FISCAL IMPACT
Capital Improvement Program (CIP) Project #42043 Bullard Widening Southbound at Van Buren will be added to the FY2022-26 CIP with a project budget of $1,555,300. This authorizes required budget transfers to establish funding in FY2022 allowing the project to start.

BACKGROUND AND PREVIOUS ACTIONS
Council has directed staff to identify and develop CIP projects that will increase transportation efficiencies and eliminate scalloped streets. This project will add approximately 600 linear feet of roadway improvements to Bullard south of Van Buren, eliminating the scalloped roadway. This is a new project with no previous actions.
STAFF ANALYSIS
Staff recommends adding this project into the CIP. If approved, a proposed timeline includes project design beginning March 2022, land acquisition in May 2022, project construction in May 2023, and project completion in December 2023. Depending on land acquisition the construction start may be delayed or advanced.
Completion of this project will benefit property west of the roadway. Of the approximately 600 lineal feet of widening proposed, approximately 125 of those feet are adjacent to what will be city owned land from CIP project #41003 – Economic Development Department’s Enhanced Bullard Landscape. The remaining approximately 475 feet of improvements will benefit non-city owned land; therefore, a cost recovery will be established to recover costs per the City’s Cost Recovery Ordinance. Requirements to establish a cost recovery are outlined in the “Goodyear Code of Ordinances Chapter 24 Public Improvements Cost Recovery” and are as follows:
As soon as this budget transfer is authorized, procurement activities can start for delivering this project utilizing the Job Order Contracting project delivery method. As the design progresses, an actual construction cost will be established within the approved budget. After construction and acceptance of the improvements, final costs (including land acquisition) are submitted and compared to the ROI costs in order for the city to establish a fair and reasonable Reimbursement Agreement per the Cost Recovery Ordinance.
The costs of land acquisition for Economic Development Department’s Enhanced Bullard Landscape & Branding project (CIP project# 41003), are separate from this proposed project, and will not be a part of cost recovery. The scope of CIP project# 41003 has been reduced to just land acquisition, and construction of monument feature(s) has been put on an indefinite hold.

(3) Those owners of real property within the area subject to reimbursement for special public improvements shall receive notice in writing of the public hearing and any continued public hearing not less than 30 days prior to the public hearing or continued public hearing held by the city council.
(4) After the public hearing is concluded, the City Council shall determine whether the public health, safety, and welfare require the special public improvements. If the City Council so determines, then the City Council shall adopt the ROI to approve the special public improvement.
