SUBJECT: TERMINATION AND RELEASE OF A WATER LINE EASEMENT ASSOCIATED WITH THE SUNWEST FEDERAL CREDIT UNION SITE

SUMMARY

Approval of the partial termination and release of a Water Line Easement associated with the SunWest Federal Credit Union site.
 

Recommendation

Approve and authorize execution of the Partial Termination and Release of Easement terminating a portion of a water line easement located within Pebble Creek Marketplace. (Linda Beals, Real Estate Coordinator)

FISCAL IMPACT

There will be no fiscal impact to the city in the fiscal year 2022 or future years related to the partial termination and release of this easement.

BACKGROUND AND PREVIOUS ACTIONS

On or about August 20, 2018, the City approved the Final Plat for Pebble Creek Marketplace which was recorded in the official records of Maricopa County on March 15, 2019, in Book 1447, Page 1 (“Final Plat”).  The Final Plat included a dedication of a Water Easement, a portion of which is located on Lot 4 of the Final Plat (“Water Line Easement”).
 
SunWest Federal Credit Union is in the process of developing Lot 4 of the Final Plat, and the driveway location requires the termination of the portion Water Line Easement located in Lot 4 of the Final Plat, as described in Exhibit “A” of the attached Partial Termination and Release of Easement (“Release Area”).  There has been no water infrastructure placed or constructed within the Release Area of the existing Water Line Easement.

STAFF ANALYSIS

Sunwest Federal Credit Union has provided the City with a replacement Water Meter and Water Line Easement for the new location of the water meter and associated water line, which will be recorded immediately after the recordation of the Partial Termination and Release of Easement document.  City staff has determined that the portion of the existing Water Line Easement subject to the termination will no longer be necessary, upon the recordation of the new Water Meter and Water Line Easement.  Therefore, City staff is recommending the partial termination of the existing Water Line Easement.
