NOTICE is hereby given in accordance with Chapter 551, Texas Government Code, that a SPECIAL MEETING of the Commissioners Court will be held in the Commissioners Courtroom of the Administration Building, 100 E. Cano, 1st floor, Edinburg, Hidalgo County, Texas. Discussion and possible action relating to the following business will be transacted:

Resolution in honor of Hidalgo County Treasurer Norma G. Garcia.

Court approved a resolution honoring the upcoming retirement of Hidalgo County Treasurer Norma G. Garcia and presented acknowledgements for the 24 years of service to county residents. Garcia was recognized for serving on the executive board of the County Treasurer' Association and implementing direct deposit for county employees, in addition to being instrumental in implementing the biometric time and attendance program. 

On motion by COMMISSIONER PCT. 1, DAVID FUENTES, seconded by COMMISSIONER PCT. 4, JOSEPH PALACIOS, the Court made a UNANIMOUS vote of approval.

Ms. Garcia thanked her office family for all their dedication throughout the years.

Acknowledgment of receipt of a Texas Association of Telecommunication Officers and Advisors (TATOA) video award presented to Hidalgo County Public Affairs Division and recognition of Multimedia Coordinator Jaclyn Treviño.

Commissioners Court honored Hidalgo County Multimedia Coordinator Jaclyn Treviño for achieving consecutive recognition at the Texas Association of Telecommunication Officers and annual conference in Dallas. This year the multimedia coordinator brought recognition to the public affairs department by receiving 3rd place TATOA Award for Overall Excellence and three honorable mentions in the following categories: Community Event Coverage for the video titled "Sheriff’s Office Fallen Heroes Ceremony;" Public Affairs for  "Motorcycle Safety Awareness Month;" and Public Service Announcement for "Don’t Drive!  Call 9-1-1".

Treviño thanked the entire court for their continuous support and said was eager to continue creating videos for the county.

Discussion, consideration and action on Texas Enterprise Zone Program Mandatory Annual report form and authority for Michael Leo, county designee, to sign all related documents.

Leo informed that the state provided incentives not the county.

Valde Guerra notified there was a public participation form asking what "slightly positive" meant. On that note, Leo informed that taxes were generated from the property/project as real property taxes and personal taxes regarding machinery and equipment. Once again, he restated that this was slightly positive because the county did not offered any incentives or abetments, but rather only supported the project and still benefited by collecting taxes. 

On motion by COMMISSIONER PCT. 4, JOSEPH PALACIOS, seconded by COMMISSIONER PCT. 1, DAVID FUENTES, the Court made a UNANIMOUS vote of approval.

Discussion and approval of Tax Abatement Agreement between Hidalgo County and Monte Alto/West Willacy Windpower, LLC and approve order on the same.

Commissioner Cantu asked Leo to disclosed each amount per project. Leo, informed that this particular project is $228 million but this one has parts in Willacy County and only has about 70 % to 75%  investment in Hidalgo County. However, the revenue is of about $40 million in tax over the next 10 years. 

Steve Crain informed that the order allows the judge to make minor changes and asked to be adopted subject to legal review. 

On motion by COMMISSIONER PCT. 1, DAVID FUENTES, seconded by COMMISSIONER PCT. 4, JOSEPH PALACIOS, the Court made a UNANIMOUS vote of approval subject to legal review.

Commissioner Cantu underlined that they  worked hard to keep as much money in Hidalgo County. Commissioner Fuentes asked about the total jobs created. With regards, Leo informed that the actual permanent job creation is about 10 to 15 positions. 

Crain noted that all these orders needed to be adopted today due to statute.

Michael Leo informed that this project is 100% in Hidalgo County. 

Steve Crain restated that because the order allows the judge to make minor changes it must be approved subject to legal review.

Leo explained that this is a different project where McAllen is doing an expansion.

Commissioner Cantu commented that they always try to support the cities but never do more than what the city itself does.

Presentation for discussion of the following: 
1) Update on ongoing county owned building construction, relocation and/or renovation repair projects 

Courthouse project manager Brian McIntyre updated the court on the ongoing project. The current progress to date indicates 95% of construction documents completed, basically the final documents minus reviews and comments from the team and addressing the comments. In addition to 50% CD/100% structural GMP approved, and building permit received for 100% structural. McIntyre informed that the meeting with Edinburg will be to obtain the full building permit, they currently have permits for structural, civil and underground utilities but will have the rest of the building permits once they have 100% permits at hand. According to the project manager, they provided the city with a copy for their review. At the moment there are 162 piers installed, and expect to finish with piers in about one month. The largest pier is about 7 feet across and about 70 feet deep.  

Looking ahead by January they expect to have 100 % construction document design packet, and slab on grade to begin late that same month. In the next 60 days they will continue to work on foundation and piers in areas (a) and (b) as well as site utilities.

Resolution honoring County Judge Ramon Garcia by designating the law library in the new Hidalgo County Courthouse as the Hidalgo County Judge Ramon Garcia Law Library.

In honor of Judge Garcia's three honorable consecutive terms as county judge, the court approved a resolution designating the law library in the new Hidalgo County Courthouse as Hidalgo County Judge Ramon Garcia Law Library. His son Orlando Garcia accepted the dedication and plaque on behalf of the judge. 

Commissioner Palacios who spearheaded the endeavor, said this was a mutual effort by the entire court in recognition of years of contribution to the people of Hidalgo County by Judge Garcia.

On motion by COMMISSIONER PCT. 4, JOSEPH PALACIOS, seconded by COMMISSIONER PCT. 1, DAVID FUENTES, the Court made a UNANIMOUS vote of approval.

Yolanda Chapa thanked Commissioner Palacios for spearheading the project and also thanked the rest of the commissioners for supporting such project. She reminded the public of the the judge's efforts to always be transparent and present accountability for every decision during all projects but specially the new courthouse project. 

Orlando Garcia accepted the designation on behalf of Judge Garcia.

Discussion/Approval of Hidalgo County Head Start Program Policy Council By Laws

Teresa Flores informed that the by laws have been reviewed by Steve Crain. One of the major change is the time of service, 
(5) one-year terms instead of the 3. The other change has to do with the community at large, for representatives. The rest of it has to do with the law, and their organization in six areas with parent representation 6 parents and 2 alternates for each parent and 5 community members. 

Crain commented that they worked well together but there was some revisions that were just sent out yesterday and therefore he asked approving the item subject to final legal review.

Diana Serna informed that this has to do with the Colonia Self-Help Center Program and various service projects for White Wing Subdivision, Roadrunner No.2, Linda Vista Estates, and Muñiz and Carlos acres. These are subdivisions identified in the 2016 application. Among the projects, they also have technology access, tool learning, solid waste removal, administration and planning, and repairs and rehabilitation of homes. Additionally, they are requesting to amend the submission of unsuitable reconstruction of homes to the Texas Department of Housing and Community Affairs to have technology access. According to Serna, the office tried working with Precinct 2 on getting the use of the technology bus, however, (TDHCA) indicated that if they do decide to buy equipment the only people that can utilized the equipment are those who reside in White Wing Subdivision.
