NOTICE is hereby given in accordance with Chapter 551, Texas Government Code, that a SPECIAL MEETING of the Commissioners' Court will be held at the Edinburg Council Chambers 415 W. University Drive, Edinburg, Hidalgo County, Texas. Discussion and possible action relating to the following business will be transacted:

Discussion and action on Memorandum of Understanding between County of Hidalgo, City of Edinburg and Edinburg EDC regarding the development of and funding for a New Hidalgo County Courthouse.

Michael Leo updated the court in reference to the MOU between the Hidalgo County, the City of Edinburg and the Edinburg EDC for the development of the new courthouse. Leo stated that the city committed to contribute to the county the amount of equal or less than 20% of the overall project cost or $30 million dollars. He explained that the $30 million dollars have a cap, if the amount goes over they're still at $30 million however, if the costs go down, they're contribution goes down. Additionally, if the city decides to pay in full the payment from the city to the county, it will be due and shall be paid on or before 1 year from when the city obtains the debt and the county's closes issuance of the bonds.

Commissioner Cantu indicated that costs should be listed so that the city can see the county's potential costs. 

Mr. Leo clarified that Commissioner Palacios along with the MPO , are working on the off site improvements. The amount is of $20 million dollars which is not consider part of the contribution. 

Further, if the city pays over time, it will be $1.5 million over 30 years. These payments are due no later than December 2018 or when the county's payment is due. 

Additionally, the EEDC will be contributing the amount of $750,000.00 per year to the county, either way between the city and the EEDC it will be $1.5 million over 30 years. 

Judge Garcia mentioned that after adopting the MOU it will send to the city for their review, the MOU could be sent back for changes. Therefore, the judge stated that any motions made should be made to final legal review.

Mr. Steve Crain suggested approving subject to legal review.

2017 CSBG CAP Plan and Budget 
1.  Public hearing regarding the proposed 2017 CSBG Community Action Plan and Budget 

Mr. Jaime Longoria advised that they held an advisory council meeting on October 5.

Judge Garcia Opened the Public Hearing.

Richard Montezuga requested information regarding the grant and information on families who are below poverty. 

Mr. Longoria explained that the Block Gran Program purpose is to serve those below the 125% federal poverty levels. In Hidalgo County  this percentage is equal to 100,000 families. 

Again, Mr. Montezuga questioned the average population size. Longoria, stated that the census uses 3.4 equivalent to a almost 300,000 individuals.

Fern McClaugherty raised concerns over the block grant proposed budget salaries. 

Longoria clarified that there are no salary increases being proposed, except for the last two items due to the living wage policy set by the county. 

Judge Garcia Closed the Public Hearing.

Mrs. Salazar notified of the 10 minute time limit per presentation, excluding question and answer. 

1) Dannenbaum- Louis Jones, P.E. presented the Hidalgo County Courthouse team which is composed of five lead firms. Dannenbaum will be the lead firm holding the contract. Jones informed that they have a establish local office in the Valley for 16 years and have 200 employees working locally. 

Court recessed due to technical difficulties.

Court reopened. 


Louis Jones continued informing that the B2Z Engineering is the other firm working along with them. The firm has 9 years of local service and experience, also  DBE/HUD certified partner. MOCA, is another firm with has over 17 years of program project management experience. With experience on 10 multistory courthouses totaling $1.5 billion dollars. They too have a local office in McAllen, Texas since 2013. Additionally, Farnsworth Group, has 450 professionals with courthouse commissioning experts, with a regional office in San Antonio, Texas. Naylor Wentworth Lund Architects is the final firm working with the team of five. The firm has 64 years of experience, 23 years of multistory courthouse design and construction. 

Reza Badiozzamani, P.E. Dannenbaum, explained that the program was put together with qualified design, program and construction management and inspection professionals. Stating that they have over 200 license engineers available, project management professionals, registered architects amongst others. 

Badiozzamani introduced the rest of the team and their qualifications, informing that he will be serving as the community outreach client mgmt. 

Under major coordination and scheduling factors, the team will work closely with the other entities tied to the project. Badiozzamani indicated that the firm is actively working with L&G. Again, it was stated that Dennenbaum is actively working with L&G regarding the infrastructure projects, closure of 281, drainage improvements, integration into master program schedule and roadway improvements. Regarding this project, Badiozzamani assured that they will work the L&G to accelerate the project. 

MOCA, Chad Jones, CCM, LEED AP, assured they manage millions of dollars courthouse projects. Presenting 10 projects related to courthouse experience, including restoration to the Bexar County County Courthouse, San Antonio, Texas. the Houstion Justice center, and Federal Courthouse in Salt Lake City, UT., U. S. Courthouse in Austin, TX. among others. 

Commissioner Cantu questioned as to what the firm's plan will be to help keep costs down and the M&O expenses down. The representative stated that making sure the structure is accurate, making sure the CMR builds the project according to specs. Operation and maintenance costs will be essential. 

Dennis Yates with Farnsworth Group, explained that commissioning is a process that affects the way the building is going to performed, versus the way the county wants it to performed. Taking into consideration temperature and its effect on the entire building. Yates, explained that it is equally important to account for having the right training for maintenance and operating. Detailing that projects that are commissioned save an average of 15% every year in energy savings than those who are not. Chad Jones added that another saving strategies is to first line up and get everything going the right direction, once its done, its a matter of cost control. 

Commissioner Palacios asked if the firm could forecast any situations that could help with the overall costs. Jones assured that they'll make sure the building has the best foundation, due to the flooding in the area. 

Robert Macheska with L&G Engineering, informed commissioner Cantu that no other project manager firm has contacted them regarding the road projects or the closure of US 281.

Louis Jones explained to the judge that they've never been involved in the construction of a courthouse however, this is the reason they put these team together. Jones assured the judge that they have the local experience and will make sure they comply with the schedule time and stay under budget. In addition, Badiozzamani ensured that they always make sure they have specific qualified people with the needed expertise. 

Mr. J.D. Garcia, MOCA, will lead the field inspection during construction. He informed of the recent 10 story building in Alabama.
Sergey Akhpatelov disclosed that he has courthouse experience and federal courthouses experience as well. He emphasized on the experience he possess working with judges, state holders, U.S. Marshals, and has the capability of delivering a successful project. 

Mr. Garcia restated that his working experience has been in California, Texas and Louisiana. In Louisiana, he worked on vertical legs for oil field rigs and skyscrapers in California, moving his way up from iron worker to quality control. Mr. Garcia informed that he was project manager in the recent completed project in Alabama. 

Jones-MOCA is part of the team because they specialize on construction legs and field inspection in courthouses, and are currently working on a courthouse project in Houston, Texas. Chad Jones added that they understand the county's accountability to the public as a governmental entity and its duty to protect the people inside the courthouse. 

Richard Seitz informed that he has the experience here, as he has built two high rise buildings in South Padre Island. Worked on the four story building police station in Dallas, Texas. Seitz reiterated that he has high rise experience. 

2) Hill International, Robert Ferguson introduced the team composed by S&B Infrastructure and Foster CM Group.

Ferguson mentioned to the court that they have the experience of 150 courthouses, criminal justice facilities and jails which equals to $5 billion dollars worth of work. This is not accounting for recent projects awarded to the firm.

As part of the management philosophy, capture and memorialize program goals is essential to understand the first step, what the project is and its values and schedule. Another key component stated was the project controls, this includes overseeing cost control, budget, change order management and schedule oversight. Along with it, there's mitigate risks that identifies and assess and respond control contracts and insurance. Every project done is started as risk register, all the way to the occupancy of the building. Again, he stated that they mitigate risks along the project. Mr. Ferguson assured that accountability is essential and only meant to move forward and make sure items are met by a certain day. Manage to an expected results is tied to set realistic milestones and meet them efficiently. The communication process is crucial, assuring the court members that they understand that this a county project were the public will involved throughout the process and will keep people inform and communicate all the way to the end. 

Ferguson informed that they've completed the county jail renovation in Dallas, Texas. Furthermore, the firm encouraged the court members to contact constituents they have worked with and provided their information for any references. 

Commissioner Palacios questioned if there's anything that they can foresee as cost control. In relation, Ferguson stated that parking lot is one area, as they do not know what's underneath. Historically, the best way to control costs is to identify contingencies during construction to the overall budget. Stating that one of the difficult parts during this project will be to find out what's underneath, once this is tackled they can start with steel and concrete. Ferguson indicated that he would get a contractor on board as soon as possible and let them bring them utility and structure subs to work with the architects. 

Daniel Rios stated that the planning of the design is very important to finish the drainage. In terms of the MPO Project, Mr. Rios informed Commissioner Cantu that there's projects in place but not to the extent of looking at the analysis. Stating that the biggest schedule impact will be getting approval by TxDOT to close US 281. 

Again, Ferguson emphasized their understanding of the project and the importance of accountability to the public.

It was informed to the judge that Harvey Mitchell and Erik Christensen will be the onsite personnel. 

3) JLL, John P. Roberts, Project Executive, presented the professional qualifications project management standard operating procedures. The list ranged from organize decision making, manage stakeholders, control schedule, mange budget, design, contain costs, control quality and facilitate communication. The first professional qualifications is the effective time management and budget control; having in consideration program goals, team members responsibilities and effective procurement and focus. 

Combined the team has 225 years of project management experience of this type. With affiliation to the several institutes and 100% of the team holds an undergraduate/graduate degree in architecture, construction, construction management or engineering.

Courthouse experience includes Fort Bend County Justice Center, Richmond TX. 
Program management experience includes the Conroe Center, Classroom Building, University Park Science Building and Process Technology Center, Stafford New Workforce Building, The West Houston Institute Northwest College, CTE High School and Early College High School.

In addition the firm introduced the understanding of the project and the five-phase process that will ensure the team navigates each stage of the county courthouse project, from initiation to closing. According to the plan, this will allow them to know who in the local community is capable of delivering the best performance and skills. 

Sundaresh Kamath, Project Director for the project notified that he has experience in program management and project management. Has worked in the public side and managed large bond programs, stating that he has reviewed all the schematic design provided to them and understands the challenges, including the closing of US 281. They are ready to explore and fully understand the ramifications of closure of Business 281 and the challenges of water, sewer, gas, fiber, electric, cable and the scheduling and costs. Stating that they are ready to work with the Hidalgo County Drainage District and the MPO, and City of Edinburg. 

Commissioner Cantu questioned the courthouse experience and requested to list them. With regards, Roberts restated that the Ellis County Bond Program is part of their courthouse experience, along with the Federal Courts Reinvestment Project in Los Angeles & Los Fresno, CA.

Joe O'Con will be present daily during construction and Mr. Kamath will run the project from start to finish 100% committed to the project. 

O'Con disclosed that he has been doing this type of work for over 36 years. He was the construction inspector for the first three major projects he worked for. 

Judge Garcia questioned the difference between program manager and construction manager. Roberts explained that in industry terms, program manger organizes other program managers that have day to day responsibilities dealing with the day to day administrative level, handling reports. A construction manger gives the level in which the architect and the contract are dealt with. Program manger has the day to day responsibility of the architect. 

4) Jacobs, Alvaro Rizo-Patron presented himself as the project executive for the Hidalgo County Courthouse Project. Rizo-Patron stated that they've worked with HDR and HOK before for multiple projects. The program manager will be Jonathan Jordan, Construction manager Brian McIntyre and Oscar Garcia as the RGV community liaison. 

The presenter informed that JACOBS has experience in 57 federal courthouses and 23 county courthouses. According to Patron, 10 projects were listed on the proposal but 4 projects were selected to present. The Hipolito Garcia U.S. Post Office and Court House in San Antonio, TX. was a significant project due to the location of it. Albert Armendariz Sr., U.S. Courthouse in El Paso, TX was presented to demonstrate to the court that the firm is capable of working along the border. The Denver Justice Center Complex in Denver, CO. was presented because of its similarities to the program and the ILA and historical downtown area. The fourth project presented was the Alto Lee Adams, Sr. U.S. Courthouse in Fort Pierce, FL. selected because Jonathan Jordan worked on that project. 

Jordan introduced himself as the main point of contact for this project and main person to deal with for the day to day responsibilities. Indicating that he has 35 years of experience in the field and is a certified construction manager. The total cost of ownership looked at the recurring cost and what's underneath the surface. The firm presented the Owner Controlled Insurance Program (OCIP) as part of the process where money can be save. 

Oscar Garcia, Principal for Jacobs in the RGV and potential community liaison of this project explained that (OCIP) removes the barrier entry for local firms to participate. This allows local firms to participate in this type of magnitude projects. 

Commissioner Palacios questioned the firm's familiarity with the current stage of the project and all variables related to the project, including what their ideas are for cost savings. Patron assured the understanding of the budget as that's what the community agreed on. Jonathan Jordan indicated that they evaluate design and costs, looking at alternatives for reasonable costs. Jordan assured the judge that he will be present all the way and involved in any coordination between the City of Edinburg and the county. 

5) Braoaddus & Project Control-Dcik McNary with Project Control introduced the team composed of Broaddus & Associates with 16 years in the Valley, Project Control has been in business for 39 years, Fentress Architects, AD Vertir and Raba Kistner. McNary informed that Fentress Architects analyze courthouse design, operation cost design and evaluate 50 year costs. 

Project control will provide five people with three full time onsite. Additionally, McNary emphasized that they do not built buildings, their only business is program management. 

Gilbert Gallegos architect with Broaddus & Associates, reminded the court that they were involved in the Edinburg Downtown rehabilitation plan. He disclosed that they are working with L&G with issues related to the drainage, also are working with the state as to the closure of old U.S. Business 83. Owner insite is another tool use for projects strictly design for owners. Gallegos assured they are courthouse experts, they account with national, state and local experience, most recent county courthouse is in Hays County. Again, restating that program management is their only business.

Once more, Commissioner Palacios asked the firm with regards to any potential cost control. Gallegos stated that drainage issues is taken into consideration, as well as civil part and infrastructure as these can sneak in terms of costs. Further, stating that they not only manage construction but total project budget. 

Gallegos informed Commissioner Cantu that he will be the program executive as he is more of the area manager for South Texas. He further disclosed that according to the current square footage for the courthouse, the price will be about $300 per sq ft. The firm is currently working with HOK and has worked with HDR. Regarding the pricing, Commissioner Cantu questioned why the cost of $300 per sq ft. as compared to other similar buildings of similar size. McNary stated that the price has to do with the structure and materials that need to stand for the future. Additionally, disclosing that he has not seen any overly design items on this project. 

Commissioner Cuellar disclosed his desire to wait on the ranking to obtain more information. Commissioner Cantu stated that he was ready to take action. On the other hand, Judge Garcia also recommended waiting.

Mr. Guerra advised that a meeting could be set up for next week for this single item.

Opal Billman claimed that due to the divorce case she has been in false imprisonment for over 20 years, connected with arrests and threats. Stating that she has complaint to the secretary of state and attorney general, district attorney but claim its not their job.
