NOTICE is hereby given in accordance with Chapter 551, Texas Government Code, that a SPECIAL MEETING of the Commissioners' Court will be held at the Edinburg Council Chambers 415 W. University Drive, Edinburg, Hidalgo County, Texas. Discussion and possible action relating to the following business will be transacted:

Update on the upcoming launch of the e-Library program. 

Hidalgo County Library System Board Secretary Arnold Becho thanked the court for taking action on helping the community become more educated. Implementation has been completed and at the moment they are working on marketing through social media. The kick off event will be August 31, 2017 in the commissioners court room at 11:00 a.m.

Discussion and approval of Resolution opposing Senate Bill 4

Court proceeded to Item.29.

1) Ramona Casas from ARISE and La Red de Voces Unidas del Valle, stated that Senate Bill 4 will affect the lives of many families. She presented a list of cities, counties and law enforcement departments that have unite against SB 4. Casas petitioned the support and approval to oppose SB4 and support to avoid implementation of this law. 

2) Ana Maria Gonzalez claimed that SB 4 will affect the community because it will cause fear among families to attend work, school and will discourage children from education and improving their lives. 

3) Dr. Kevin Peek Economics Professor at STC spoke in regards to the economic impact that will occur through the implementation of SB 4. According to Dr. Peek, there will be dislocation of the economic market since 8.5% of the workforce in Texas consist of undocumented workers. If this percentage is remove, industries will be affected, as well as agri demand for all the goods and services utilize by society. Again, first consequence will be labor dislocation with about 165,000 and 245,000 peoplelosing jobs with negative effects. Second, there will be reduction in the agri demand, and third will be reduction of gross domestic product with a negative ripple effect in the economy. Additionally, Dr. Peek argue that they'll see reduce tax revenues flowing through the government because of significant unemployment. Also, companies will produce fewer goods and a reduction in corporate income tax will be seen. Therefore, as a consequence of reduction of agri demand, they also have projected $13.8 billion reduction in tax just for the first year. 

4) Pastor Jose Rene Angel from Resurrection Catholic Church related to the court that Jesus was the first illegal in history. The priest advocated saying that most people are running away from violence, poverty and are not vandals. According to Priest Angel, crossing without papers is not a criminal act. He also pointed out that Europeans are also illegals when they came first came here many years ago. 

5) Dr. Mike Seifert on behalf of Dr. Marsha Griffin a pediatrician in Brownsville, Texas. Conversed to the court that for the last 10 years she has been taking care of the some of the poorest children in the state. Most of the children are citizens of the United States however, in cases many cases family members do not have papers. According to Dr. Griffin, in the past the border was filled with people crossing to enjoy family and friends on this side of the border, but now things are different. She also emphasized in the importance of being able to trust the police and report on violence. 

6) Amber Arriaga Salinas from Proyecto Azteca and on behalf of Executive Director Ann Cass, claimed that SB 4 has increase the fear and anxiety within the community. They receive word from different partners claiming that children are afraid to go to school and parents are afraid to take them. Federal qualified clinics are losing patients and people are even afraid to go to the grocery store. As anxiety is increasing, the health of the community is deteriorating and business are losing money. Additionally, they are also afraid of the upcoming census count, because people are afraid to answer the door.

7) Pastor Dino Tuttle reminded the court of the Trail of Tears from 1836 and stressed that they do not want to see anymore children crying for their parents or teenagers without parents.

8) Myrium Zepeda commented that although, she supports LUPE and LULAC, she does not condone the fear that they're installing within the illegal community who do not understand SB 4. According to Zepeda, the organizations have spread rumors about "driving while brown". She further claimed that the majority of the people present at the court have not even red the bill and do not understand that they do have protection. Zepeda noted that SB 4 does not mandate for police officers to ask for legal status. 

9) Fern McClaugherty said that she always shows her drivers license when stopped, as it is part of following the law.  

10) Norma Aldape expressed her position against SB 4 and petitioned the court to oppose it. 

On motion by COMMISSIONER PCT. 2, EDUARDO “EDDIE” CANTU, seconded by COMMISSIONER PCT. 4, JOSEPH PALACIOS, the Court made a UNANIMOUS vote of approval.

1. Discussion, consideration, and action on Order creating Precinct 5 Justice of the Peace Place 1, and Precinct 5 Constable.

Robert Escobar, City of Elsa Councilmember along with La Villa, Elsa, Delta and Monte Alto representatives disclosed concerns over their population and the services they provide. Escobar stated that their local police department can not cover most areas because they are growing and need assistance and help. Although, the sheriff has committed to help and they do their best, it takes about 45 minutes to get there. 

Virginio Gonzalez Mayor for City of Edcouch requested a fair share of services to serve 40,000 residents. The mayor alleged that precinct 1 justice of the peace is having a hard time covering all the area. 

Jesse Peña Vice President of Edcouch-Elsa School Board disclosed that they are one of the largest area, and they have one of the highest voter turn out. Peña said they are looking to have their own identity, because geographically they area big area. 

Fern McClaugherty questioned the presence of constable precinct 1 during the meeting. She asked if they were going to cut the salaries of the justice of the peace precinct 1 and the constable's if they they cut their job in half.  McClaugherty noted that the constable working in the area where she lives has not been able to find the person who stole from her property. She further claimed that Hargill belongs in precinct 4.

Judge Garcia read a letter received from Ray McClaugherty. 

Commissioner Palacios commented that when this item was first brought to be dissolved, he was a newly elected official. Since then, losing the justice center has been one of the major issues. The commissioner noted that this is the second year they have a balance budget and are reducing the tax rate this year. He noted that the population is growing and there are profound issues relevant enough to consider. 

Commissioner Cantu questioned the establishment of precinct 5 and the amount of employees it will require to maintain.

According to Sergio Cruz, as per the proposal submitted, this precinct is supposed to be a different size. Right now, precinct 1 has an approximate budget of $1.2 million, precinct 2 constable approximately has the same budget, and precincts 3 and 4 have about $1.4 million. One of the scenarios for this new precinct would be to have 4 positions, 1 constable and 3 deputies, with 1 deputiy being reassigned from precinct 1. Scenario two, would be reassigning 2 deputies from precinct 1. Constable precinct 5 would have an approximate operating budget of $276,000 
with approximately $200,000 coming from precinct 1to precinct 5.

Cruz, noted to the court that they'll have to establish a justice of the peace office, with a cost amount of $335,000 per year. It was stated that the other jp's have a budget of about $450,000 to about $500,000. For justice of the peace precinct 5, they are looking at about 4 employees including the justice of the peace. The other justice of the peace offices have about 8 employees including the jp. 

Commissioner Palacios underlined that it is critical to have a justice center. 

Commissioner Fuentes pointed out that the community of Hargill does not have any elected officials other than school members. 

Judge Garcia remarked that they exist to provide services to residents of the county. The Delta area is a very unique area of the county and they had those services for over 100 years before they acted as they did a few years ago. As per the judge, there are about 40 elected officials united in favor of this request. 

Steve Crain advise the court to wait to take action until 12:15 p.m.

2. Discussion and approval of recommended changes to Justice of the Peace and Constable Precinct boundaries under Article 3, Section 18 of the Texas Constitution due to the creation of Precinct 5 Justice of the Peace, Place 1, and Precinct 5 Constable.

Pablo "Paul" Villarreal presented the 2017 planning calendar.

3. Discussion of 2017 tax rates

Villarreal informed that the benchmark 2017 effective tax rate is $0.5925 last year's tax rate was $0.5900 and this year's rollback tax rate is $0.6295

The tax assessor explained that as long as they can adopt a tax rate less than $0.5925 they do not have to have public hearings. 

Judge Garcia announced that they are proposing a tax rate of $0.58 

Villarreal stated that if that's the case, they do not have to have those two public hearings. 

Commissioner Fuentes joined the meeting.

4. Record vote on proposed 2017 tax rate and schedule two (2) public hearings if proposed tax rate exceeds the lower of the effective or rollback rates.

On motion by COMMISSIONER PCT. 4, JOSEPH PALACIOS, seconded by COMMISSIONER PCT. 2, EDUARDO “EDDIE” CANTU, the Court made a UNANIMOUS vote of approval on the proposed tax rate of $0.58

Longoria reminded the court that they received $300,000 grant from the Texas Veterans Commission to serve veterans in Hidalgo County. They served approximately 350 veterans at $600.00 per veteran for a total of $270,000 

The monitor report from May, indicates that at the time they were monitored they were at 122% of performance in terms of identifying and serving veterans. However, by the end of the term in June, they were at 92% expended in terms of the overall budget, and 98% expended in terms of the dollar amount that goes to actual veterans. They left a little less than 2% of the money on the table, later they asked for a 3 month extension and now they have 3 months to spend $4,000. The money has been allocated already.

Consideration and approval of a resolution in support of the Rio Grande Valley Equal Voice Network Housing Working Group's efforts to rectify ongoing issues with FEMA.

David Morales with the Rio Grande Valley Equal Voice Network spoke in regards to the acknowledgment of the deficiencies that occurred with Hurricane Dolly and the implementation of how FEMA performed duties, related to and resolving in lawsuits. As per Morales, one of the deficiencies was the delayed rate here, in comparison to other parts of the state. He disclosed that some families who were part of the suit and those who were delayed will receive about $11,000. Morales said that FEMA did not have any manuals or policies which caused a high level of issues and deficiencies. Thereupon, they are asking for assistance to take this one step higher and get FEMA to have manuals and procedures.
