NOTICE is hereby given in accordance with Chapter 551, Texas Government Code, that a SPECIAL MEETING of the Commissioners' Court will be held at the Edinburg Council Chambers 415 W. University Drive, Edinburg, Hidalgo County, Texas. Discussion and possible action relating to the following business will be transacted:

Open Forum

Fern McClaugherty spoke about the issues of potholes in the Trenton Road to Tower Road. She mentioned that potholes run all the way from San Juan Road to Tower Road, she also asked what precinct Tower Road belongs to. She demanded knowing where the money from Road and Bridge is going since there is too many roads with issues.

Judge Garcia joined the meeting and Commissioner Flores stepped away.

Once again Ms. Billman talked about her unfair division of community property. According to her the court in charge of her settlement divided her property into two corporations and spread the community among agents, managers and trustees. She is now demanding to have a court order dismissing all court appointees of her community property.

Commissioner Flores joined the meeting.

Sandra Sanchez representing Healthy McAllen Kids Marathon spoke about the participation of the community in the marathon. The free event is sponsor by the Doctor’s Hospital Renaissance United Health Care, The Monitor and City of McAllen with the support of Hidalgo County and McAllen I.S.D.

Julia Sullivan, Director of Hidalgo County Public Affairs, spoke about the great turn out that they had at the Hidalgo County’s Christmas Party.

Ms. Sullivan also mentioned the enormous participation by the Commissioners Court Commissioners and county departments in the annual toy drive. Thanks to all the contributions they will be delivering toys to all 41 Head Start centers. In addition to the Head Start Centers they will also donate to the children from the CASA program as well. Representative Oscar Longoria also adopted a center in precinct 3. Ocean Gate Company also joined in and adopted three classrooms. Ms. Sullivan mentioned the number of centers adopted by the precincts. Precinct 1 adopted 11 centers, including 1 classroom adopted by the boot camp in Weslaco. Precinct 2 adopted 3 centers, precinct 3 adopted 6 centers and precinct 4 also adopted 3 centers.

Ricardo Saldaña gave a quick update on the October rain event that affected the east side of the county. He announced that the Disaster Recovery Center will be open in Weslaco. He commented that so far engineers from FEMA have already gone to the affected areas to inspect the damages. They estimated close to $4 million in road damages from the October rain event. He is hopeful that this number will compound to the number set by the State of Texas to be able to declare public assistance of $37.5 million.
On another note from the June event precinct 4 had request a reevaluation of their roads, City of Edinburg submited an appeal also and precinct 1 as well.

Commissioner Palacios commented on the concerns of Ms. McClaugherty in regards to the Trenton Road and Raul Longoria Road. He mentioned that these roads are divided into different precincts, he also added that they are working to meet the demands of the public and urged for citizens to call the precincts to notify them of the damaged roads.

Judge Rudy Delgado approached the court to speak about the last meeting they had in regards to the Indigent Defend Commission. He acknowledged the presentation by Judge Hilda Salinas Flores and for working with all the judges in administrating the program. He believes that the commission staff wanted to advance the money that was projected for the county but now the commission has withheld the monies until they come into compliance. Judge Delgado indicated that 17 out of 18 courts, not including the Probate Court have complied, including the 93rd Court which he preside. He mentioned that the only court that was not in compliance was the 449th District Court, under Judge Jesse Contreras. According to Judge Delgado, Judge Contreras had appeared at the commission and had removed himself from the appointing process. He does not believe that Judge Contreras went far enough to be fully removed, because he proposed a plan to have the presiding judge make the appointments in consultation with the staff. Therefore, he believes that this is the reason why the commission did not ruled in favor for the funds that were allocated for Hidalgo County. He commented that they are going to reevaluate the position to make sure it is in compliance. However, as a member of the judiciary he is proposing to advice Judge Bobby Flores that he is not to assist Judge Contreras in taking that other approach. Instead it should be left to the Indigent Defense Program.

Judge Garcia expressed to Judge Delgado that since they are under Open Forum they cannot discuss this issue any further.

Commissioner Cantu emphasized the efforts they are making to strengthen the relations with the rest of the courts and the board of judges.

Commissioner Palacios stepped away from the meeting.

Mr. Arredondo commented that this is an extension from Canyon Road to 907, they are expanding to a five lane and there is crossing of a gas line basically they are looking into extending the casing because of the widening.

Ramiro Garza Jr. accepted a resolution in honor of 15 years of service to the City of Edinburg as well as serving Hidalgo County through Precinct 4.  Mr. Garza is responsible for collaborating on the future courthouse project. He also contributed on the merging of UTPA and UTB resulting in a stronger unity paving the way for a new UTRGV Medical School.

Ms. Salazar commented that this item is to be approve by modifying the amendment for the construction manager prodigy in order to add the additional $7,500 per month through December 31, 2015 in the language that will approve will be what was agreed upon between Mr. Steven Crain and the Auditor’s Office.

FLORES, seconded by COMMISSIONER PCT. 2, EDUARDO “EDDIE” CANTU, the Court made a UNANIMOUS vote of approval subject to the basic services compensations to the construction manager is a fee of $105,000 and no cents which includes the amount not to exceed $7,500 per month for 2 months base on the hourly rates included in exhibit A, to coordinate unforeseen mechanical issues.
