SPECIAL MEETING - August 8, 2017

BE IT REMEMBERED, that on this 8th day of August A.D., 2017, there was begun and held a SPECIAL MEETING of the Honorable Commissioners’ Court of Hidalgo County, Texas, wherein the following members thereof were present, to-wit:

NOTICE is hereby given in accordance with Chapter 551, Texas Government Code, that a SPECIAL MEETING of the Drainage District #1 Board of Directors will be held at the Edinburg Council Chambers 415 W. University Drive, Edinburg, Hidalgo County, Texas. Discussion and possible action relating to the following business will be transacted:

Roll Call

Board Member Joe M. Flores and Board Member Eduardo "Eddie" Cantu were not present during roll call.

The Board of Directors recessed at 9:30 a.m.

The Board of Directors reconvened at 9:32 a.m.

Raul Sesin led the courtroom in Prayer.

Open Forum

Approval of Consent Agenda

The board moved to approve the entire consent agenda.

Discussion on Hidalgo County Drainage District No.1 projects, maintenance and operations:
A.) Edinburg Stub Control Structure

Sesin informed that this project is part of the listed bond projects, completed in 2015 at a price of $242,870. The system will manage water coming from North West Edinburg and part of McAllen. 

B.) Alamo Lateral Control Structure

This project was also identify as a bond project, originally, there was an engineer assigned to the project but the district has taken control. They already have evaluations needed to start the design plans for construction. Sesin is hopeful they'll put the project up for bids by the end of the year. This system serves precincts 1, 2, and 4.

C.) South Floodwater Channel

The drainage director notified that this project was identified in 2012 and is fully complete. The project was a partnership with Urban County. According to Sesin, the district funded the levy improvements and the box installation, and pump structure, with an invested amount of $598,000.

D.) HCDD1 Website

Sesin let the public know that their website went live on July 5, 2017.

A.) Requesting approval of FEMA Project Worksheet No. 00595 as it relates to Emergency Protective Measures (Pumping Operations) for May & June 2015 rain event and approval for District General Manager or his designee to execute.

On motion by BOARD MEMBER PCT. 1, DAVID FUENTES, seconded by BOARD MEMBER PCT. 4, JOSEPH PALACIOS, the Board made a UNANIMOUS vote of approval.

B.) Requesting approval of FEMA Project Worksheet No. 01528 as it relates to repairs of crossings for Hoehn Rd and Terry Rd. during the May & June 2015 rain events and approval for District General Manager or his designee to execute.

On motion by BOARD MEMBER PCT. 1, DAVID FUENTES, seconded by BOARD MEMBER PCT. 4, JOSEPH PALACIOS, the Board made a UNANIMOUS vote of approval.

A) Requesting acceptance and approval of Donation Deed from San Juanita Alonzo 15.0' Drainage easement of Lot 41 as it relates to Colonia Lucero Del Norte Drainage Project.

On motion by BOARD MEMBER PCT. 1, DAVID FUENTES, seconded by BOARD MEMBER PCT. 4, JOSEPH PALACIOS, the Board made a UNANIMOUS vote of approval.

B) Requesting acceptance and approval of Donation Deed from Mario Gomez and Ruben Gomez 15.0' Drainage easement of Lot 47 as it relates to Colonia Lucero Del Norte Drainage Project.

On motion by BOARD MEMBER PCT. 1, DAVID FUENTES, seconded by BOARD MEMBER PCT. 4, JOSEPH PALACIOS, the Board made a UNANIMOUS vote of approval.

These two easements will help move along the Lucero Del Norte project.

Requesting approval to declare surplus the listed items in the herein attached Exhibit "A" (including i.e. vehicle units, heavy equipment, Tractors/Shredders, General Miscellaneous Property) for the purpose of sale through auction [scheduled for September 6, 2017] in accordance with Texas Local Government Code 263.152 (a)(1);

On motion by BOARD MEMBER PCT. 1, DAVID FUENTES, seconded by BOARD MEMBER PCT. 4, JOSEPH PALACIOS, the Board made a UNANIMOUS vote of approval.

B. Requesting authority to publish advertisements for the Auction of Surplus Items schedule to be held on September 6, 2017.

On motion by BOARD MEMBER PCT. 1, DAVID FUENTES, seconded by BOARD MEMBER PCT. 4, JOSEPH PALACIOS, the Board made a UNANIMOUS vote of approval.

C. Requesting authority to remove assets listed on Exhibit "A" (attached hereto) from the Hidalgo County Drainage District No. 1 inventory list after finalizing the auction sale; AND, in the event "NO BIDS" received:


D. Pursuant to Texas Local Government Code, 263.151(1) and/or 263.152(a)(3), Board of Directors proceed to:'...order any of the property on Exhibit "A" (attached hereto) to be destroyed or otherwise disposed of as worthless in as much as the Board of Directors undertook to sell said items at auction on  September 06, 2017, resulted in no bids received.

On motion by BOARD MEMBER PCT. 1, DAVID FUENTES, seconded by BOARD MEMBER PCT. 4, JOSEPH PALACIOS, the Board made a UNANIMOUS vote of approval on Item.8.C. and D.

Requesting approval to declare Surplus Fill Dirt from the following two locations in as much as  an attempt was made through a Request for Sealed Bids  for the Sale, Removal and Hauling of Fill Dirt/Loose Materials, advertised for (2) weeks and No bids were  received.  
  • Location 1:  South Main Drain East of FM 493.  Approximately 179,060 cubic yards.  
  • Location 2:  Peñitas Drain -From US Expressway 83 to Canal Crossing located 2,809 LF North  (STA 15 + 77 to STA 43 + 86).  Approximately 87,398 cubic yards.
On motion by BOARD MEMBER PCT. 1, DAVID FUENTES, seconded by BOARD MEMBER PCT. 4, JOSEPH PALACIOS, the Board made a UNANIMOUS vote of approval.

This is a project in central part of precinct 4, which has improved the flowing system between Kenyon Rd & Mile 17 and Mile 18.

Raul Sesin explained that the Work Authorization is decreasing the amount by $46,497.25 from the original work authorization. This is also a reimbursable effort thorough the interlocal agreement with the RMA.
