BE IT REMEMBERED, that on this 7th day of June A.D., 2016, there was begun and held a SPECIAL MEETING of the Honorable Commissioners’ Court of Hidalgo County, Texas, wherein the following members thereof were present, to-wit:

NOTICE is hereby given in accordance with Chapter 551, Texas Government Code, that a SPECIAL MEETING of the Commissioners' Court will be held at the Edinburg Council Chambers 415 W. University Drive, Edinburg, Hidalgo County, Texas. Discussion and possible action relating to the following business will be transacted:

Discussion, consideration and action on the procurement method options for the engagement of Construction and/or Project Management Services Provider in connection with the design and construction of a New Hidalgo County Courthouse Facility:
A. Acceptance and approval of the draft of the "core qualifications, requirements, duties, responsibilities, etc." as drafted and developed by Hon. Hawkins & Peden, Porter Hedges, LLP as part of an RFQ titled: Project Management Service Provider for the Design and Construction of a New Hidalgo County Courthouse Facility with authority to proceed to advertise and selection of the grading committee for same; OR, AS PREVIOUSLY DISCUSSED;
B. Nomination of at least three [3] firms from the HC approved "pool" of Construction Management Service Providers for the purpose of following the established protocol/process of grading/scoring, selecting evaluation committee, placing grid on CC meeting for ranking and thereafter commence the negotiation with the #1 selected in order to finalize an agreement.
Mrs. Salazar notified that they have two options, they can select or nominate from the current construction management provider pool or have legal counsel develop a project specific RFQ, for project management services.
Commissioner Palacios validated with Mrs. Salazar that as of now, they only have a pool for construction management and not for project management. Mrs. Salazar stated that these are two different pools.
Further, she explained that Porter Hedges, has created a core list of services, that has been provided to the court members. In addition, she sent the actual components of the RFQ itself.
Commissioner Cantu questioned if they could select three from the pool today, as last week they selected three. On that regard, Mrs. Salazar informed that precinct 4 has not selected, and the judge requested to see the core services that are going to be required. She made clear that this is not going to be a pool, it is going to be a project specific, request for qualifications for a single award. They'll be ranked but, only select one for this specific project.
Again, Mrs. Salazar stated that three out of the four precincts have selected however, it was put on hold as a request by the judge. She notified that under precinct 1, they have Project Control of Texas, Dannenbum and TEDSI. Precinct 2, Dannenbum, Brothers and Associates and L & G. Precinct 3, Dannenbum, L & G and Brothers and Associates.
Mrs. Salazar explained to Commissioner Cantu that they would only nominate, then she would sent out the scoring sheets. Additionally, they'll put up the advertising on the website, and expect to have statements of qualification by a certain date.
Mr. Crain restated that when the pool was created it was created for the ordinary topic projects to come through, from that pool select a project manager. In this case other counties with a project this size, go out for project specific bid.
Mrs. Salazar informed that she received the packet Friday.
Commissioner Cantu stressed that once they solidify it, have sent out to the potential firms to find out if they'll be submitting their names.
Commissioner Cuellar stepped away from the meeting.
Judge Garcia mentioned that he has spoke to their lawyer about insurance, he has suggested to consult with an insurance broker that is familiar with this type of project. Accordingly, it was suggested to him to consider a wrapped around policy. This would allow every individual involved in the project to be allotted a certain amount of the cost.
Commissioner Cuellar joined the meeting.
Mrs.Salazar commented that although the work is very specific, any local firm could do.
Mr. Crain informed the judge that in very large projects the wrapped around policy is better all together.
Mrs. Salazar brief that base on the comments by Mr. Peden, he suggested the wrapped around policy, in their opinion what the county is requiring in the pool is $1 million is inadequate.
Commissioner Flores stated that $1 million is not enough, he questioned the judge if $10 million would be enough. Judge Garcia stipulated that it would be more than $10 million.
The court suggested to set up a workshop and ask Mr. Peden to be present.
Court took no action on Item.1.A. and B.
Court proceeded back to regular agenda Item.21.A.
