NOTICE is hereby given in accordance with Chapter 551, Texas Government Code, that a SPECIAL MEETING of the Commissioners Court will be held in the Commissioners Courtroom of the Administration Building, 100 E. Cano, 1st floor, Edinburg, Hidalgo County, Texas. Discussion and possible action relating to the following business will be transacted:

Judge Garcia called the meeting to order at 10:12 a.m.

Commissioner David L. Fuentes was the only absentee.

The court moved to approve the entire consent agenda with the exception of Items. 10.C. & 11.G. to be pulled for further discussion.

Resolution in support of the Veterans Crisis Line, which features a toll free number 1-800-273-8255, press 1; online chat at www.veteranscrisisline/chat; and text-messaging service at 838255.

On motion by COMMISSIONER PCT. 4, JOSEPH PALACIOS, seconded by COMMISSIONER PCT. 2, EDUARDO “EDDIE” CANTU, the Court made a UNANIMOUS vote of approval.

Vote: 4 - 0 – Unanimously

Hidalgo County Community Service Agency Executive Director Jaime Longoria disclosed that they began this outreach through grant-funded money within the agency. Longoria said they began getting involved when the agency applied for a grant through the Texas Veterans Commission and recognized the lack of communication between veterans and the Veterans Administration.It was reported that nationwide, 20 veterans lose their lives to suicide and out of those 14 had no contact with the Veterans Administration. 

Texas Valley Coastal Bend Director Homero Martinez and a 20-year veteran said suicide is a national concern that affects all Americans. Currently they served 20 counties comprised of about 100,000 veterans of which 34,000 are currently seeking care through their health system. Recently, they have launched the toll free line which can be access through an app as well. 

Texas Valley Coastal Bend Health Care System Suicide Prevention Coordinator Dr. Rodolfo Quintana was thankful for approving the resolution as this is all about saving lives. 

Commissioner Palacios thanked CSA for securing this grant.

1. Presentation and approval of Hidalgo County Small Town Economic Development Grant Program awardees as ranked by the Hidalgo County Small Town Economic Development Grant Program Evaluation Committee.
2. Approval of Hidalgo County Small Town Economic Development Grant Program Agreement by and between Hidalgo County and program awardees.

Yolanda Chapa noted the items to be approved pending legal approval as there are questions by the auditor's office.

On motion by COMMISSIONER PCT. 2, EDUARDO “EDDIE” CANTU, seconded by COMMISSIONER PCT. 3, JOE FLORES, the Court made a UNANIMOUS vote of approval 1 & 2.

Vote: 4 - 0 -Unanimously 

Yolanda Chapa presented the winners of the Hidalgo County Small Town Economic Development Grant Program. Each small business received $20,000 grant totaling $100,000 to help boost development in the community. The winners were Reybotics, Green Thumb Nursery, Cappadona Ranch, Ashley Nicole Boutique, and Hernandez Barns. 

The evaluation committee was composed of the Lower Rio Grande Valley Development Council Economic Development Director Terrie Salinas, UT-RGV Professor Dr. Marco Garza, UT-RGV Director of the Rio Grande Valley Texas Rural Cooperative Center Dr. Collin Cain, RGV Partnership President Sergio Contreras, and Rio South Texas Economic Council Executive Director Matt Ruszczak.

Special acknowledgments were given to Hidalgo County Economic Development Director Michael Leo, Nestor Lopez and Virginia Jones. 

Judge Garcia said the money comes from the Comptroller Office specifically for economic development.

Commissioner Flores and Commissioner Cantu recognized the work done by the judge's office staff and the commitment by each of the business.

1. Requesting waiver of the Hidalgo County Tax Increment Reinvestment Zone (TIRZ) Policy, as to term.

Michael Leo informed that this is in reference to the Peñitas TIRZ project that was discussed with the court over a month ago. The city presented projects that they wanted to see through within the TIRZ, and also discussed some of the challenges that occurred such as the delayed of the La Joya bypass. Leo said if the court gives direction to move forward with an extension in the TIRZ, it would basically be a 30-year TRIZ starting now from this point moving forward. However, in order to this they need a waiver for the policy first.

On motion by COMMISSIONER PCT. 3, JOE M. FLORES, seconded by COMMISSIONER PCT. 2, EDUARDO “EDDIE” CANTU, the Court made a UNANIMOUS vote of approval.

Vote: 3 - 0 - Unanimously

Fern McClaugherty noted there has to be special circumstances for the TIRZ to go over 20-years and asked what the special circumstances are for this specific one to be 44 years. With regards, Leo explained that the 20-years is what they currently have the policy on for new TIRZ however, when Peñitas was initially approved they didn't have this policy. The TIRZ they were doing at that time were for 30-years. However, according to Leo, as far as extensions they can go up to 10 years for a total of 40 years. In this particular one, it is a total of 44-years.

2. Requesting approval of Amendment and Restated Interlocal Agreement between Hidalgo County, City of Penitas, and Reinvestment Zone Number One, City of Penitas.

According to Leo, even though they are extending the years, they are not going to contribute additional money. Initial contribution amount is still the same. He requested the court for approval subject to legal. 

On motion by COMMISSIONER PCT. 3, JOE M. FLORES, seconded by COMMISSIONER PCT. 2, EDUARDO “EDDIE” CANTU, the Court made a UNANIMOUS vote of approval subject to legal.

Victor Gallardo explained that this is located on Conway around the 9 Mile area, this piece of property is landlocked. The section between the property and the road way is Hidalgo County owned. Gallardo informed that the county has a right-of-way that was given by the old rail road. 

John A. Rigney said his client is purchasing this property and there is a 9 acre piece of land that has approximately 20 feet of easement between the subject property and Conway. The attorney explained that years ago, Conway used to be divided into two different rail roads and there was a rail road right-of-way right down the center of it. Therefore, they are asking for an access easement to enter into the subject.

Fern McClaugherty disclosed that a certain employee has been found sleeping during work hours. Additionally, she said she received calls regarding a lady who asked Magic Valley to place light poles on her private property. McClaugherty stated concerns over the matter and asked if this is being done at county's expense. Furthermore, she noted that comptroller's money is tax payers money. McClaugherty also asked about the amount of bonds that the county has sold in order to afford the construction of the new courthouse.
