Authorization to release the minutes from the May 19, 2026, Executive Session 9A to Jones, Skeleton & Hochuli, P.L.C.
Background Information
The Board of Supervisors may hold an Executive Session for an enumerated purpose under A.R.S. § 38-431.03(A).
On May 19, 2026, the Board of Supervisors entered into Executive Session pursuant to A.R.S. § 38-431.03(A)(1) and (3) for the annual performance review of the former County Manager, James Menlove, and for discussion and consultation for legal advice with the Board's attorney(s).
Minutes of, and discussions made, at Executive Sessions shall be kept confidential except from:
1. Members of the public body that met in Executive Session.
2. Officers, appointees or employees who were the subject of discussion or consideration pursuant to subsection A, paragraph 1 of this section.
3. The auditor general on a request made in connection with an audit authorized as provided by law.
4. A county attorney or the attorney general when investigating alleged violations of this article.
Disclosure of Executive Session information does not constitute a waiver of any privilege, including the attorney-client privilege. Any person receiving executive session information shall not disclose that information except to the attorney general or county attorney, by agreement with the public body or to a court in camera for purposes of enforcing this article. A.R.S. § 38-431.03(F)
The minutes from the May 19, 2026, Executive Session are being requested by Jones, Skeleton & Hochuli, P.L.C., who has been assigned by the Arizona County Insurance Pool to represent the County in matters relating to James Menlove.

Conclusion
Due to the strict confidentiality framework under A.R.S. § 38-431.03, the County Attorney's Office requests that the Board of Supervisors formally authorize the disclosure of the minutes from the Executive Session, 9A, to Jones, Skeleton & Hochuli, P.L.C to assist in the representation of the County in matters relating to James Menlove.
Recommendation
It is the recommendation of the County Attorney's Office that the Board of Supervisors authorize the release of the minutes from the May 19, 2026, Executive Session 9A to Jones, Skeleton & Hochuli, P.L.C., as permitted by A.R.S. § 38-431.03(F).
