SUMMARY
A map of dedication to dedicate the right-of-way required to construct approximately 0.47 miles of South Sendero Drive extended west from its current location.
Recommendation
Approve the Map of Dedication for South Sendero Drive - Phase 3 , subject to stipulations. (Steve Scinto, Deputy Director of Development Engineering)
STIPULATIONS
- Any technical corrections to the Map of Dedication (MOD) required by the City Engineer or his designee shall be made prior to the recordation of the MOD;
- Prior to recordation of this MOD, Owner shall provide a current title report and the MOD shall be revised to reflect current the current ownership of the property included within the MOD and shall include Lender’s Consent for all lenders with an interest in the property included within the MOD;
- Prior to recordation of the Map of Dedication, documentation acceptable to the City Attorney or his/her designee shall be provided demonstrating that the party executing the MOD is authorized to do so;
- Prior to recordation of the MOD, the easements identified in the MOD as being dedicated by separate instrument shall be recorded, and the recording information needs to be inserted, this includes the Public Utility and Sidewalk Easements (identified as PUE); and
- The northern boundary of the section of South Sendero Drive being dedicated in this MOD connects with a portion of the South Sendero Drive located with that certain real property currently known as Estrella Parcel 11.E. This MOD shall not be recorded until the Final Plat for Estrella Parcel 11.E. has been recorded.
FISCAL IMPACT
Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.
BACKGROUND AND PREVIOUS ACTIONS
The Final Plat for Estrella Parcel 11.H subdivision was approved by the City Council on September 13, 2021, and Final Plats for Estrella Parcels 11.I1, 11.I2, and 11.E are being presented to council for approval by separate action concurrently with this MOD.
STAFF ANALYSIS
The right-of-way included within the Map of Dedication for South Sendero Drive – Phase 3 is needed to provide access and connectivity to and between property being developed included within the Final Plats for Estrella Parcels 11.H, 11.I1, 11.I2, and 11.E.
