the specifications that they need before the PO is issued. Still Mr. Eufracio declared his worries about awarding the contract to the vendor without the specs. Commissioner Cantu commented that at this time they have an emergency situation due to a gravel road on the south side of town and that they want to address this situation by adding an inexpensive layer to control the dust. They also have seen fecal matter from cattle on this road and as vehicles drive through, the contaminated dust is polluting the produce in the fields. Commissioner Cantu reported that the USDA and the County’s Health Department have approached him with this emergency situation therefore, he is asking for an immediate repair of the road.
