SUMMARY

A final plat for Pradera Phase 3 Parcel E subdividing approximately 24.74 acres into 75 single family lots and ten tracts on property zoned R1-4, R1-6 (Single Family Detached) generally located at the southeast corner of Durango Street and 183rd Avenue. The typical lot size is 55 feet wide by 120 feet deep.

Recommendation

Approve the Final Plat for Pradera Phase 3 Parcel E subdividing approximately 19.97 acres into 75 single family lots and ten tracts on property zoned R1-4, R1-6 (Single Family Detached) located at the southeast corner of Durango Street and 183rd Avenue, subject to stipulations. STIPULATIONS

  1. Prior to recordation of the Final Plat for Pradera Phase 3 Parcel E (the “Phase 3E Final Plat”), a current title report for the property included within the boundaries of the Phase 3E Final Plat (the “Platted Property” shall be being provided to the City Engineer or his/her designee.  The Phase 3E Final Plat shall be modified to reflect the current ownership and current lender as reflected in the current title report, including a Lender Consent and Subordination in a form approved by the City Attorney or his/her designee for all lenders with a security interest in the Platted Property.  The Phase 3E Final Plat shall not be recorded if the current title report provided the city reflects any interest in the Platted Property inconsistent with or adverse to the dedications, conveyances, or other property interests created by the Phase 3E Final Plat or transferred by the Phase 3E Final Plat;
  2. The Phase 3E Final Plat shall not be recorded until: (i) all construction documents for the public infrastructure to be constructed within Platted Property and pursuant to the stipulations set forth herein have been approved by the City Engineer or designee; (ii) any technical corrections to the Phase 3E Final Plat required by the City Engineer or designee have been made; and (iii) all required signatures on the mylar of the Phase 3E Final Plat have been obtained;
  3. Prior to recordation of the Phase 3E Final Plat, the Map of Dedication Pradera Phase 3 being presented by separate council action concurrently with the Phase 3E Final Plat (the “Phase 3 MOD”) shall be recorded in the official records of the Maricopa County Recorder (“MCR”), and the recording number shall be inserted on mylar copy of the final plat for Durango and 183rd Avenue;
  4. The Phase 3E Final Plat shall not be recorded unless either (i) the Final Plat for Pradera Phase 3 Parcel D and the Final Plat for Pradera Phase 3 Parcel F being presented by separate council action concurrently with the Phase 3E Final Plat are both recorded simultaneously with the Phase 3E Final Plat or until the City has been provided all necessary easements and/or right-of-way required for secondary emergency access, for the construction of water and/or wastewater infrastructure needed to serve the Platted Property, and for the construction of drainage facilities;
  5. Prior to the issuance of any Certificate of Completion, Temporary Certificate of Occupancy or Certificate of Occupancy for any structure within the Platted Property, the following infrastructure improvements shall have been completed and accepted by the City Engineer or his/her designee subject to the completion of the two-year warranty period:
a. Full half-street improvements for the south half of W. Durango Street from the center line of 183rd Avenue to the center line of South 181st Avenue.  The improvements shall be those required in the Engineering Design Standards and Policies for a minor collector, which include, but are not limited to, pavement, curb and gutter, sidewalks, street frontage landscape and landscape irrigation, and street lighting; and
b. Full half-street improvements for the east half of 183rd Avenue from the Center line of W. Durango Street to the center line of West Lower Buckeye Road.  The improvements shall be those required in the Engineering Design Standards and Policies for a minor collector, which include, but are not limited to, pavement, curb and gutter, sidewalks, street frontage landscape and landscape irrigation, and street lighting; and
c.Full half-street improvements for the north half of W. Lower Buckeye Road from the center line of 183rd Avenue to the center line of S. 181st Avenue.  The improvements shall be those required in the Engineering Design Standards and Policies for a minor arterial, which include, but are not limited to, pavement, curb and gutter, sidewalks, street frontage landscape and landscape irrigation, and street lighting.
  1. Prior to the issuance of any Certificate of Completion, Temporary Certificate of Occupancy or Certificate of Occupancy for any structure within the Platted Property, all of the infrastructure improvements (streets, water, sewer, and drainage) that were to be completed with the development of Phase 1 Parcels A and C as reflected in the Phasing Plan approved with the Preliminary plat for Pradera, a copy of which is attached hereto, shall have been completed and accepted by the City Engineer or his/her designee subject to the completion of the two-year warranty period;
  2. In addition to the specific infrastructure identified herein, the Owner of the Platted Property shall construct or cause the construction of all infrastructure improvements required by the city of Goodyear subdivision regulations and Engineering Design Standards and Policy Manual in effect at the time of construction;
  3. The Owner of the Platted Property shall dedicate, at no cost to the city, all rights-of-way and/or easements within the boundaries of the Property that are: (i) needed for the construction of infrastructure improvements required for the city to provide water and wastewater services to the Property; (ii) required to be dedicated under any applicable law, code, ordinance, rule, regulations, standards, guidelines governing the development of the Property including, but not limited to the City of Goodyear subdivision regulations, Building Codes and Regulations, and the City of Goodyear’s Engineering Design Standards and Policies; (iii) required for the construction of improvements for which Owner is responsible for making in-lieu payments; (iv) required to be dedicated pursuant to any development agreement with the city regarding the development of the Property; (v) required for the construction of the infrastructure improvements to be constructed pursuant to the stipulations herein; and (vi) required for public infrastructure improvements that is required to be constructed pursuant to any applicable law, code, ordinance, rule, regulations, standards, guidelines governing the development of the Platted Property including, but not limited to the City of Goodyear subdivision regulations, Building Codes and Regulations, and the City of Goodyear’s Engineering Design Standards and Policies;
  4. Prior to the issuance of any building permits for any structure within the Platted Property, the Pradera Community Association, Inc. an Arizona non-profit corporation (the “HOA”) shall enter into an enforceable operation and maintenance agreement in a form approved by the City Attorney of his designee that identifies the HOA’s responsibility for maintaining, repairing, and replacing of stormwater facilities constructed pursuant to engineering plans approved by the City Engineer or his/her designee (the “Storm Water System”) within the property subject to Ordinance 2018-1385 recorded in the Official records of Maricopa County Recorder at document no. 2018 0394939 and the HOA’s responsibility for ensuring the Storm Water System functions as designed;
  5. The Public Sales Report shall include a statement that Pradera is subject to attendant noise, vibrations, dust, and all other effects that may be caused by overflight and by the operation of aircraft landing at, or taking off from, Luke Air Force Base and/or the Phoenix-Goodyear Airport; and,
  6. The Public Sales Report shall include a statement that Pradera is within the vicinity of a proposed 230 kV overhead electrical line planned along the west side of Perryville Road.

FISCAL IMPACT

Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the city. The development is responsible for construction of infrastructure necessary to serve the site and will generate one-time revenue for the city through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.
 

BACKGROUND AND PREVIOUS ACTIONS


On July 10, 2006, the Goodyear City Council adopted Ordinance No. 2006-1021 rezoning approximately 160 acres generally located at the northwest corner of Lower Buckeye Road and Citrus Road to the Planned Area Development (PAD) District for a development to be known as Pradera (the “Pradera Property”).  That same day, council approved a Preliminary Plat for the Pradera Property.  On May 14, 2018, the Goodyear City Council adopted Ordinance No. 2018-1385 rezoning the Pradera Property from the PAD District to R1-4 and R1-6 (Single Family Detached).

The July 10, 2006 approval of the preliminary plat approval was vested by terms of a development agreement, and on June 10, 2019, a Final Plat for Phase One of Pradera was approved by the Goodyear City Council (the “Phase 1 Final Plat”).  The Phase 1 Final Plat was consistent with the zoning adopted by Ordinance No. 2018-1385 and was consistent with the preliminary plat approved on July 10, 2006.  To allow for the development of smaller lots allowed for under Ordinance No. 2018-1385, a preliminary plat for Phases 2B and 3 of Pradera was approved by the City Council on August 19, 2019.
 

STAFF ANALYSIS

The final plat substantially conforms to the approved preliminary plat for Phases 2B and 3 of Pradera and is consistent with the technical requirements of the city’s subdivision regulations and engineering standards and provides for the orderly development of the property by identifying the required infrastructure needed to serve the development.  Further, as set forth in the attached preliminary plat Council Action Report, the proposed subdivision is consistent with the General Plan and will not adversely impact the surrounding area.
