Discussion and consideration to draw down funds for MCO Pass Through Payment Pilot Program from the Local Provider Participation fund to be determined by HHSC instructions.
Mr. Carlos Zaffarini, Local Net Hospitals, commented on the methods they been having to set, related to the costs associated with the services provided to all medicaid patients or for those who can't afford to purchase insurance. Mr. Zaffarini stated that it has been challenging to do the work without touching tax payer money. Although, the LPPF helped, now they don't have a way to fully offset those costs as in the past. Claiming that they've worked over the last year to advocate on behalf of all the safety net providers in Texas, to developed a program that can be utilized in other states like California or Utah. The MCO Pass allows to use the LPPF dollars to access additional funding.
Mr. Zaffarini informed that they met with the governor and HHSC agreed to submit concept papers that would permit for the South Texas Pilot to move forward. Additionally, they made a formal request and CMS responded with an information bulletin. It stated that no new pass troughs could be created however, the only pass troughs that could be pursue were the ones in place and if there wasn't one as of July 6, 2016 they couldn't pursue a new one.
Overall, Mr. Zaffarini proposed sending a delegation representatives from each county to meet with the governor and staff.
Mr. Olivarez requested permission to draft a resolution for next agenda.

A. Public Hearing, at 10:30 am, to consider public comments concerning the amount of mandatory payments required to be paid by paying hospitals for fiscal year 2017 and how the revenue derived from those payments is to be spent.

Mr. Olivarez clarified that this item is not related to the hospital district. This is in relation to the Hidalgo Health Care Funding District, which was set up by Senate Bill 1623. Allowing to generate private funding from Hidalgo County's hospitals. Advising that two sessions ago, Starr County, Hidalgo County, Webb County and Cameron County, were the only counties allowed to do this through a private hospital sector. During that time Hidalgo County was allocated $829 million by the federal government for matching however, the county's tax base could not generate the $329 million of matching funds. Mr. Olivarez explained that The LPPF was created by legislature action into law. Thereon, allowing private hospitals to be able to contribute to the county in form of funds.
Commissioner Palacios requested Mr. Olivarez to provide information regarding uncompensated care funds. In relation, he explained that the range for uncompensated care funding in Hidalgo County can range from $112 million to $150 million. The LPPF assists with making up the uncompensated care component however, does not provide full coverage. As per Mr. Olivarez, the most important component of LPPF, is that it allows Hidalgo County and Region 5 to maximize a matching potential from the federal government. Mr. Olivarez accredited all the work done by Senator Juan "Chuy" Hinojosa and the South Texas Delegation.
Mr. Olivarez clarified that a person must apply for indigent care in Hidalgo County compose of about 21% of poverty level and about $6,000 per year for family. This is also for people with insurance that can't afford to pay after coverage.
Public member stated his position in favor of the program, stating that this program allows the hospitals to multiply their financial impact in the community. He assured that this does not require money from Hidalgo County.
Mr. Olivarez recommended the court to consider a 6% rate and an annual payment of $76.5 million dollars. Most of the hospitals pay for it at the beginning of the year and others later.

B. Consideration and possible approval of mandatory payment to be assessed quarterly by the Hidalgo County Health Care Funding District on the net patient revenue of an institutional health care provider and how the revenue derived from those payments is to be spent.
On motion by COMMISSIONER PCT. 1, A.C. CUELLAR, JR., seconded by COMMISSIONER PCT. 4, JOSEPH PALACIOS, the Court made a UNANIMOUS vote of approval.

C. Consideration and possible approval for the Hidalgo County Tax Assessor/Collector to collect the mandatory payment required by Hidalgo County Health Care Funding District.
On motion by COMMISSIONER PCT. 1, A.C. CUELLAR, JR., seconded by COMMISSIONER PCT. 4, JOSEPH PALACIOS, the Court made a UNANIMOUS vote of approval.

D. Consideration and approval to assess mandatory payment annual rate of 6%.
Commissioner Cantu questioned Mr. Olivarez in regards to an article published in the Monitor. According to the commissioner, the article claimed that Doctors Hospital at Renaissance alone was bringing in about $1.3 billion. The commissioner questioned if the $1.276 billion dollars was a new or old number. With regards Mr. Olivarez informed that the law states that the projected revenue to use in taxing was projected to start in 2010 and is subject to submit their revenues up to two times a year.
Mr. Olivarez clarified that $1.2 billion represents all hospitals.
Mr. Carlos Zaffirini explained their goal is to access the most out of uncompensated care however, are limited by the federal government and by the application given to Texas. According to Mr. Zaffirini, when the waiver started in 2012 they were able to access 95% of the uncompensated care. Now that they're at the end of the year of the initial waiver the dollars have dropped dramatically.

3) Fern McClaugherty spoke in regards to the tax foreclosures homes. According to Mrs. McClaugherty, people can't afford high taxes and therefore are losing their homes.
4) Norma Saldaña continued with the same statement, claiming that the health care district will increase healthcare costs. She claimed that the $25,000 homestead exemption passed by Senator Juan "Chuy" Hinojosa is an actual exemption amount of $3,000.
