NOTICE is hereby given in accordance with Chapter 551, Texas Government Code, that a SPECIAL MEETING of the Commissioners' Court will be held at the Edinburg Council Chambers 415 W. University Drive, Edinburg, Hidalgo County, Texas. Discussion and possible action relating to the following business will be transacted:

Approval of Proclamation declaring April 10 - April 16, 2016 as Volunteer South Texas Week in Hidalgo County.
 
Volunteer South Texas Program Coordinator and United Way Board Member Jeanette Ahlenius thanked Commissioners Court for the proclamation. She informed this new platform is an easier way to stay connected, the advantage is that everyone can use this new tool through their smartphones. 

Mrs. Ahlenius introduced United Way of South Texas President Thelma Garza and Maggie Peña from the Salvation Army. Ms.Peña thanked United Way for allowing them the opportunity to participate in the new online platform. She announced that 46 volunteers signed up this week, 20 of those individuals have already complete 60 hrs of community service.

Approval of Proclamation Declaring April 23, 2016 as Walk-N-Rolla Celebration Day

Hidalgo Metropolitan Planning Organization members Mr. Andrew Canon and Debra Fanco came to court to invite the community to the 6th Annual Walk-n-Rolla Event.The event is to encourage residents to seek alternate transportation, by walking, bicycling, carpooling and public-transit. 

Ms. Franco thanked Commissioners Court for their support in embracing new alternatives to bring awareness to obesity and diabetes. She thanked Mr. Canon for the support provided to the South Texas Juvenile Diabetes Association.

Mr. Canon gave special thanks to Mr. Richard Hinojosa at the City of Edinburg and the city staff for their partnership.

On motion by COMMISSIONER PCT. 3, JOE M. FLORES, seconded by COMMISSIONER PCT. 1, A.C. CUELLAR, JR., the Court made a UNANIMOUS vote of approval.

Discussion, consideration and action on Hidalgo County Affiliated Departments Retirement Plan Adoption Addendum with authority to submit to Internal Revenue Service and authorize County Judge to sign related documents

Mr. Guerra informed the court that this is the Affiliated Departments Retirement Plan, for CSA, Head Start and Urban County. This is an annual event and it's required.

On motion by COMMISSIONER PCT. 1, A.C. CUELLAR, JR., seconded by COMMISSIONER PCT. 3, JOE M. FLORES, the Court made a UNANIMOUS vote of approval.

Judge Garcia questioned Mr. Guerra if they've already invited a representative from the agency holding the retirement money to come make a report. On that regard, Mr. Bobby Villarreal informed the judge that he had discussed it with Mrs. Norma Garcia and they have a specific date. Mr. Guerra added that the day is sometime in May and the Treasurers Office is coordinating that meeting.

Mr. Villarreal mentioned to the judge that he knows of other counties that have under founded, but Hidalgo County has never. Mr. Guerra commented that the county is very diligent and always attends the conferences in Austin.

Commissioner Palacios joined the meeting.

Mr. Guerra corrected the previous statement informing that this is an annual event, the event is actually every 6 years.

Approval of 2016 unappropriation of funds in the amount of $257,000.00.

Mr. Olivarez noted that last week he presented to the court in regards to the 1115 Waiver, where they did a local provider fund of $8.2 million. However, there was an error by the State, they are now informing that Starr County is going to be contributing a larger amount. In actuality Hidalgo Health & Human Services Department ended up giving less than they got permission for. The Auditor's Office is asking to let the court know that it is $257,000.00 less than Mr. Olivarez got permission for.

Mrs. Yvonne Ramon, Elections Administrator was pleased to introduced the new Elections Analyst Mrs. Hilda Salinas. The new analyst spoke about new social media projects she has been working on and her eagerness to learn the elections division.

Election Day Primary Poll Workers:
TAC RULE 81.120 – Compensation for Election Day-Primary Workers (a)… the compensation paid to polling-place judges, clerks, early-voting-ballot board members, or persons working at the central counting station for the general-primary and primary-runoff elections shall be equal to the hourly rate paid by the county for such workers in county elections up to $8.00 per hour from the primary fund.

Mrs. Ramon advised that she wanted to have a discussion in relation to the possibility of increasing the wage for the poll workers and judges, she explained that this would be a supplement to the current $8.00 dollars across the board. Once more, she explained to the court that the State pays $8.00 dollars reimburse straight across for workers on election day. 

Judge Garcia reference the Emergency Meeting held on March 8, 2016 were they decided to increase the pay. The judge reminded the court that at that emergency meeting he contacted Secretary of State Mr. Carlos Cascos who referred them to Mr. Keith Ingram. Mr. Ingram then sent the judge an e-mail explaining that legally there was no authority for the county to do it but that legally they would be able to do it; leaving it to the county to do make the decision.

Mr. Crain mentioned that he too sent correspondence to the judge informing that there's no legal or direct legal authority, it may imply. However, he recommended to seek an Attorney General Opinion to confirm, prior to taking action. On that regard, Judge stated his concerns over the short period of time that they have to work with, as they have to start hiring individuals. Judge Garcia stated that he knew of other counties that have done it, and the chief elections officers and council have said that they can do it. Therefore, stating that he is not sure if it makes any particle sense to request an Attorney General Opinion.

Melissa Alvarez announced that the total cost for May, would be $30,415.00 dollars having the judges at $12.00 per hour and the clerks at $10.10 per hour and plus training. Mr. Sergio Cruz informed the members that they would have to bring an item back for next meeting to approve. Ms. Alvarez confirmed to the judge that this is for for the Primary Runoff. 

Commissioner Palacios stepped away from the meeting.

Mrs. Ramon clarified that this is a supplement to what the State already pays, as this is a party cost. The Democratic and Republican Parties run Election Day, they receive reimbursement from the State at $8.00 dollars an hour per hour and per employee hired. Mrs. Ramon stated that these are not Hidalgo County employees, as each party is responsible to pay them. Therefore, it is going to be a supplement to what they already receive, to then put them at the same level that Hidalgo County employees which do get hire by the county to run early voting get. 

Mrs. Ramon reaffirmed to Commissioner Flores that it would have to be for both parties.

Commissioner Flores asked Mrs. Ramon is this kind of decision has been made before here in the county. In regards, Mrs. Ramon stated that they have been searching through the minutes but haven't found anything.

Mr. Valde Guerra ratified that the final action was $12.00 dollars for both. Commissioner Flores explained that it's going to be $12.00 dollars, $10.10 dollars, plus training. Mrs. Ramon added that this is also for delivery and it would be the supplements because they receive $15.00 dollar reimbursement, while the county pays its judges $25.00 dollars for deliveries. Therefore, there would be that supplement to meet them at the same standards as the county.

Mrs. Ramon introduced the new site for the Primary Runoff Election, the STC Cooper Center. The administrator asked to consider the Pecan Campus a permanent voting site, increasing the locations to 26. The 25 sites have already been voted on.

Requesting authorization for appraisal, survey, metes and bounds, title commitment, and title policy for the North Ware Road Recreation Project.

Commissioner Palacios informed the court that two weeks ago a non-profit visited the precinct 4 office. The commissioner notified that the ECISD numbers are showing that there're 70% of children in that area are at risk. The precinct is partnering with them to take four lots and develop a park and building jointly, to were is not 100% cost to the county. They'll provide tutorials and at risk services for that area.

Commissioner Palacios notified the court that these are all the assistance received from FEMA in total $1.4 million dollars. The commissioner stated that's the previous item and are already recovering and building, those are the two listing above, about $500,000 completed and billing back to FEMA. Under Workforce Solutions they received another grant and still have workers on a 7 day schedule to make sure they completely recover this year.

Mr. Cruz explained that there are concerns by the auditor and that there're proposed purchases for the Constable's Office. However, there're Attorney General Opinions that allows for technology purposes for the Constable's Office as long as Commissioners Court approves. Mr. Cruz mentioned that this only the appropriation, they will have action items to seek the approval of the appropriation.

Commissioner Palacios stated his position in line of the presentations presented, establishing concerns due to not having a fully executed document with the City of Edinburg. The commissioner stated that there's no fully executed document that grantees the $30 million dollars and there're questions in respects to the fiduciary infrastructure in connection to drainage and roadway infrastructure around the area. Moreover, he mentioned that they've discussed with the State about the on system road and hope to have them as a partner. He explained that they are proposing to approach the MPO, which the court already provided a resolution for their consideration. In addition, they are also hoping to have TxDOT as a partner. 

The commissioner further stated his concerns over drainage and the flood issues, stating that the area carries an AH Flood Zone designation. He reminded the court about the severe rains in July 2015, where they saw up to 3 ft of flood waters. The commissioner underlined that this issue does not only have to do with the courthouse, but as well as the city and UTRGV and surrounding areas. He clarified that all his concerns don't mean that they shouldn't select but he stated that there's still a lot of work to do to identify partners and tap into funding and then bring together the architects. 

Additionally, the commissioner stated that it's still not clear if its going to be a shallow or deep foundation. Equally important is the composition of who's representing who, declaring they're on the right track with the selected attorney. Nevertheless, he suggested looking at having a program manager that's going to look at the entire area and not just the courthouse area. The commissioner mentioned that it was the first time the actual footprint of the building were presented with the option of moving it and potentially see some savings.Out of respect, he would like to discuss this option with the city since it could also affect them. 

Overall, he proposed to the court to delay this selection and make time to look at everything else. 

Mrs. Salazar emphasized to the commissioner that this action is up to the court and there's no obligation to continue.

Commissioner Flores asked if it was the county or the city who is going to be in charge of drainage. In response, Commissioner Palacios mentioned to him that there's nothing on paper and that at the last meeting they had deferred the county to be the fiduciary. However there's no fully executed document stating that's the case.

Another issue stated by Commissioner Palacios is to allow to identify the right time tables for infrastructure around the courthouse, look at the drainage variables and identify other variables. 

Commissioner Cantu stated that they need a pause to understand the schematics and really understand what's needed here in the county. They have checked with their financial advisor and are aware of what they can afford and just getting comfortable with that number however, they still need the City of Edinburg and MPO as partners. Most importantly they also need an specific timeline to close Closner and US 281, which could take more than a year to do. The commissioner emphasized that they need to clearly understand the timeframes and the costs.

Commissioner Palacios made clear that he is a big advocate for the new courthouse and clearly understands the necessity for this new building however, there're variables that need to be clear first.

Mrs. Salazar stated that she comprehended the concerns and there're too many variables and conditions that need to be taken into consideration first. 

Commissioner Palacios mentioned that these are issues they have been working on, the judge had several meeting with the MPO and TxDOT. 

Judge Garcia agreed with the decision to take no action at this time, as there are more issues to be address. The judge mentioned that they have been talking with the city and their own lawyers to try to finalize the agreement to finally execute.

HOK representative Mr. Jeff Bradley acknowledged the concerns stated by the court members and affirmed that all those variables are typical parts of a project which they help find a solution for. The architects help coordinate these diligent parts of the projects and address schedules and issues are typically part of the project and can help put together a cohesive plan. 

In regards Commissioner Palacios stated, that he understands that both firms are capable of doing that work. However, there're some parts they have to do as elected officials, as well as consider others like the City of Edinburg, and MPO.

Mr. Mike Brenchley representing HDR suggested that if they're still having uncertainties to speak with others. He concurred with Mr. Bradley in the sense that the architect team can certainly help assist throughout the process. Mr. Brenchley informed they can always come back to answer any questions by the court. 

Commissioner Palacios recognized that both architect firms are capable of assisting, however is HDR available to assist them in any questions or items even if they still haven't selected a firm. Mr. Brenchley clearly stated to the commissioner that the firm will be glad to assist with any questions as they have done it for the last 3 years. 

B.  Authority to commence negotiations [with assistance from Hon. David D. Peden, Purchasing and Court member(s) with the number one (1) ranked firm of __________________________ for the purpose of a Letter of Engagement of professional architectural services  to finalize the design and construction of a New Hidalgo County Courthouse.

She explained to Commissioner Cantu that they have 5 members of service providers those are already accepted into the pool, on that day there was only one title stating appraisal and/or appraisal services providers, it was defined that under appraisal services they actually have 3 providers. Therefore, she is bringing this item back to court to add the review services to the court.

Open Forum

Commissioner Cuellar stepped away from the meeting.

1) Opal Billman spoke about the divorce action taken by the court in regards to the settlement of her community property. She requested to have remove commercial buildings that have been built on the frontage of Shary Road. stating that these land is part of her community property. According to Mrs. Billman her commercial free property has recently been sold, and the City of Mission has claimed to have bought a strip of land running from Shary Road. to Glasscock Road. Mrs. Billman assured that the because Mr. Billman died the law dictates the case must be dismiss.

2) Mr. Jesse Ozuna updated the court in regards to the policy committee meeting he attended last week. He mentioned that one of the topics was the Property Tax Relief Committee, and the possibility of a potential tax relief that would mandate counties to either lower property tax rates or freeze appraisal values. This situation could potentially lower the rate from 8% to 4% leading to potentially lose money. Mr. Ozuna informed that another issues mentioned was the state transportation, the State Transportation Commission is considering removing all toll state authority roads. In addition he also explained that they are losing money through the Sheriff's Office and the support for holding criminal aliens in the criminal justice system. According to Mr. Ozuna, at the moment the reimbursement for this process has been going down and is putting the budge in deficit. Another topic was the Texas Department of Motor Vehicles, they want to collect some of the fees that are collected here and reallocate back to the State.

Commissioner Cuellar joined the meeting.

3) Dr. Adams acknowledged the efforts by Commissioner Cuellar to repair the roads around her area. She explained that her neighbors were able to get engineers to that area to explained the plans for the road repairs. Dr. Adams mentioned that she was puzzled by the excavation around Old La Blanca and Sioux Road. Further she informed of her concerns over the open ditch, due to the present of mosquitos that might carry the new virus. Moreover, she spoke about the plans to widen the road on that immediate area and stated that people already drive through there fast without regards to the potholes.
