NOTICE is hereby given in accordance with Chapter 551, Texas Government Code, that a SPECIAL MEETING of the Commissioners' Court will be held at the Edinburg Council Chambers 415 W. University Drive, Edinburg, Hidalgo County, Texas. Discussion and possible action relating to the following business will be transacted:

Judge Garcia requested the a moment of silence in honor and memory of the Sheriff Deputies who have fallen in the line of duty.

In Regards to the recently released property values, Judge Ramon Garcia took time to explained to the public that the Appraisal District is not part of Hidalgo County Government. The judge stated that the Hidalgo County Appraisal Districts is its own entity, created by the Texas Controller of Public Accounts. Any homeowners who may have concerns regarding the appraise value of their homes should contact the Hidalgo County Appraisal District. The County of Hidalgo has no authority over the county appraisal district, as it is not part of county government.

Recognizing the heroic actions of  Abel and Robert Perez. The father and son team rescued two teenagers from drowning at South Padre Island on Saturday, April 30, 2016.

Judge Garcia and the entire Commissioners Court acknowledged the heroic family duo, father and son who saved two teenagers from drowning at South Padre Island.

Mr. Abel Perez and his son Mr. Robert Perez thanked Commissioners Court for the recognition.

Mr. Michael Leo introduced City of Pharr Executive Director for EDC Mr. Sergio Contreras. The director announced several events that will occur in the City of Pharr to celebrate international trade. 

City of McAllen EDC Executive Director Mr. Keith Patricks stated that they have been able to create over 169,000 jobs.

Presentation & update of County's retirement system by Texas County & District Retirement System (TCDRS).

Hidalgo County Treasurer Mrs. Norma Garcia introduced Mrs. Amy Bishop who was present to update the court about the county's retirement plan.

TCDRS Director Amy Bishop presented a summary and update to Commissioners Court in regards to the retirement plan. The director explained that TCDRS has partnered with over 700 employers throughout the state to be able to provide survival and disability benefits. They serve 270,000 Texans throughout the State, with a 89% funded and a 35 year return of 9.6%

Mrs. Bishop explained that employees are putting a percentage of their pay into a TCDRS account, that account grows 7% a year. At retirement, employees earn a benefit based on the savings account balance and employer match. This is called the Savings-Based plan or Cash Balance Plan. Stating that last year they paid $1.2 billion in benefits for the State of Texas, $19,694,933 went to Hidalgo County. In addition to the county's participation, they also account for 7 districts that participate as separate entities in Hidalgo County.

In addition, the average retiree savings balance in Hidalgo County is $32,919 
On average, age 60 retires see benefits of almost $19,000 a year.

The director presented an overview of how the earnings fund benefits works, explaining that because the employer and the employee are both putting money in advance for when it's needed they are getting the maximum power of investment over time. Investment fund nearly $0.77 of every benefit dollar the employer pays off. About $0.13 comes from employers and $0.10 from employees own pay. 

Mrs. Bishop indicated that they are a long term investors and consider that employees work an an average 15 to 20 years. She presented a chart with the Annualized Returns, the Total Fund and the Benchmark. Under the investments the director noted that for 2015 the mark was at -0.8% primarily due to the drop in oil price and slow growth in the international market. 

Mrs. Erika Nieto, TCDRS Employer Service Representative, stated that the benefits the employer is providing to the employee are responsibly funded. Assuring that when the time comes, funding will be available to pay the benefits. She demonstrated that in the system every employer is required to pay a percentage payroll called a "required rate" to adequately fund the plan. For Hidalgo County for 2017 the require payroll is 11.47% of payroll. By paying this rate, the employer is investing in the employee's future benefits and are paying down any unfunded liabilities within 20 years.

The current 2016 employer rate is 11.25% and it increase in 2017 to 11.47% she explained that the increase was due to the impact to the investment return, over the flat year investment returns. Under the demographic and other changes -0.16% is actually a positive plan experience for Hidalgo County. Based on the demographic research the results show that more people here in the county, when they terminated they withdrew their money and out of withdraw forfeited the matching  dollars that the county had been saving for them. Those matching funds stay in the Hidalgo County account.  

Mrs. Nieto pointed out that one strength of their plan at TCDRS is that decision makers have the flexibility and local control to adjust benefit levels base on the budget and needs. Currently the county has a 7% employee deposit rate and a 200% match. Further, she explained how the require rate could decrease or increase, should the court was to decide to adjust benefit levels. Nevertheless, when it comes to changes they have a very unique timeline. Independent actuaries take a snapshot of the plan, doing it on the last day of the year. From January to April a process called "Evaluation" occurs were they study the workforce in great depth and value the plan. By May 1, rates are release this is when they let the employers know what the rates will be for the coming year. She informed the court that as decision makers they have between May and December 15, to make any plan changes. Should they decide to leave things how they are, rates will simply go into effect January 1, if any changes are to be made they work directly with the treasurer. 

Finally, Mrs. Nieto stated that at TCDRS employer service representatives provide the best accurate information in a timely manner. 

Judge Garcia clarified the reason as to why he requested to have this presentation and stated concerns over the retirement plan. 

Mrs. Bishop acknowledged that there's a lot of negative press over pensions, more likely as they go into the next legislative session there will be more press over local plans. 

Commissioner Flores joined the meeting.

The TCDRS director assured they'll work hard over the legislature to make sure that the pension committee and the legislators understands that TCDRS is different and are not one of the local plans having issues. 

Commissioner Cuellar stepped away from the meeting.

Additionally, she explained that once the money goes into TCDRS is created as trust and constitutionally protected and can not use that money for anything else.

Mr. Silguero stated that for the Administrative Assistant II, it is a longevity correction. The longevity is being distributed through the general fund and the forfeiture fund. This is a correction to charge it to the general fund as normally. 

Mr. Silguero informed that the creation of Criminal Investigator I should be Criminal Investigator II.

Recognition of Hidalgo County nurses and the services they perform. National Nurses Week begins each year on May 6 and ends on May 12.

Mr. Olivarez acknowledged all of Hidalgo County Health & Human Services nurses. In the 83 years of existence, Hidalgo County's nurses have been the foundation. Hidalgo County Health & Human Services accounts with 39 clinical nurse professionals, 16 RN's, 21 LVN's, 1 masters nurse practitioner and 1 physician assistant. They also count with 7 comprehensive clinics and 1 specialty clinic that deals with TB. 

Last year Hidalgo County Human & Health Services through their clinics rendered over 56,183 types of health services to the residents of Hidalgo County at no cost or minimum cost. 

Mr. Olivarez introduced new Clinical Director Mrs. Connie Sanchez, she oversees all clinical operations for Hidalgo County Health & Human Services. He also spoke about Mrs. Gloria Salinas who is the coordinator for the Hidalgo County Health & Human Services. Mrs. Salinas has been nationally recognized by the Center for Disease Control as the best tuberculosis pulmonary nurse in the country.  

Commissioner Cuellar joined the meeting.

Mr. Olivarez spoke Immunization Coordinator Mrs. Nelda Mendez stating that she oversees all 220 physicians who provide immunizations, and is responsible for overseeing over $200 million dollars worth of immunization is distributed throughout the county. 

Mrs. Lucy  Vargas is the newest EP nurse she has overseen 1,200 epidemiology investigations last year.

Mrs. Connie Sanchez recognized all the nurses at the department.

Mrs. Fern McClaugherty stated concerns over Items. 9.E. & 9.F. she requested knowing the success rates for those services provided.

2) Teresa Nieto representing ARISE Organization came on behalf of the Hargill Community. On behalf of the community Mrs. Nieto petitioned Commissioner Cuellar to consider include the town of Hargill, Texas in Hidalgo County's Unincorporated Subdivisions Street Lights Program. According to Mrs. Nieto, Community Organizer Andrea Landeros has been able to collect over 98 signatures in favor of public light. Nevertheless, because Hargill is consider a town and not a subdivision they are having problems. Therefore, they are requesting to have Hargill be divided into four quadrants, to have a cost study for public light installations and maintenance be performed to reflect the estimated cost fo public lighting in Hargill and a tax delinquency report.

Commissioner Flores joined the meeting.

3) Mrs. Opal Billman stated that courts are not allowed to take over private community properties. She affirmed that their community property still belongs to them. According to Mrs. Billman, her property and the income still producing was taken over the court presiding over the divorce case.

4) Community resident of Tower Trails, Marcela Alejandre thanked Commissioner Palacios for the clean up in her community. She stated that this is the second time the cleaning process occurs and appreciates all the help provided by the workers that assisted.
