COMMISSIONERS COURT MEETING

NOTICE is hereby given in accordance with Chapter 551, Texas Government Code, that a REGULAR MEETING of the Commissioners Court will be held in the Commissioners Courtroom of the Administration Building, 100 E. Cano, 1st floor, Edinburg, Hidalgo County, Texas. Discussion and possible action relating to the following business will be transacted:

Roll Call

Judge Ramon Garcia called the meeting to order at 9:30 a.m.

Commissioner Joe M. Flores was not present during roll call.

Commissioner Eduardo "Eddie" Cantu was the only absentee.

Pledge of Allegiance

Judge Garcia led the courtroom in reciting the Pledge of Allegiance.

Prayer

Opening prayer offered by Oliver De La Garza.

Approval of check register and payment of claims and bills - (Payments from Juvenile Probation, Adult Probation, LEOSE Fund, DA Motor Vehicle Theft Fund, DA Check Fraud Fund, DA Forfeiture Fund, Sheriff Forfeiture Funds, Constable Forfeiture Funds, HIDTA Forfeiture Funds and VIT Interest Fund are presented for recording purposes only.)

Commissioner Flores joined the meeting.

On motion by COMMISSIONER PCT. 1, DAVID FUENTES, seconded by COMMISSIONER PCT. 4, JOSEPH PALACIOS, the Court made a UNANIMOUS vote of approval.

Pursuant to Texas Local Government Code 111.070, approval of emergency appropriation from the General Fund - Fund Balance in the amount of $1,000,000 for emergency related expenditures, including but not limited to: pumping equipment and services (water extraction), fuel, and equipment repair services and supplies.

On motion by COMMISSIONER PCT. 1, DAVID FUENTES, seconded by COMMISSIONER PCT. 3, JOE M. FLORES, the Court made a UNANIMOUS vote of approval.

Approval of continuance of local state of disaster under Texas Government Code Section 418.108.

On motion by COMMISSIONER PCT. 3, JOE M. FLORES, seconded by COMMISSIONER PCT. 4, JOSEPH PALACIOS, the Court made a UNANIMOUS vote of approval.

Vote: 4 - 0 - Unanimously

Valde Guerra informed this is for a 7-day period, any further action would take place on the next commissioners court meeting set for July 3, 2018.

Applicable and necessary action to address flooding issues/situations directly attributable to torrential tropical rains beginning on June 19, 2018 including, but not limited to, the following:
A.  Ratification of activation [recommended by Emergency Mgmt. & the filing of Form 213] of Hidalgo County's Contracts:
     1. #E-17-267-11-14 with Asbritt, Inc., pre-positioned Emergency Debris Management Services to assist in flood waters extraction in Pct. #1 [minimum of 12 trucks on Sunday, June 25, 2018] including any signatures necessary by County Judge and processing of Requisitions/Purchase Orders; and,

On motion by COMMISSIONER PCT. 1, DAVID FUENTES, seconded by COMMISSIONER PCT. 4, JOSEPH PALACIOS, the Court made a UNANIMOUS vote of approval.

     2. #E-16-247-01-24 with Tetra Tech, Inc., pre-positioned Debris Monitoring & Recovery Services to assist in the required monitoring of water extraction and related services including signatures necessary by County Judge to sign with submission of Requisitions and processing of Purchase Orders ;

On motion by COMMISSIONER PCT. 3, JOE M. FLORES, seconded by COMMISSIONER PCT. 4, JOSEPH PALACIOS, the Court made a UNANIMOUS vote of approval.

Vote: 4 - 0 - Unanimously

B.  Action to activate the contracts detailed herein [i.e. Ashbritt, Inc. & Tetra Tech, Inc.] on an as needed basis as coordinated through  Emergency Management with submission of Form 213 for all Pcts. as necessary to address flooding situations either continuing through more rains or aftermath of said rain event commencing on June 19, 2018 with authority for County Judge to issue and sign Notices to Proceed with submission of Requisitions and processing of Purchase Order.

Martha Salazar noted that this also includes the secondary option with Ceres Environmental Services, Inc., in the event that the others can't cope with the work. 

On motion by COMMISSIONER PCT. 4, JOSEPH PALACIOS, seconded by COMMISSIONER PCT. 3, JOE M. FLORES, the Court made a UNANIMOUS vote of approval.

Vote: 4 - 0 – Unanimously

Commissioner David L. Fuentes notified that Republic turned the precinct away because they had met their threshold. The commissioner petitioned for Salazar to review the contracts of this and other transfer stations to be sure they are availabe when needed.

Discussion, consideration, and approval regarding Emergency Management Assistance Matrix, as per recommendation by Hidalgo County CSA Advisory Board. 

Valde Guerra informed that the type of crisis include: Individual Emergency Crisis, Disaster, Homeless/Displaced/Evacuation/Crime/Domestic/Violence Victim. Etc. and Emergency Weather Cries or Disaster.

On motion by COMMISSIONER PCT. 4, JOSEPH PALACIOS, seconded by COMMISSIONER PCT. 1, DAVID FUENTES, the Court made a UNANIMOUS vote of approval.
