NOTICE is hereby given in accordance with Chapter 551, Texas Government Code, that a SPECIAL MEETING of the Commissioners' Court will be held at the Edinburg Council Chambers 415 W. Discussion of the upcoming 85th Legislative Session.
Bobby Villarreal informed that they've sent out any request from departments regarding any issues they have for the upcoming session. The notification is due to the challenges the state is currently facing as a result of the low oil revenues. Villarreal stated that the sales tax from the contour will be about 1.3% lower than projected, oil production about 7.6% less than projected. Additionally, notifying that they have $10 billion in the rainy fund. As stated by Villarreal, all agencies have been asked to cut the budget by 4% for the exception of CPS, Medicaid, Public Schools and DPS for border security. At the moment DPS is asking for $300 million for border security reasons.
Villarreal advised that they've met with Senator Hinojosa, the district attorney and the sheriff with regards to an issue called "blue warrants" essential for people who are in jail waiting to be persecuted by the state. The potential "blue warrants" could reduce the time people are on hold due to the daily cost the county has to render.
Moreover, Villarreal notified of a possible amendment to the existent legislation for the courthouse filing assessment fee.
In addition, the health department is seeking for more funding for zika and tuberculosis. They are also meeting with planning regarding subdivision rules.
Villarreal disclosed that they have a proposal by Senator Eddie Lucio about solid waste, essentially similar to the colonia lighting program. However, the legislation will allow the county to do it but will not explained how to do it.
Another issue, is the designation of colonias, as requested by the secretary of state.
Commissioner Cantu petitioned amendments to the health care district legislation. Stating that he and Armando Garza prepared some amendments based on what they have heard during the election process.
Valde Guerra requested looking into the issue of stray animals and how to better address the problem in the municipality. Guerra reminded the court that these animals were someone's pet at one point, therefore the need to be educate the community the importance of having pets spay, neuter and vaccinated. With regards, Commissioner Palacios added that he would like to see the county and cities take a more active role to figure out the issue.

Rick Avery stated that The Texas Association of Counties recognizes the effectiveness and efficiency of county government. As such, The County Best Practices Award Program has been presented to Hidalgo County for the "Executive Office Vehicle GPS Program".

Treviño extended acknowledgement to the entire court for authorizing the program, including the assistance of Valde Guerra in the development.

According to Steve Crain, there's an understanding between the county and the Linn-San Manuel fire department to occupy a portion of the building. San Manuel pays a certain amount to the county to occupy that portion, currently there're issues regarding the utility expenses. As stated by Crain, back when the agreement was set, all utilities expenses were included in the annual amount.
Mr. Guerra questioned Crain as to whether or not there was a need to take action regarding amending agreement or clarification. With regards, Crain settled that there was no need for action.
Mr. Guerra notified that there're pending utilities that need to be process and doe not want to interrupt any services at the facility.
Letty Chavez from the auditor's office stated that she wasn't familiar with the issue.
Guerra restated that the issue has been clarified by the court and will be contacting the auditor's office to process any payments.
Commissioner Cuellar stepped away from the meeting.
Commissioner Palacios stressed the importance of having the building function property as it also serves as center for DPS and Border Patrol.

Raul Silguero informed that Judge Garcia requested an update on the Grade and Step process.
Silguero stated that the classification of positions has been most time consuming but will allow to place employees in the right grade. About 166 positions have been created, the positions listed in the position inventory list highlighted in yellow are positions that are in the salary schedule but are still pending classification grade. The other positions marked in blue are classified but are being compare to other counties market value. Silguero informed that they are about 90% done classifying the positions.
When referring to costs, Silguero mentioned that this is for salaries that have been given to employees outside of the classification plan and don't match with the step and grade. Therefore, to place employees in the correct step, there might associating cost because they are in between steps and the salary is not at the correct step . He emphasized that there's no need to increase salaries due to the implementation. Silguero indicated that 1,007 positions are in the right step and 1,700 positions will require adjustments. However, if salary adjustment does happen, 100 positions will require an increase of $2,500 and 132 positions are outside the last step. Silguero reported that there are 21 grades, each grade is 8.5% differential between grades. There's 11 steps at 3.5% each step, and 2 grade intervals between career ladder positions. Additionally, there are 488 positions in the salary schedule which the court approved during the budget process. There's going to be 2,716 classified positions for the exception of certain ones. Additionally, there are 1,990 positions already classified in the county and 588 positions already classified in the sheriff's office and 138 in the constable's office. On the other hand, non-classified are court reporters, juvenile probation and the TX Agrilife Extension. Other exemptions include 42 elected officials and 2 appointed officials, one being the county auditor and the elections administrator.

In reference to the grade and step salary schedule table, Silguero explained that those highlighted in yellow at step 1 are at market value for the step and the grade. Those marked from step 2 to step 11 are intended to provide the court the opportunity to reward the employee for performance and experience. Nevertheless, due to the county's minimum wage of $12.00 there are some variations the table is also subject to change if there is a future COLA.
Furthermore, any person who gets promoted will be placed in a step that's at least 3.5% or step 1 of the new grade, which ever one is less.
Commissioner Flores questioned if there was going to be any costs to the county. In regards, Mr. Silguero stated that it will be up to the court.
Silguero assured Commissioner Cantu that they'll have the discretion to say they don't want any costs.
What's more, Silguero suggested keeping the 1,7000 employees who are in between steps at the current salary. According to Silguero, these positions will be corrected when they get promoted to a new job at a higher pay. However, once that position is vacant it has to go back to step 1, allowing it to be self corrected. If they don't allow the system to correct itself, it will cost about $500,000 therefore, Silguero implied that the system can self correct at no cost.

One of the changes affecting the county will be the changes to the salary test regarding the FLSA exemption. The previous salary level test used to be set at $23,660 however, it has double at $47,476 as far as annual salary to be classified at exempt. Currently, the county has 30 employees classified as exempt, however effective December 1, 2016 those employees will be none-exempt. No fiscal impact is project to county. These employees will be able to punch in and out and accumulate compensatory time.

McClaugherty stated that this bill was created by Senator Chuy Hinojosa and Eddie Lucio in 2014 later, two bills were written by Senator Hinojosa and Representative Bobby Guerra. Claiming that these two bills have been introduced under other titles.
2) Opal Billman stated that due to the unfair result of the petition for divorce in 1996, all her community property has been taken away. Additionally, being suppressed to unfair imprisonment.
3) Pedro Ayala updated the court regarding the historic architecture and preservation of urban organization in the communities. Mr. Ayala invited the court to the upcoming event be held at the Echo Hotel in Edinburg, set for November 28.
