Discussion, consideration and action on Resolution for the creation of new District Court(s)

Valde Guerra read out the data and resolution in support of the creation of new the District Court(s).

On motion by COMMISSIONER PCT. 3, JOE M. FLORES, seconded by COMMISSIONER PCT. 2, EDUARDO “EDDIE” CANTU, the Court made a UNANIMOUS vote of approval.

Vote: 5 - 0 - Unanimously

Judge Garcia informed that this will create an additional district court and the propose date to take effect is January 20, 2021.

Honorable Judge Mario Ramirez spoke in favor of the creation of the new District Court. Although, they have the votes they will wait to have room in the courthouse. 

Jim Barnes a City of Mission resident and member of the O.W.L.S. disclosed concerns over the data presented to approve the new district court. He questioned the assumptions of the data between Hidalgo County and other counties in the state. Questioning if the working days and hours from other counties were the same to Hidalgo County. 

Fern McClaugherty assured that there is no need for a new court, because courtrooms are usually empty. She claimed that on Tuesday's and Thursday's afternoon the courtrooms are usually empty and specially on a Friday.

Judge Ramirez stated that he is usually found at the court on Friday, because usually restraining orders are brought to him that day. Monday's are the busiest because judges set trials mostly on that day.

Status update on New Hidalgo County Courthouse project

Judge Garcia explained that he petitioned this item to be place on the agenda because it is important to update the residents of the progress of the construction of the new courthouse. However, a report he was expecting to present was not completed on time. 

Commissioner Cantu joined the meeting.

Commissioner Palacios commented that meetings have been conducted with the effort to provide transparency regarding courthouse negotiations. According to the commissioner, no negotiation was reached, but were able to get to the scope of services with no agreement. As to the comments made regarding confidentiality, Commissioner Palacios disclosed that they agreed to hold that meeting in a public setting because the court is committed to negotiated in the best interest of the tax payer. 

Commissioner Fuentes stepped away from the meeting.

Commissioners Court along with Criminal District Attorney Ricardo Rodriguez, Jr. and Sheriff J.E. "Eddie" Guerra recognized the importance of this year's awareness campaign theme "Engaging New Voices". The court declared April 2017 as Sexual Awareness Month and encouraged the community to speak up against sexual violence.

On motion by COMMISSIONER PCT. 1, DAVID FUENTES, seconded by COMMISSIONER PCT. 4, JOSEPH PALACIOS, the Court made a UNANIMOUS vote of approval.

Requesting approval to accept the Interlocal Cooperation Agreement between UTRGV and the County of Hidalgo. The purpose of the Interlocal is to engage and empower community residents to engage in behaviors and make changes that improve individual and population health and provide interprofessional experience for the UTRGV students involved.

Eddie Olivarez informed this is the program they have been waiting for over 2 years, they will work with the CRC centers. This will allow medical students and residents to interact with the county.

1.  Discussion and presentation of the proposed Uniform Hospital Rate Increase Program (UHRIP).

Eduardo Olivarez explained that this is item was related to last week's presentation by Carlos Zaffirini regarding the allowance by the Center for Medicare and Medicaid Services (CMS) and the Texas Health and Human Services Commission (HHSC) at the state level. They are proposing a plan to allow a wait change for Medicaid services in relation to the hospital component and LPPF, subject to approval by the state.

Carlos Zaffirini informed they made a proposal to the Texas Health and Human Services Commission (HHSC) in regards to what would work for Hidalgo County and the whole region. Other counties are trying to replicate what Hidalgo County has been able to do. 

Olivarez reminded the court that the Local Provider Participation Fund (LPPF) started with SB 1623 which allowed private hospitals to be able to contribute into the (LPPF). 

2.  Discussion, consideration and approval to draw down funds for the Uniform Hospital Rate Increase Program in the amount to be determined by HHSC instructions from the Local Provider Participation Fund (LPPF) with a transfer date of May 1. 2017.

Steve Crain questioned if this item should be "subject to CMS approval". With regards, Olivarez said that at that time they were expecting to have the final approval. Zaffirini stated that at least the state has adopted the rules and they can depend on that. Olivarez explained that the action would be based on state instructions and action. Zaffirini added that they warned the state not to do this, and thinks that they made a mistake. For whatever reason they only submitted the initial request for El Paso and Bexar, even though they have been asking since months. However, the state gave them a deadline of May 5, to fund the IGT.

Carlos Zaffirini affirmed the judge that this does not use one dollar from the ad valorem tax and  there's not county tax involved in this. 

Olivarez informed that all this will be forwarded to the auditor's office.

Again, Crain suggested approving subject to CMS approval. However, Zaffirini noted that the state is depending on the relationship with the Medicaid agency. He suggested the court to trust and follow the state's lead on this, and follow the current state rules in place now. Since there are no ad valorem tax involved, it is a risk of the LPPF. If the Center for Medicare and Medicaid Services (CMS) is reject it, the funds will go back into the LPPF and there wouldn't be any risk of lost funds to the county. Therefore, Zaffirini petitioned the court to not approve the item "subject to".

3.  Approval of Certification of Revenues as certified by the County Auditor from the Local Provider Participation Fund in the amount to be determined by HHSC instructions.

Data was sent to the auditor's office.

4.  Approval of 2017 appropriations of funds from the LPPF in the amount to be determined by HHSC.

Discussion and approval to amend the Hidalgo County Health Care Funding District Rules and Procedures.

Mr. Olivarez explained that because this is a new level of funding available to the county, they have to amend the rules to allow it.

Ramon explained tha the law does not allow the county to profit, they recuperate the charges when running city or school elections. They wait for third party vendors in order to charge what the county gets charged; and fees prorated are according to the number of actual voters.

Norma Saldaña recognized the great work that the Weslaco Boot Camp has been able to provide to the juveniles. She also acknowledged all the support provided by Judge Renee Betancourt to the camp. Saldaña petitioned the court to keep supporting the camp, she informed that the camp needs uniforms, they only have one industrial washer and dryer and might need new bedding.
