1.  Discussion regarding Election updates (Audio Reference 1h:05m 22s)

Yvonne Ramon from the Elections Department stated that on Friday April 17th, Judge Tim Sulak of the 353rd State District Court ruled that Texas voters are eligible to apply for mail ballots under the disability provision of the Texas Election Code. Furthermore, Mrs. Ramon stated that on the same day Texas Attorney General, Ken Paxton, filed notice that he would appeal Judge Sulak's ruling to the third court of appeals. Furthermore on May 1, 2020 a letter was received by the Elections Department by Attorney General, Ken Paxton, stating any advisement to voters non - authorized by the election code could subject those third parties to criminal sanctions imposed by the Texas Election Code. Mrs. Ramon further stated though there is a court order, pending litigation, and a possible appeal, the Elections Department is informing the voters that they decide if they meet the disability mail ballot law. As long as the box under disability is checked off the application will be processed accordingly. Mrs. Ramon continued stating that it was not determined by the Elections Department who is disabled or not. A voter has never had to send in supporting documents proving their disability. Mrs. Ramon also stated that the disability box must be checked off, or the application will be rejected even if the voter writes an explanation. Mrs. Ramon also stated that she is collaborating with the Emergency Management Department, Health Department, and Facilities Management for guidance as to the needs for safety during elections.

No action was taken on item 17.A.1.

2.  Discussion, consideration and approval to pay any extra duty hours to be worked by the Hidalgo County Elections Department in preparation for any local, state and federal elections and runoff elections that are to be held throughout 2020 in accordance with Hidalgo County Civil Service Commission Rules. Mrs. Ramon stated that there are 28 permanent early voting locations and the Elections Department is working with each entity to practice social distancing and safety.

Judge Cortez questioned if the expenditures are in compliance with the guidelines. In which, Sergio Cruz from the Budget office reassured that they reviewed the guidelines given by the U.S Treasury, which state as so long as the expenditures are related to the affects of the COVID-19 virus. 

Commissioner Cantu read for the record from the Corona Virus Relief Fund guidelines from April 22, 2020, that the statute also specifies that expenditures using fund payments must be necessary. The Department of the Treasury also understands this term broadly to mean that the expenditure is reasonably necessary for its intended use in the reasonable judgement of the government officials responsible for spending the money. Commissioner Cantu also read for the record a frequently asked question on the Department of Treasury's website if the governments are required to submit proposed expenditures to the Department of Treasury for approval, in which Commissioner Cantu stated that the answer was no. The governments are responsible for making determinations as to what expenditures are necessary.
