SUBJECT: FINAL PLATS OF ESTRELLA PARCELS 11.E, 11.F1, 11.I1, AND 11.I2

SUMMARY

Final Plats of Estrella Parcel 11.E, 11.F1, 11.I1, 11.I2 (the “Community 11 Final Plats”) subdividing approximately 62 acres into 211 lots and 14 tracts west of South Hillside Drive within the Lucero Community.

Recommendation

Approve the Final Plat for Estrella Parcel 11.E, the Final Plat for Estrella Parcel 11.F1, the Final Plat for Estrella Parcel 11.I1 and the Final Plat for 11.I2 (collectively the “Community 11 Final Plats”) subject to stipulations. (Steve Scinto, Deputy Director of Development Engineering)

STIPULATIONS

  1. Any technical corrections to any of the Community 11 Final Plats being approved herein required by the City Engineer or his designee shall be made prior to the recordation of such Community 11 Final Plat;
  2. Prior to recordation of each of the Community 11 Final Plats, a separate and current title report shall be provided to the City Engineer or his/her designee for the property included within the boundaries of each of the Community 11 Final Plats (the “Platted Property”).  Each of the Community 11 Final Plats shall be modified to reflect the current ownership and current lender as reflected in the current title report, including a Lender Consent and Subordination in a form approved by the City Attorney or his/her designee for all lenders with a security interest in the Platted Property.  No Community 11 Final Plat shall be recorded if the current title report provided for such Community 11 Final Plat reflects any interest in the Platted Property inconsistent with or adverse to the dedications, conveyances, or other property interests created or conveyed in such Community 11 Final Plat. 
  3. Prior to recordation of each of the Community 11 Final Plats, documentation acceptable to the City Attorney or his/her designee shall be provided demonstrating that the party executing such final plat is authorized to do so
  4. Prior to recordation of any of the Community 11 Final Plats, fully executed copies of all of the easements and conveyances identified in the Community 11 Final Plats as being conveyed by separate instrument shall be recorded in the official records of the Maricopa County Recorder (“MCR”) and the recording information for each recorded conveyance (easement, special warranty deed and Map of Dedication) shall be inserted in the Community 11 Final Plats as applicable.  This includes all of the following:
    1. The Map of Dedication for W. Ardmore Road being approved by separate action during the July 11, 2022, regular meeting of the Goodyear City Council
    2. The Map of Dedication for S. Sendero Drive Phase 3 being approved by separate action during the July 11, 2022, regular meeting of the Goodyear City Council
    3. The Special Warranty Deed for the Sendero Lift Station being approved by separate action during the July 11, 2022, regular meeting of the Goodyear City Council
    4. The easement needed for the Sendero Lift Station force main that will be located north of Estrella Parcel 11.I1 and will connect to an existing 20’ wide sanitary sewer easement as recorded in the MCR at instrument 2018-0386172
    5. A public utility easement along the section of W. Ardmore Road that is subject to the Map of Dedication for W. Ardmore Road referred to above
    6. Public utility easements along the sections of S. Sendero Drive including the section of S. Sendero Drive that is subject to the Map of Dedication for S. Sendero Drive referred to above
    7. An Access Easement – Ardmore Connection to connect the future Ardmore Road right-of-way to an existing access easement recorded in the MCR at instrument 2018-03861701. 

FISCAL IMPACT

Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.

BACKGROUND AND PREVIOUS ACTIONS

The preliminary plat for each respective parcel was approved by City Council on the dates listed below.
  • Estrella Parcel 11.E was approved by the City Council on December 17, 2018. A one-year extension of the preliminary plat approval was extended by City Council on February 24, 2020.
  • Estrella Parcel 11.F1 was approved by the City Council on February 29, 2019. A one-year extension of the preliminary plat approval was extended by City Council on February 24, 2020.
  • Estrella Parcel 11.I1 was approved by the City Council on February 8, 2021.
  • Estrella Parcel 11.I2 was approved by the City Council on April 26, 2021.
     

STAFF ANALYSIS

This Council Action Report has been combined for the four respective final plats because the approval of each subdivision is contingent on all of them being approved and to provide for a more efficient approval process. The four subdivision plats will be recorded separately.

The proposed subdivisions are consistent with the technical requirements of the city’s subdivision regulations and engineering standards, and provide for the orderly development of the property by identifying the required infrastructure needed to serve the property within each subdivision final plat.  The Final Plats are in substantial conformance with the Preliminary Plats described above, and as set forth in the Council Action Reports for the Preliminary Plats for Estrella Parcel 11.E, the Council Action Reports for the Preliminary Plats for Estrella Parcel 11.F1, the Council Action Reports for the Preliminary Plats for Estrella Parcel 11.I1 and the Council Action Reports for the Preliminary Plats for Estrella Parcel 11.I2, all of which are on file with the Goodyear City Clerk, each of the proposed subdivisions is consistent with the General Plan and will not adversely impact the surrounding area.
